Re: Pardon to Sanjay Dutt

      You would be aware that Sanjay Dutt has been sentenced by Hon’ble the Supreme Court to 5 years imprisonment.  By this letter I am appealing to you to grant pardon to him under Article 72 of the Constitution of India. In this connection I wish to state as follows:

The legal position:
The power of the President to pardon etc is contained in Article 72 of the Constitution which states:

“The President shall have the power to grant pardons, reprieves, respites or remissions of punishment or to suspend, remit or commute the sentence of any person convicted of any offence”

The leading case on the power of the President/Governor to grant pardon etc is the Constitutional Bench Judgment of the Supreme Court in Maru Ram vs. Union of India AIR 1980 SC 2147. It has been observed therein

“Considerations for exercise of power under Articles 72/161 may be myriad and their occasions protean, and are left to the appropriate Government, but no consideration nor occasion can be wholly irrelevant, irrational, discriminatory or mala fide. Only in these rare cases will the court examine the exercise”.

  In Kehar Singh vs. Union of India AIR 1989 SC 653, the Supreme Court observed that the judicial power and the power to pardon are totally different. The power of pardon cannot ordinarily be subjected to judicial review except on very narrow grounds mentioned in Maru Ram’s Case.

From a reading of these Constitutional Bench Judgments, the following principles   can be derived:

(a)  The power of pardon can be exercised for various reasons e.g. humanitarian considerations, and is not limited to the public good. This needs to be emphasized since it has been stated by some persons on TV Channels that the power of pardon can only be exercised for the public good. The Supreme Court observation in Maru Ram’s case that “Considerations for exercise of power under Article 72/161 may be myriad” is a complete reply to those who say that this power can only be exercised for the public good and for no other reason.

(b)  However, as observed in Maru Ram’s case, this power cannot be exercised for irrelevant, irrational, discriminatory or malafide considerations.

(c)    The court cannot sit as a court of appeal over the order of the President/Governor granting pardon. The scope of judicial review of such an order is extremely limited, and can be exercised only in rare cases when the court finds that such an order was malafide, arbitrary or discriminatory.

Maru Ram’s case and Kehar Singh’s case are Constitutional Bench judgments, i.e. judgments of 5 Judge Benches, and hence anything said to the contrary in judgments of smaller benches of the Supreme Court will not be good law.

  Keeping in mind the above legal position we may consider Sanjay Dutt’s case.

The facts of Sanjay Dutt’s Case
Before coming to Sanjay Dutt’s case certain objections by some people may be replied to.

It has been stated that the law has to be the same for everybody. This is no doubt true, but the facts may be different in different cases. We have therefore to see the facts of Sanjay Dutt’s case, and then consider whether he should be granted pardon.
            It is then alleged that Sanjay Dutt is a celebrity, and granting him pardon will send a wrong message. In my opinion Sanjay should not be granted pardon merely because he is a celebrity. At the same time he should not put to disadvantage merely because he is a celebrity. If he deserves pardon, he should not be denied it just because he is celebrity.

In paragraph 70 of the Supreme Court judgment it has been observed: “In the case of Sanjay Dutt, the Designated Court took a view on the basis of his own confession that the weapons were not acquired for any terrorist activity but they were acquired for self-defence, therefore, acquittal was recorded in respect of the charge under Section 5 of TADA. We fully agree with the same”

            The Supreme Court has held that Sanjay Dutt was not involved in the 1993 bomb blasts, and he is not a terrorist. The only charge on which Sanjay Dutt has been found guilty is the charge of having in his possession a prohibited weapon. However, regarding this charge the Supreme Court has observed that Sanjay Dutt was keeping the weapon not for terrorist activity but for self defence. This being the verdict of the Supreme Court it has be accepted.

            Of course possession of such a weapon without a licence is illegal, and therefore the Supreme Court was bound to give minimum punishment of 5 years imprisonment mentioned in Section 25 (1A) of the Arms Act. I am therefore not questioning the Supreme Court verdict.

            However, judicial proceedings are different from the pardon proceedings. As held in Kehar Singh’s case (Supra), the considerations in the two proceedings are different. For instance, in judicial proceedings, the court has no discretion to award lesser punishment than the minimum prescribed by law. But in pardon proceeding the President/Governor can grant pardon even if the person convicted has not served the minimum punishment, as in Nanavati’s case. The power to grant pardon is a Constitutional power, and no constitutional provision can be curtailed or controlled by an ordinary statute.

