I Protest
By
Justice Markandey Katju
I had decided not to write articles
any more for quite some time because having write too many already, I do not want to be
accused of seeking cheap publicity.
But the 30th April issue of
the ‘India Today’ has changed my mind. The cover of this issue shows the
cleavage of a female breast, and the words mentioned there are ‘The Booby Trap
– Women want them perfect. Men want less flab. Breast surgery is the new rage’.
Inside the issue is an article which begins ‘Woo hoo! Its Happy Cleavage Day.
How should I celebrate?’ Then follow all the details about breast surgery to
increase the female breasts to make them more attractive for men. This is said
to have become a rage in India. The editorial mentions the cost – Rs. 1.5 to
2.5 lacs, and says it is not longer unaffordable.
My reaction to all this is -- what has most of the media become? Have
you lost all sense of shame? In a poor country like India where most women are
bravely feeding and supporting their families on the pittance which their
husbands, or they themselves, earn, is it not a gross insult to them to talk of
breast enlargement by surgery?
It is estimated that 47% of Indian
children are malnourished. The Prime Minister himself admitted the figure to be
42%, and said it is a matter of great shame. This means that about half our
children do not get enough to eat. And since most mothers would rather remain
hungry than see their children hungry, this means maybe 75% of our women are
malnourished. Do our Indian women not deserve sheer admiration for their
selfless sacrifice and bravery in supporting their families? And is it not
sheer vulgarity and a disgrace to highlight breast enlargement, as if that is a
great issue in India today?
The editorial of the issue says that
Rs. 1.5 to 2.5 lacs is an affordable cost. Has the writer any idea of the
skyrocketing prices of foodstuffs, medicines, etc? Would a woman devote her
budget to supplying food etc to her children, or for breast enlargement? Most
women in India are today eking out a hand to mouth existence. To talk of breast
enlargement by surgery is like Marie Antoinette saying that if the people do
not have bread, let them eat cake.
The lives of most women in India are
full of continual, unending labour, a kind of labour that bears the imprint of
bondage. They have to do cooking, washing clothes, cleaning the home and other
household chores, apart from bearing and rearing children. Petty household work
crushes, strangles, stultifies and degrades them, and they often waste their
labour on unproductive, petty, nerve racking and stultifying work of crushing
drudgery.
I.Q tests in modern psychology have
shown that the I.Q of an average woman is the same as that of an average man.
Our Constitution provides for equality between men and women, vide Article 15.
But the fact is that the old backward mentality of looking down on women and
treating them as objects of mens’ lust persists. And it is this backward
mentality which, no doubt only by insinuation, the issue referred to
perpetuates and furthers.
What truly great sacrifices most
Indian women are making (and by the way they are too poor to have breast
enlargement surgery)! What self effacing heroism! They do not demand to be known,
they remain anonymous. In these terrible days where 80% of our 120 crore people
are poor, when prices are skyrocketing, when unemployment has assumed massive
proportions, when health care has become too costly for the masses – in these
desperate circumstances our brave women are uncomplainingly toiling from day to
night to support their families.
Instead of highlighting frivolous
issues like breast enlargement our media should help our people in their
struggle for a better life. But, as I have been repeatedly emphasizing, a large
section of our media deliberately diverts attention of the people from the real
issues facing the Indian masses which are socio-economic to non-issues like
lives of filmstars, cricket, astrology -
and now, breast enlargement.
I am sorry to say that a large section
of our media has totally lost its
priorities and sense of proportion.
great article !!Kudos to katju sir for criticizing such insulting stories... Very valid arguments by Justice Katju
ReplyDeleteAbsolutely Right.
DeleteWhy not talk about breast cancer on the cleavage day! something all women should be aware of!
DeleteWell, at least someone has courage to speak against 'Who Cares Attitude' of Media Giants. I wish more people should cultivate such courage.
ReplyDeleteMr. Katju is absolutely right.in a poor lame duck country like India while fakely boasting of largest democracy in the world, lose sight of the abject poverty with which the largest portion of its population is stricken with and the prevalent capitalism is adding fuel to it. largest female population is mal-nourished due to unavailaibility of even one time meal to them. the condition of children is going worse and under such situation if rich india talks of enlargement for breasts is a sheer shameful on their part which certainly revealing the callousness and individual profit making by the ruthless capitalists which requires now the strongest iron hand to deal with such rudes. i am highly gretaful to this Nation that people like Mr. Katju are still existing in this fake democratic Nation and enlightening and pulling the nerves of these power brokers who feels above law.

