Alice in Wonderland

Once upon a time a little girl called Alice was dozing one summer afternoon on a meadow when she saw a strange sight. A white rabbit wearing a blue coat was running on its hind legs, looking at his watch and saying "I am late". Alice got up and ran after him, but the rabbit jumped into a hole in the ground. Alice followed the rabbit into the hole, and she fell and fell, until she landed with a loud thump somewhere far below.

She got up and saw a strange sight. A group of young women were walking in a procession carrying placards on which were written "Hang the rapists', 'Castrate all men', 'Stone them to death' etc.

Alice silently followed this marvellous procession. At one place a child in tatters came upto the procession and asked for some bread as he was hungry. "Get lost" said one of the young ladies, "Hunger is nonsense. The only real issue in the world is rape. Have you been raped ?". "No", replied the child,"but I have not eaten for two days". The ladies retorted "Then you have no problem. The only problem in the world is rape. Hunger is Maya, an illusion, as Vedanta philosophy teaches. The only reality is rape", and saying so the procession moved on, with Alice following.

They then came across a poor woman carrying a sick child in her arms. She begged for some money to buy medicines for her child. "Have you been raped?", asked the processionists. "No" she replied "But my child is sick and may die without medicines". "You have no problem since you have not been raped" said the ladies, "Healthcare is a frivolous and insignificant issue. The only real issue in the world is rape", and saying so moved on.

They then came across an unemployed young man, and asked him whether he had been raped. He replied in the negative, but added that he had a masters degree from a University but was prepared to do even a peon's job so that he may survive. They cursed him for speaking such a trivial thing.

In this way the procession went on and on, with the processionists, who were shouting slogans against rape, being frequently accosted by persons who raised issues other than rape like skyrocketing prices, widespread child malnutrition, largescale farmers suicide, etc, whom they brushed aside with derision and ridicule, saying that you are raising trifling issues when the issue of rape was a matter of life and death for the human race.

After some time the processionists came across another group of women who had angrily blocked their path. "Please join us" said the processionists, "We are fighting for a common cause". "And what is that cause ?" asked the blockaders. The processionists said "Our cause is that we want people to forget poverty, price rise, healthcare, malnutrition, farmers suicide, etc and declare that the only issue in the world is rape". 

"Do you even know the prices of vegetables which are touching the sky ? Do you even know how almost impossible it has become to feed our families ?", asked the blockaders. The processionists, who appeared to be well fed and well dressed ladies, said "No".

On hearing this the blockaders fell on the processionists with lathis, fisticuffs, etc, and this violent scene made Alice wake up, and realize she was dreaming

    Why ppl are not protesting for 2 lakh farmers suicides in last 15 years. Why not a hue and cry for 47% malnouriushed children.

    Why no one protesting for our soldiers getting killed??

    Why no one is concerned over ppl getting died due to extreme cold in NOrth Delhi??

    I think the TRP led media overhyped the incident.

    As the Victim's friend saaid," Lighting Candles will not solve the problem, we have to think about it rationally. Society needs to change its mindset and should help in need.

  3. Thanks Justice Katju for a great piece! These neo-middle classes are polarising the country to dangerous path! They are "provincial propertied class (PPC) and landing the entire country to a "new middle-caste propertied to their upper caste counnter-parts." And in this game regional parties are also responsible. In the last 20 years, these regional parties are creating worse situation in the country by alternating with either major parties like Congress and BJP. However a few states, having major chunk of Muslim population , are untouched with such phenomena.In other states Hindutva forces are emerging menacingly and giving ominous signal of fascist and authoritarian rule of 'Gujarat-type'.

  4. 100% correct... When it comes to anti-corruption rallies every other problem is hidden... And now the present situation... Atleast the patience to hold to the problem till it is solved is absent... Someone organises the protests or rallies,people participate and they think their job is done...The solution to these problem will come only when people realise that all social problems are linked to one another and form the base of crimes.........