 Now the question is whether pardon should be granted to Sanjay Dutt or not.

 In my opinion pardon should be granted for the following reasons:
(i)                He has already undergone 18 months imprisonment.

(ii)              After his release on bail after undergoing 18 months imprisonment it took him 5 or 6 years to restore his damaged career. During this 5 or 6 years he was often ostracized by people as he had the brand of a terrorist on himself. He did not get film offers as producers thought that the film may remain incomplete if he is sent to jail midway. He could not get bank loans. He had to take permission of the court for foreign shooting every time he wanted to go abroad.. He had to undergo various other tribulations and indignities during this 20 year period.

(iii)            Sanjay Dutt has got married, and they have two small children.

(iv)            During this 20 years period when the case was going on there is no allegation that he did anything wrong, rather he did good social work.
Considering all these factors I am of the definite opinion  that Sanjay Dutt should be granted pardon

Had he not undergone imprisonment for a single day and not faced so many hardships for the last 20 years I would not have appealed for his pardon. But in my respectful opinion he has substantially undergone the punishment. He may not have remained in prison for 5 years but he has undergone sufferings which is substantially equivalent to that.

 I am reminded of the famous speech of Portia in Shakespeare’s ‘Merchant of Venice’ that justice should be tempered with mercy.  In my opinion we should take the approach of Portia rather than that of Shylock who wanted a pound of flesh.
  
 I am clarifying that I am not appealing that Sanjay Dutt should be pardoned because he is a celebrity. I am also appealing for pardon to Zaibunnasa Kazi, co –accused who is not a celebrity. I have in the past appealed for pardon for many person who were not celebrities e.g.  Gopal Dal, Sarabjeet Singh, Khalil Chisthy, etc.

I therefore appeal to you to pardon Sanjay Dutt under Article 72 of the Constitution. I mention that Article 72 does not state who should send the appeal. Hence even if Sanjay Dutt has not sent an appeal I am entitled to send such an appeal.
            I conclude by quoting a shlocka of Brahaspati:
“Kevalam shaastram aashritya na kartavyo hi nirnayah
Yuktiheeney vichaare tu, dharmahaani prajaayate”
which means
“The decision should not be given merely by following the letter of the law
For if the decision is inappropriate injustice will follow”

Being a commoner I strongly condemn Justice Katju's appeal for pardon to Mr. Sanjay Dutt.I would like to state that Justice Katju is appealing for pardon for a person who was in contact with those responsible for the 93 blasts and moreover aquired illegal and unlicensed weapons from them. I think that Justice katju is forgetting the fact that Sanjay Dutt's father being an MP from the ruling party must have been capable enough to protect his family by getting police protection. Had Sanjay been a law abiding citizen at that point of time then instead of aquiring an automatic rifle from a traitor he would have preferred to inform the police about this.Moreover,Justice Katju should not forget that he has just been convicted for arms act and not under TADA which is again a boon for Sanjay Dutt.Instead of fighting for people like Sanjay Dutt, it would be better if Justice Katju fights for those who really need his support.

      While arguing for Sanju baba Mr Katju, lists down "facts"
      3rd para says "It is alleged that Sanjay is a celebrity ...."
      Is it a fact or an allegation against Sanju baba ?

      Mr Katju goes on to explain, how Sanju baba went through difficult time to get back to movies, as producers were "scared" to sign up with him.
      Our producers have so much faith in our juduiciary system that they signed up with Sanju baba, because the case would take more than 20 years, and then ex-judiciary people would appeal for pardon.
      Sanju baba's difficult time is over now.
      he has become a role model and and what seems like an expensive wrist watch company has signed with him as a brand ambassador, and their baseline is "Be a part of legacy"
      Wonder if the owner of the company is Haneef Kadawala or Abu Salem.

      Mr Katju can you please let us know what social work did he do in the last few years ?
      He has not done anything wrong in last 20 years ?

      Mr Katju, since you must be busy writing so many letters everyday to all and sundry, you may have missed this incident, where Sanju baba was accused of having discussions with Chota Shakeel.