Good reply, thanks
DeleteYour Lordships, I beg to differ. India Today is a magazine which only the rich and English-speaking can read. And breast surgery is an issue which is their concern. Why are you bringing poor women in between? And your statement on equality of men and women in the Constitution! Don't you know that Muslim Women do not have equal rights as Muslim Men? Have you ever thought of/ written about this inequality? Any Judgements from your Bench in favour of abolishing this inequality?
ReplyDeleteall rots can not be corrected by a single individual and so every one else also needs to be participated. when we talk of equality we talk of all women and people irrespective of their richness or poorness. Breast surgery is not an issue but is a brainchild of the capitalists who are eating this Nation like a termite. the issue before the Nation is Female Foeticide, child labour, prostitution, beggary by Indian children, child abuse and not this enlargement of breasts. what women will do with large breasts, have you ever focused. capitalists will ruin this Nation.

DeleteSir, I disagree. I am a 24 year old girl working in an mnc. I have a salary of 40k and I live independantly. I have seen pulitzer prize winning photos of malnourished children in the face of India today since i was 7. All the govt has done about it is a 3000 cr nrhm scam. I think it is wrong to blame the media. 1stly there is nothing called Indian woman. My life conditions are totally different from the household help. The condition of a village woman in kerela is totally different from bihar. Which are you talking about. The group of independent women may be small but its still large enough to have an article in India today relevant to them. I agree with you on the fact that it should not be cover page in grave times like now But if one article out of many is dedicated to breast augmentation (which is of concern of me and my peers), what is the big deal? If there had been an article comparing the smart phones or prices of penthouse in Delhi (also nothing to do with poverty and female feticide), you won't have a problem. Saying statements like 'Indian women look best in Sarees only so they should wear that' and 'women are best suited for traditional roles' is the new form of indirect oppression since direct oppression is now frowned upon. "what women will do with large breasts" is none of your concern. Augmentation is for women who have smaller breasts and feel that they are in some way inferior to other women who are of normal size.