    India is a patriarchy and we have a feudal society here.
    Even after lot of hype been created and so much awareness in the coutry there are many brutal incidents of rape and other crimes against women are reported after DEC 16!

    Why it is so .. After so much protests there are about 20 gang rape reported in the country. Why??

    Creating new law will not solve the issue. Society needs to change mindset raising slogans will not end this.

  7. An eye opener for everyone in India because nowadays in India Rape has became a national problem and nothing can't be bigger than that and everyone is blaming for this our legal system. But they didn't know that the problem is not with the laws but with the people itself, when it comes to sex education in schools these people stand to prevent education in the name of culture etc. As Sir Katju said in his previous article that 90% Indian are fools, now it is corroborated by the present situation and i think these numbers might increase in future if people living in metros and big towns didn't accepted that we himself are somewhere doing something wrong and not equally treating our other brothers and sisters in this country.

  9. Does the country's judiciary really care for the country? Don't u think that like all other highly placed ppl in the country, they are always trying to "solve the wrong problem". The judiciary is more concerned about the "wordings" in the law about the sun films on the vehicles. Why don't they make some "time bound" solutions to Crores of cases lying in their courts for years. What is the point in giving a life sentence or capital punishment to a person who is in his 80s or 70s for a criminal or civil case that he committed when he was 40 or 50 (like the case of bhopal union carbide). It is high time we should have service level agreement like keep a time frame for closing every case, prioritize, depending on severity and affected citizens.

    With due respect, I would like to get clarification - when would be the burning problems like poverty, unemployment, caste-suppression, malnutrition,corruption, etc. cease to exist? Please inform the date, then we shall fight against rape/molestation/eve-teasing/acid-attack, etc. Thank God, there is no compulsion so far, that the public should protest against the wrong things listed in some gazette or bill. It is the agony of common man that lead the protests in Delhi. I wonder why no intellectual or any political party except communists ever rise voice against price-rise, unemployment, farmers' suicide and problems of our society. If person of your status and intellectuality redicules the people, who else will give a patient hearing?

    You critisize the protests in Delhi, just think of the rural/semi-urban population, who do not even report many issues. They are afraid of being 'talked-about' in the society. Still going to policy station is an unwanted affair, because the victims would be more tortured in courts, they would have to re-live the crime to which they were subjected to. And our conviction rate speaks for the rest. They do not have either money or power to ensure justice is done. By the way, how do you think to provide justice to the victims of rape/molestation in public places or work places, or at home. Can the police or courts undo the things that happened? How can we compensate the lost morale and life of the victims and their families? Don't you think these accused are threat to the civilised society where you and I live in and not to the victims alone? Please, do think with your heart, and not all with judicial intelligence - parents are scared. The last few days, we are frustrated to see the number of cases of rape/sexual assault/kidnap being reported in news papers. People are really really frustrated and the administration/police/judicial systems - just wait and watch the sufferings of public. Of course, all the Indians are not relatives of some vip, they had to suffer. And irony is that, intellectuals would write to op-ed pages,blog and preach the victims/public to fight against the basic problems, ignoring their pains. God Bless You, Justice, and give you opportunity to speak for the helpless Indians.

  15. And, the following night, Alice had yet another dream.

    This time again she saw a large procession of women marching in protest. These were several groups moving together. Whereas some were carrying placards demanding action against sky rocketing prices, others were demanding access to healthcare. She also saw farmers’ wives protesting against their husbands committing suicide, a few well educated women demanding decent jobs, and a number of hunger stricken women who could barely keep up with the fast pace at which the procession was moving.

    The procession came face to face with a smaller group of raped women who were marching silently in support of thousands of other rape victims, and demanding prompt and severe punishment to the rapists.