      I would urge Katju to write similar appeals for Sallu bhai, Saifu and Fardeen khan who face criminal cases.

      Katju saab I will also write to PM, President, I & B Minister, Law minister to check on duties and responsibilities of Chairman of Press council.
      What is the job description of Chairman of Press council ?
      Does he / she have enough work for the day so that they dont start shooting out so many mails every day ?

      Are you doing this in your official capaicty of Chairman of Press council ? Are you using office stationary (Paper, Secretary typing out such useless correspondence, postal mailing charges etc)

      I am also writing to Law minister to revoke your decisions as a judge, KYUN KE AAP KE DIMAG MEIN LOCHA HUYELA HAI.
      Dont know if this a recent development or this is a manufacturing fault ? and it was just overlooked due to the proximity to Nehru family ?

      Is Mr Katju doing this in his personal capacity or as a chairman of Press council ?

      2.If he is doing this in his personal capacity is he (mis)using the facilities of Press Council of India for his personal work ?
      I cant imagine he would type such long letters by himself.
      Is he using office stationery ?
      His mails that get sent to President, Prime Minisiter, Governers etc who pays for the mailing charges ?
      Is this not a misuse of a taxpayers money ?

    3. Just happened to watch NDTV interview of one alleged retired judge mr katju and subramaniam swamy.
      Circuit (Katju has now become new circuit becoming a CHAMCHA of Sanjay dutt) kept referring to para 70 of judgement by Supreme court that it said Sanjay Dutt was not a terrorist and he carried the weapons only for self protection.
      Circuit bhai, if you want to follow what Supreme court has said, why dont you follow it in totality ?
      Why are you being selective in following the judgement ?

  3. ये बात अब अच्छी तरह समझ में आती है की क्यूँ सांप्रदायिक, भ्रष्ट और सामंती शक्तियां और उनके अज्ञानी समर्थक जस्टिस काटजू का भरपूर और बात-बेबात पर विरोध करते हैं। ऐसा हमेशा हुआ है, इतिहास गवाह है। कम से कम उन आम देशवासियों को समझना चाहिए की कौन उनके पक्छ में है और कौन उनका इस्तेमाल कर रहा है, क्यूंकि बहुत अफ़सोस होता है जब आम जनता में से कुछ लोग सोशल मीडिया पर जस्टिस काटजू जैसे लोगों के बारे में भद्दी बातें लिखते हैं। देश को जस्टिस काटजू जैसे लोगों की बहुत ज़रुरत है पर ऐसे लोग "विलुप्त होती प्रजाति" के सामान बहुत कम रह गए हैं।

    In your previous blog you convicted Narendra Modi-ji for 2002 riots even though there is no proof, no court has held him criminal.

    SIT monitored by SC has given him a clean-chit, due to a decade of witch-hunt against Modi-ji people have a wrong image of Modi-ji. Unfortunately you also accused him, that is not fair on your part.

    Going by your own ideology, please post a news article or a blog to pardon Modi-ji and ask other people also to pardon him.

    Why I think Modi-ji should be pardoned by secular media and ex-congress people like yourself -
    1. He is not held guilty by any law in India
    2. He has suffered a lot in these 10 years, he couldn't go to US/Europe
    3. His carrier went down and he had to work hard to revive it
    4. He spread message of shri Vivekananda and shri Vallabh Bhai Patel
    5. There are lot of eminent lawyers, cricketers, film stars, business men who support him
    6. His way of repenting is a bit different, you can observe that there is not a single incident of communal violence after 2002, even though Gujarat always was a communally sensitive state.

    I don't agree that he has suffered more or less as compared to the other convicts.

    He has been released on bail since 20 years, he got married twice and has three children, has made more than 100 films since 1993 earned riches enjoyed his life and after being found guilty of an act of carrying illegal weapons which even police didn't have.

    I think its unfair on the part of the victims who have suffered the most.

    Going beyond what the court has pronounced morally logically and applying basic intellect there is no one in this country who can say that Sanjay Dutt was unknowingly in contact with people who were planning for the deadliest act of terror after independence on our country.

    Any nationalist or a like minded person having even an iota of doubt would have either refused to help the perpetrator or could have informed the police having kept the identity anonymous.