Hello Miss Anonymus,
DeletePlease get into the depth of the article what actually the author is trying to describe, rather than writing all nonsense stuff,i am wrking in Mnc and taking handsome salary. We are talking of all women in general ,please try to have broader outlook and out of box thinking. All women do not work in mnc's and they have tough challenges and are doing endless struggles,to satisfy their family needst in best possible way, their prorties are much higher than breastenlargement,People dont have food to eat, serve their family feed their children,so how can they think of such things.
mohandas: I beg to differ
DeleteINDIA today:
1) is not a magazine which is only read by rich people. i can read and understand english but still am not rich.
2) is not a magazine which comes with a proviso "FOR RICH AND MODERN INDIA" .it's a magazine which should deal with matters which are more important to our country as pointed out by J. Katju.
On one hand I agree that Anonymous girl is a valid target segment, niche maybe but large enough for their concerns, petty though the may seem in the larger scheme of things, perfectly valid for them. And for me - I am also in early thirties work in an international organisation and earn well enough.
DeleteBut Anonymous Girl, you also have to consider how India Today is a magazine supposedly with a larger mandate - it is not cosmo - it is meant to answer questions and provoke a larger segment towards issues of national importance. Or ideally it should. Its advertisers may need something else but if the media does not try to bridge the gap and help you empathise with larger issues you may end up voting for a government that gives you tax cuts and cheaper petrol than one that ensures that the rural woman in bihar or kerela gets education and health privileges.
A large role for the media in this country has to be to make sure we remain in touch with the larger picture because it is very easy for an urban well off woman like you, and actually like me to lose that perspective.
Anonymous girl ... U earn 40 k a month...I am sure u work hard enough for that .. but the fact remains that the 40 k is some peoples life time savings... U should see and understand the difference.. What Mr Katju has merel pointed out is that a media should be poised in such a way Livelihood issues should be priorities over lifestke issue... Sex ratio issue should be priorities over sex surveys thats,, all...
Delete--India Today is a magazine which only the rich and English-speaking can read.
DeleteThe duty of the mass media is much greater. They owe a duty to the people and it is their responsibility to state the relevant news to them and not indulge in cheap marketing gimmicks. Such is the condition of today's people than half of them don't even know the name of the President of India; forget about them being concerned about poverty, casteism, naxalism, crime. Most of the media is not even concerned about these issues, for them stories about celebrities makeups and breakups, cricketers, evil spirits on roads and other C grade stories generate enough money to pay their bills and as you all know 'social activism does not pays'
--Regarding he issue
It is not wrong to have an article on breast surgeries but i have reservations against it being on the front page.
--The plus point
Such an issue may actually make some of the urban 'dudes' buy the magazine and they might end up reading some 'relevant' news also.
Anonymous Girl 2
DeleteTo Miss Anonymous Girl! it is so sad that you cannot think beyond your petty concerns. Wish a job in an MNC could come with an ounce of common sense as well then we would not have pity our sad luck to wonder that life of "an individual with a job at an MNC" imply endless fixation with one's boob size or dick size whatever be the gender! Seriously dude! Do some justice to your cerebrum, cerebellum and medulla oblongotta because billions of cells and neural connections are writhing in deep psychological pain at being so ill-used.
Breast Augumentation re-inforces the grim and century old tradition of objectification of women.Your opinion in favour of such a suggestive cover page is testimony to the sad reality that you internalized the patriachal norms down to the last alphabet.
Please also run a fact search and compare the percentage of women vis-a-vis Indian population who earn 40k and above, work in an MNC and are neurotically concerned with the size of their breast. There are bigger and more relevant issue lying to be addressed and that is what Mr. Katju is trying to draw the attention. It is your right to disagree but kindly understand and take responsibility for the premises of your disagreement like a rational individual because you are not ranting in your MNC office when you choose to write a reply on a blog.

ReplyDeleteWhile it is clear that there is a high poverty in India, the reasons for malnutrition in children go beyond poverty. For example, the nutrition rate of Sub-Saharan countries having higher poverty have a better malnutrition rate. This was adequately pointed out by the reports: e.g., http://www.cini.org.uk/childmalutrition.pdf .
ReplyDeleteMr. Amit you also have said that India is high poverty nation then how can we tolerate rich India talking of enlargement of breasts for 2 or 3 lakh rupees at the cost of these poverty stricken Indians.India today should feel ashamed of it while showing cleavages of female breast on cover. such magazines must be banned or taken to task by strict application of law of the land.
DeleteI agree with the protest.
ReplyDeleteHonourable Sir,
ReplyDeleteI stand by you in protesting against issues insulting women and especially the " booby trap " occupying the cover page of a well-received magazine.Hopefully many women rights organizations will follow suit. Commodification of women should be curbed at the earliest time.

I reqest you, Sir, to continue contributing your thought-provoking articles ignoring the possible comment of " cheap publicity ".Who will buy this? Please continue your articles ,even as your colleague justice V.R.Krishna Ayyar is doing,to help us understand men and matters in due