    As the leader of the larger procession approached the smaller group, she counseled them to feel happy and fortunate for having been raped. “How I wish I could also have been raped while Justice K was still in office? At least the Justice would have helped me broker a deal where I would get cash settlement that would help overcome sky rocketing prices, pay for healthcare, pay-off my farmer husband’s debt, start my own business because jobs aren’t available, and even leave some to feed myself and my family” she said.

    With tears rolling down her eyes, Alice woke up wondering how sadistic one would have to be to draw comparison between two dissimilar issues, one the basic necessities of life and the other, a crime.

    Moral of the story: The wider he opens his mouth, the deeper he pushes his foot in it.

    3. Excellent one! This guy who is writing about all these issues is part of the same judicial system which provides delayed justice in cases he is citing and expedites the corporate cases. Worse when he was in power, he could have achieved something by disposing cases faster (still unclear why these justices have such long vacations when there is a backlog). A simple question to the justice. How many cases you had in total and out of those how many you disposed in your working life?

    I believe if we talk for all the problems in India, it will be soon forgotten and responsible persons will definitely forget. They just pretend to be making solution for the problem and it remains.

    Why don't we split the problems and assign to each group of people and shake the govt areas, probably at least for some ratings medias will bring the attention of the authorities.

    Rape was the heated topic, soon many many rapes were revealed. They were happening till the reporters brought to daylight.
    Where were the reporters before the Delhi incident?
    We must create a stir and then bring the attention of whole media so as to get problem to be seen!

Candle march cannot solve the problem.We react to situation after it has occurred and somewhat media plays a crucial role in this hue & cry. Why not people who are passing by reacted when the boy and girl naked in cold winter, injured asking for help.
    Firstly everybody has to change their mindset about humanity then the system will grow stronger.

  18. A well written piece indeed sir. But i guess someone will have to take up the matter of rape victim also. Just because a particular section of the society is fighting for the rights of rape victims, does not mean that other general yet important issues of hunger, poverty, unemployment and education are being neglected in toto. One can see bandhs, strikes very often in this respect in the country. The girls who are fighting for the cause of women empowerment are not ignorant of other issues sir, they are just acknowledging the fact that it is high time to raise the issue of rape victims' rights and women's safety also.

    Although I also, personally agree that media has created much furor out of all this, they are always hungry for fodder anyways. But in your own words, although in a different context, even if too much of this demand on women safety might seem like a dirty job to a few, but someone will have to do it!"

    It is important to know that one cannot compare apples with oranges. Belittling one issue in front of the other is not justifiable in ant context.

    But the intensity of the problems that is outside rape and abuse of women does not make rape a lesser evil and to be not put on the agenda for protest and change.
    Price rise, lack of proper health care , hunger and poverty , all are agonising aspects we live with. One cannot choose which is more vile than the other. It does not mean in any which way that a well fed , well cared women will ignore being abused or raped.

  21. You have great faith in science and technology. I think you should open your eyes to long term damage by "chemical" farming in Punjab & Haryana.
    I would say first control the population growth, by force if needed.
    Then realize that science is not the savior - it solves one problem and creates many others - this is how the economy rolls on, isnt it.
    I'd suggest you do some research on learning to live with Nature instead of exploiting Nature under the banner of western style modern progress and development. Do you think there can be any modicum of balance in "exploiting natural resources scientifically".
    The real progress is in the inner world, not the outer.
    Please dont look at the West as a role model. They are already marching in the direction of genetically engineering the environment so that it learns to live with our polluting ways.

  22. Justic Katju might do well to time his flights of fantasy better. Issues of life and death for women are constantly put on the back burner while more 'important' issues make the news. Rape, molestation, and the curtailing of equal freedom affect just under half the population of the country. The reason it is under half is that lakhs of women die in the womb or before their first birthday. Don't belittle this genuine outpouring of anger. And nothing is stopping the Honourable Justice from flagging these other issues. Or maybe he doesn't have the time since he must write meaningless negative blog posts, undermining the last month of protest and increased awareness.