    Knowing from a person of your intellect i have no doubts on the merits of pardon but at the same time we need to be equally answerable to our conscience and moral judgement.

  7. Dear Mr. Katju - your point (iv) under "The facts of the case" is wrong. Sanjay has been in touch with underworld and the transcript / audio is out in the public domain. For this single point, the mumbai police needs to register a FIR against him (dont know why they are not doing that). If you have any conscience, you should withdraw this pardon request and if president is fair, he should reject this request.

    If nothing of that sort happens, then Swamy will take care!

    some magazines in a bed sheet as per the request of Sanjay Dutt
    (A-117), and Salim also gave Sanjay Dutt 20-25 hand grenades
    which were put in a black coloured bag along with other
    ammunition.
    10. Confessional statement of Manzoor Ahmed Sayyed Ahmed (A-89):
    He confessed that he had a blue coloured Maruti 800 bearing
    No. M.P.23 B-9264. On 22nd/23rd January, 1993, in the evening,
    Salim contacted him over the telephone and called him to his office

    at Santacruz. After reaching there he took him (A-89), to the office
    of the appellant (A-41) at Monaz Builders and Builders, S.V. Road,
    Andheri, Opposite the Post Office. He introduced (A-89) to the
    appellant (A-41), and gave the key of his car to the appellant (A-41)
    and after about half an hour the appellant (A-41) came back and
    parked the said car outside the office, and gave the key to Salim and
    told him that he had kept the bag of weapons in the car. When Salim
    and (A-89) entered the car, he (A-41) saw that a black bag
    containing weapons, was kept on the rear seat of the car."unquote

I will publish a letter on this blog and send it to President and Governor of Kerala (since there is a dispute about jurisdiction) after studying your case in detail in two days and that will help you fight against misuse of 498A. But, mind it, I only do it in deserving cases. Put the Hat Back on, I can't write in this glare.

  12. Respected Justice Katju Ji, I strongly endorse and support your appeal to His Excellency President of India.

    1. When a person like Guru can appeal and even against death penalty and can live for a decade than a citizen like Sri Sanjay Dutt or Zaibunnasa Kazi, have all the case to request for pardon.
    2. Persons like Baba Saheb Bhimrao Ambedkar & Constitution writers kept the required provision to help judiciary where it's hands are tight roped and in spite of all sympathy, they are bound to announce the minimum sentence and that is Article 72 of our constitution.

    3. A person like you, who always fought for poorest poor and I quote your one Judgment in case no 1182/2011 which brought whole country in scanner and attacked Land Mafia, if putting the facts, certainly, constitutional authorities shall examine it on the facts and shall not simply keep it pending or denying the Pardon.

    President dispensed with use of "His Excellency" last year. Being PCI Chairman, do you read newspapers.

    I read in Indian Express that despite Sanjay Dutt saying that he does not want pardon, you have said that you will still go for it and his wish is immaterial. Then, who is the really for? For your popularity?

    Justice should be tempered with mercy. But Justice should not be 'tampered with' in name of mercy.

    Aap kuch batein hi bar bar bolkar bore karte ho. Jaise pehle log sanjay dutt ki movie ke bare mei publish karte toh problem thi ki "vidarbha ke farmer" ke bare mei itna roya ki bechara tumhara rona sunkar mar gaya. Phir beech mei sab jagah "feudalism" ki bat aa gayi. Ab shakespeare aur shylock ka rona laga rakha hai.

    Manav ho kuch toh sharm karo
    Jao Virochit Karm karo

    Help the poor with the money saved by you. Establish some old age homes for the poor. Teach children and even if you teach 1000 of them you have served your country. All this non sense about sanjay dutt, fedualism, 'media ka raja banao mujhe' would do no service to humanity.

    Please show some sense at least at this age.

    The convict does not want pardon.

    The convict's family has not applied for it (they may apply and it is their right)

    The convict's lawyer and those who are close to him have not applied for it.

    The people don't want it as the law should be same for everyone.

    The only person who is hankering for it is YOU, a person who claims he does not know Sanjay Dutt, has not watched his movies (but knows 'Gandhigiri of Munnabhai' :) Pakade gaye naa Justice Smarty Pants)and is not his fan (seems you are his only fan).

    What does this show about YOU? Conviction, no. Attention Deficiency Syndrome, yes.

  18. What happened to your farmer's issue? For an individual criminal you have devoted too much space in your blog and print and electronic media. Dutt was in possession of many weapons and should have been punished for every single weapon separately! What is your take on this?

You need proof - silly, haven't you seen Mother India where Sunil Dutt was a farmer. So SD is in fact a farmer. My farmer's issue is still alive and the whole blog now is dedicated to it.

Mr Katju,till recently I have been an admirer of yours and I have always defended your views and still do on all matters that you have advocated before like press regulation, caste control etc. but after this Sanjay Dutt facade, I have come to know about your desire to selectively pick up cases to remain in lime light. Any ways, the grounds you have mentioned for grant of pardon to Sanjay Dutt are by all means cannot be the product of a sane mind. For eg, he has suffered a lot. Now what do you know of suffering? The main suffering that separates a man behind bars and a man released on bail is the inability to move around freely, earn a livelihood and making love with the beloved women at one's will (of course with other partner's consent and wish). Now, in between his release from jail 20 years ago and the recent decision, he has been moving freely in the country, has been abroad (even after the suffering a lot because of asking for visas in your eyes), done 100 films, earned crores of rupees, attended a lot of parties, drank a lot of liquor, wore a lot a fancy costumes and dresses (not jail uniform) and most importantly married twice thus enjoying sexual intercourse with his wives (other than God knows how many girlfriends) and reproduced children. I know it is a lot of suffering in your opinion.
    Now, coming to the 'revival of the spirit of Gandhi'. Now, you have contradicted your own point. Is the so called 'spirit of Gandhi' so weak and bleak in nature and content so as to require a commercial movie for its revival? If yes, then why does such spirit of Gandhi need to be revived if it is fundamentally so weak? If no, then how could Sanjay Dutt be any helpful in its revival? Even if for one second I agree with you that his move Lage Raho Munnabhai helped in the spread of message of truth and non-violence, then why aren't you taking cognizance of movies like 'Khalnayak','Vaastav','Hathyar','Musafir','Agneepath' etc. where he played the character of a murderer, a don, a mafia, a crimial or in plain words, a typical movie villain ? Has it helped the public interest in any way ? I do not know whether the so called 'spirit of Gandhi' has ever been spread or not, but newspaper reports do confirm that the method of cheating in the examination hall used by Sanjay Dutt's character in 'Munnabhai MBBS' has been replicated by many students throughout the country and many people have been caught doing that. Having said all that, I want to confirm that I am not writing this because I dislike Sanjay Dutt or like you said, want 'a pound of flesh'. As a citizen of India, I will be neither happy nor sad if he is granted pardon however, as a Sanjay Dutt fan, I will be happy to be seeing many other movies of him. What actually concerns me is the fact that what compelled you to suddenly advocate a wrong cause out of the blue which neither concerns any 'aam aadmi' nor serves any public good.

Respected sir, if you ask for pardon for this great actor who committed the crime at the age of 33 who had 2AK47, 400 Rounds of amunitions and other bombs etc; you claim he suffered a lot and seek pardon for him, who spend only 18 months in jail. Similarly please seek pardon for 3 Rajiv Gandhi killers accused please because if a 33 year old adult had so much of ammunition can be pardoned a person who supplied two batteries is given death penalty. Is it fair sir, he spent all his adult age in jail and still you have not spoken for these people.

  26. Ratio decidendi of Sanjay Dutt's case: Even if one is caught with hundreds of AK 56's one will be charged only for one single offence under the Arms Act. So terrorists and law breakers rejoice! And then Katju will always be there to help you getting pardon.

  30. Undoubtedly, I am a big fan of Sanjay Dutt, but justice cant be denied like this. We know he has gone through alot of emotional distress in last 20 years but 5 years of incarceration is worth it. Had Sanjay been proved terrorist, he would have surely gone for life term. So, in my opinion 5 years is worth it. Positively, he will not face any problem afterwards.