Its sad, disappointing and rather unacceptable to see how most of the people including those with immense experience and “supreme” intellect fails to recognize the ill in the same magnitude that it exists in the society today. Each woman is confronted with this ugly face of molestation/eve-teasing/rape at some or the other point of time in her time, it might not have a physical bearing in all cases but it ALWAYS leaves a woman mentally harassed. Are we choosing to ignore this harassment that breeds a society of unequals and criminal mindsets? We have to realize that men and women are different and this difference is to be acknowledged and addressed in the right spirit. Crime doesn’t know hierarchy, no social issue is big or small, what we do need is an open mind to acknowledge that things are not right and status quo wont work any longer.

Incidentally, this is not about fragmented minorities, but half the Indian population, cutting across socio-economic class, creed, religion, regions. Belittling the issue, as one of many other issues is as bad as belittling other issues compared to rape.
    One wonders where you got your grossly misinformed assumption, that women who care about rape, do not care about any other form of oppression. Pity you are a judge, because as you have proven time and again, your comments smack of a complete lack of taste, discretion, sensitivity, or judgement.

    I do get your point here but to be brutally honest the prcoession is not only about rape alone. It is also a screaming demand to improve women's safety, to take srtict action against such deeds which are being committed on daily basis in various parts of the country, to punish people who forget what being human means. to take this further, it is also an alarm to govt to get serious about the gross disbalance in sex ratio in states like haryana, uttar pradesh and rajasthan, about feamle infenticide.

  36. Why are the masses on the street? Is it just a temporary phenomenon fueled by sudden pain, shock, anguish and feeling of helplessness? Or the constant ranting on the media created unison thinking pattern in the viewers and their subsequent response? Psychologists would be in a better position to answer these questions but to me, a commoner, it appears that somewhere an elastic snapped after incessant stretching. History is resplendent with examples that whenever the societies are cornered with problems they react. India is witnessing a similar phenomenon. Other problems, such as poverty, malnutrition, illiteracy, etc too will eventually result in protests by masses. After all governments are there to provide good governance to the citizens and that includes law and order, education, poverty alleviation, food, employment opportunities and what not. Well fed, secure and happy citizens will not come out enmass on streets and start protesting.

    you have spoken about article 14, 15 and 16 giving equality to women and not being given their due. With due respect sir, you have clearly forgotten about article 21, which gives us a measly "right to life". Strangely, everyone(including you) are concerned with equality in employment, rising prices, poverty etc but noone seems to be concerned with a basic right to life for a woman. I understand and agree that poverty et al are burning issues, for the last 65yrs every political party that campaigns for elections promises to take measures to reduce poverty and inflation provide better health facilities etc, but none of the parties talk about providing safe living conditions for women in the country. Why? because they don't believe that it is an important issue. They don't believe that this is an issue which will help them build their vote bank. It is this mentality that needs a change, however if people like you who are in a position to be heard think and talk the way your blog is written, we have no other option but to march to Jantar Mantar to be heard. Because apparently, how the nation will appear to the global media when the global media reports that thousands of people marched to the Rashtrapati Bhawan in India as a mark of protest towards deteriorating safety for women is more important than its own citizens being allowed to live safely in the country. Sir it is easy to sit in your high chair and sermonise. THANK YOUR STARS THAT YOU ARE NOT A WOMAN IN INDIA!!!

    first of all i would like to say that i am great admirer of your process of thinking and your vast knowledge of indian history. i have read more than a few of your articles and have found myself agreeing with you almost everytime, but here i cant. i can see that your intentions aren't evil but your words aren't very helepful either. i agree there are equally(if not more) serious issues in our country and we do need to address them also but just because there are other issues, you can't ignore this(delhi rape) one. you cant protest for all the issues at the same time. you have to start with one and you have to go with it all the way until you get what you want. and that's what these women are trying to do. so just because this issue has taken all the space in our newspapers, don't undermine their effort by calling it a show. they need all our support and atleast we can give them that if nothing more.