    I have immense Respect for you a Retired Supreme Court Judge and now the chairman of Press Council of India. I have heard through many that one of your greatest contribution to Indian Judicial System is the "Mimansa Principle of Law" which you brought back as a tool to interpretation of law which normally courts, lawyers do not use. Sir given your background as SC Judge, PCI Chief ; some one who is deeply connected to Indian Culture, i respect you. But off late my your judgement are getting off target; are rather surprising. You recently wrote 2 articles One on Mr Narendra Modi as Gujarat CM ; 2ndly Pardon Pleas for Sanjay Dutt ; Zebunissa Kazi in 1993 Bombay Blast Case. Though i have reservations about your opinion but since your a free individual and is entitled to it. I have read your above articles and hence would point out some starling contradictions; facts for your humble consideration.

    1) As Soon as the Sanjay Dutt judgement came you within 48 Hours fired a Letter to Governor seeking pardon for him under Art 161 of Constitution while later realising after few days that your letter to Governor was inherently wrong per se

    2) You were pointed by an esteemed lawyer on TV that it was under Article 72 of Constitution a pardon for Dutt could lie before President Of India as under 7th Schedule of Constitution, Union List, Entry 5 "Arms, Ammunitions &; Explosives" are Union Subject; and Arms Act, 1959 being central subject the Pardon could be dealt by President under Art 72 & 73 of Constitution

    3) What was so hurry grave to fire a pardon to Governor without realising the exact provisions and stating ground like Good Parents, Gandhigiri etc and again firing a letter to president for pardon for Dutt

    4) Grounds of Gandhigir Good Parents included in pardon petition before governor were later missing in 2nd Pardon sought before President as these arguments were very shallow and did not fit the bill for pardon of Mr Dutt

  34. 5) You say Mr Dutt suffered a lot in last 20 years, emotionally, mentally, ostracized by producers, has served 16 months in prison and hence should be pardoned. But how come has he suffered, he has done movies, attended parties, travelled abroad, lived in luxury, fame, name, even did campaigning in politics for SP. He got married and has kids. Is this suffering? and if it is then Poor man on Pavement will be thinking he is a Billionaire right.

    6) You said its stated in Judgement arms were acquired for Self defence purposes. But he already had 3 licensed arms, must have had fathers MP's security provided by GOI; Mumbai Police. Why did he acquire 20 Hand Grenades, 3 Ak 56, 250 Rounds of Bullets. Tomorrow if mistakenly someone is given arm for self defence by a terrorist, will he be pardoned. You say he was foolish to accept it at the age of 33

    7) You Quote Shylock & other shlokas, plead mercy now what do you want a "pound of flesh", have some mercy. Justice Katju without going into merits of the case he was given concession as no TADA was pressed by CBI, then SC given his conduct gave bare Minimum of 5 years as stated in judgement and as any Citizen of India, serving a Sentence for Conviction of Crime is not Pound of Flesh

    8) You say he has reformed as a Human Being. As per the tapes leaked by ANI; Outlook even after 7 years of being facing trial going to Jail once, Mr Dutt was still on contact with Criminals, there are conversations available which reveals he was never apologetic. Till date he has not regretted to people about his links with main conspirators of Bombay Blast 1993

    9) You state sanjay dutt should not be punished coz he is a celebrity. It was because he was a celebrity, that his late father approached many influential politicians to get him out on bail, while many other prisoners languished in jailed and even today there are numerous undertrials in jail whose's trial has not begun. It is because of his political links that many pol parties are backing his pardon

    10) Sir its worth Highlighting in Maru Ram vs Union of India- (Which u rely on) it is stated “Pardon, using this expression in the amplest connotation, ordains fair exercise, as we have indicated above. Political vendetta or party favouratism cannot but be interlopers in this area. The order which is the product of extraneous or mala fide factors will vitiate the exercise. . While constitutional power is beyond challenge, its actual exercise may still be vulnerable. Likewise, capricious criteria will void the exercise

    11) The above point clear states he belongs to highly politically influential family adding your campaign to it has lead to heated debate in india which has nothing but harmed his reputation more, now people have seen ; read about his links, tapes ; acts which otherwise was hidden or burried under the dust of time. This is the reason he came on TV ; said please stop debating i dont want pardon. Then sir its time you should on paid news, media ethics which are far more dangerous to democracy than the case of sanjay Dutt

  35. This was about Dutt case and lets see what the relevant authorities decide i will not prejudge it. But assuming that ur arguments for pardon, reformation are taken on face value i would like to point out double standards when it comes to modi. I know both the cases not similar but still for hypothetically lets look at your stand

    1) Sanjay Dutt is pronounced Convicted of a Criminal Offence but You Seek Pardon ; Modi who is has been given clean chit by SIT constituted by SC is Guilty for you. Double standards ?

    2) Modi has no FIR or Charge against him in any court of law for dereliction of his duty in the state of Gujarat

    3) SIT says Modi asked for help from 3 Cong States but refused, called army within 24 Hrs, made proper efforts to to curb the riots. rather it points many there players like Cong, teesta, bhatt ; NGO's created, fabricated evidence before Court to frame modi. It has been exposed in SIT report

    4) You Highlight 2002 as one sided massacre that muslims were targeted, but as stated by Mos Home  UPA govt says 790 muslims, 254 Hindus dies while 233 Missing in RS. You don't pick the cases of Hashimpura where 57 Muslims Killed, 1984 Riots where 3.5 K Sikhs killed in Delhi with No Justice, Nellie Massacre to name a few. Why selective targeting of one CM.

    5) Modi did reformative acts to bring harmonisation to otherwise a communal state since decades, he has made sure no riots takes place in 10 years of his rule even after Bomb Blast in Ahmedabad in 2007;He has done sadbhavna mission to bring peace to Gujarat.

    6) He has also been ostracized vilified by his opponents, media NGO's who ran a malicious campaign not only in India but also abroad like Wharton to stop him. Even he has suffered a lot. But you dont see that.

    7) He spreads the message of Swami Vivekananda, Vallabhai Patel, says My secularism is India First;All caste, creed, religion immaterial we are Indians first. Is that wrong sir ?

    8) Modi has given the Development to state, 10% Agricultural growth, 24 * 7 Power, Drip Irrigation, Solar Power, Female Literacy has Increased, School Dropout Down, etc, Highways. He has developed Gujarat when India has slowed down. If this is not inclusive development what is.

    9) In recent Assembly Polls he Modi's BJP polled 33% of Muslim Votes, in latest Municipal Polls in Sallya Area of (Jamnagar) a 90% Muslim Dominated area, he gave tickets to muslims and all 24 Ppl (muslims) out of 27 seats won on his tickets because he built roads, electricity ; sanitation to a an area known for smuggling activities in past.

    10) Even in the Sachhar Committie Report, it is stated that Muslims are most better of than any other state in India whether UP, Bihar, or Bengal. Even Madani of Deoband on Headlines Today accepted the said fact that Muslims in Gujarat are now happy & want development.

    11) You Criticised him on Malnutrition, that ppl are languishing as per CAG report on Malnutrition, Gujarat is the Best in Performance with Mal Nutrition down from 70% 2005 to 35 % in 2011.

    12) You said he is hitler, ppl should not vote him etc. But hasn't he been elected thrice by People of Gujarat with thumping Majority, dont you think that a former SC Judge u should respect the verdict of the people in democracy, as preamble says "Its by the People, For The people ; Of the People". He is not authoritarian but rather profession, asking for performance by bureaucrats and no red tapism. But unfortunately majority wont understand as we are used to colonial era of babugiri. The ppl of Gujarat ; the world respects him for it.

    Sir, after comparing the Dutt Case ; Modi facts, i would like to call on you that Modi bashing has become a cottage industry and i hope a learned ; intellectual person like who has occupied a post in the Highest Court of India should not Hold a democratically elected CM Guilty; Convicted Celebrity to be pardoned. Let the law prevail equal for Both

    Dear Mr. katju 20 years and still Mumbai Blast Case is not closed, I feel ashamed of still saying I respect law, or Supreme court, Dear sir Supreme court is of course supreme but not the so called supreme authority who is appointed by corrupt politicians.
    Sir I need an answer and yes you owe it as being the sole fighter for Sanjay Dutt. He is an Actor not a real Gandhi. Mr. katju for 20 years and many more years to come relatives of Mumbai blast victims will keep crying what was their fault.   63. Justice Katju, you have given four reasons based on which you're pleading pardon for Sanjay Dutt. But these four reasons - prolonged trial period, have family with small kids, career setback etc are common to most people facing cases in court. They can also apply to many people who are serving their sentence in Jail. If we start issuing pardon, based on these four reasons then we won't be able to punish many criminals and justice cannot be served in our country.