Hi,

Mr. Katju i very well agree with you. The magazine's name is 'India Today'. So, it must present to the public the true picture of India. Topics like these sometimes reach such a folly that they even show a survey conducted by them in metro cities of India.
ReplyDeleteIndia Today has that reach & language that it can very well connect to the the middle class(who play a major role in bringing about change in society) of the country. So it must use these for awareness make the public ponder upon the likes of issues as you have mentioned. Furthermore PRESS is regarded as the 4th pillar of democracy. Democracy, as run by its organs, is not about breast augmentation or 'trends related to sex', particularly for a country like India which 'Today' faces evils like poverty & violence against women.
Also there has been an increasing of what you termed as 'treating them as objects of mens’ lust'. Thanks to these magazines and our advertisement industry this thing has received a major boost. I, personally regard this as a major reason for increasing rate of sexual assaults targeted against women. All these provocative stuff surrounding us everytime has affected the psychology of this male dominant society.
Great Sir, once again you did.
ReplyDeleteWith due respect to the women folk, especially our Indian Women, honestly they are the most sufferer in humankind. Today they are not safe even at her own house, not safe in the Workplace,Society,Bus stand,Railway Station, can not move alone, can't travel alone. All sorrows starts from the very moment of her birth. A woman has to be very very careful at every moment, has to be very alert every time, both personally and in the Society. A woman has to suffer a lot both personally and for family wise. Majority of the Indian women are running the family as the so called family head, Husband, is busy in drinking habits; does not want to share/shoulder the responsibility of a Family. A woman has to suffer as a Girl Child, as a Wife, as a Mother, as a Mother-in-law; She has to nurse the husband and her children; She has to forget her own pains, and sorrows & get suppressed it due to these hectic day to day work. A woman get all sorts of happiness only from her own Husband, whom she can trust, believe, at the cost of submitting to him, but unfortunately that too is very much rare now and getting disappeared from the world of Humankind. All owing to Satanic world/Worldly life.

ReplyDeleteSir,
ReplyDeleteI think the real issue behind the cover story on India Today is something else.
The commercialization of media has overpowered the good journalism. I am of the opinion that there are good and honest journalists who do try and want to highlight the 'real' issues of India. However, the editorial process today is such that the commercial sales of the magazine/newspaper is given a priority and whatever story can help achieve this is given the publishing priority.
We, the readers, can only ponder on the wisdom of the editors of pan India magazines and news forums, many with great reputation, as to why they allow sensationalization of a topic that is not connected with mass and in some way is derogatory to a particular gender. Probably, the Indian media is going through a change from ideal reporting & publishing to profitable reporting & publishing practices.
Do we, the readers, have an option to opt for something else? What I mean to say is that do we have an option of switching from India Today to any other equivalent magazine that will give us an understand of something of relevance to India? I guess no. In this scenario, the only option we have is to find those real journalistic work that might be hidden in a manner of half page articles somewhere in the middle of the magazine.
i can not agree more. well said!
DeleteRespected sir,
ReplyDeleteI agree with you. Some one said,'India today' is meant for rich and English speaking population only but,Isn't that Rich people are rich because some one is poor out there. They are rich because some one else is suffering because of them,Capitalism. It is their responsibility to look for social issues and do something for it.Media is such a powerful instrument. It should be used properly.

I read a news yesterday. A 12 year girl was raped. Now was it because the child was wearing revealing clothes? Or she had her breast augmented? Another news, a school girl was pulled into a van and gang raped? Did she wear revealing clothes? No she was in her uniform (its same for everyone). Take out last months news papers and see if there is even a single rape incident when the female was wearing revealing clothes. The only common thing you'll find is that they were all alone when they were assaulted.

I agree. You have captured some of the points I had in mind, but there is still more that can be said. Overall it can be said that women in India have always been suspended into particular role models. This is a patronizing attitude towards those who should have been born free.
Delete"Augmentation is for women who have smaller breasts and feel that they are in some way inferior to other women" I understand how 'independent' you are!
DeleteI completely agree with Anonymous Girl. I respect Justice Katju but his blog seems like a knee-jerk reaction. Why is talking about breast enlargement any more inappropriate than talking about multi-million dollar cars or luxury diamonds and so on? The fact that this article has appeared in India Today shows that it is relevant to a large section of the modern, urban Indian women. It is a big trend amongst a certain segment of women, and the magazine has captured it. What's morally or legally wrong with it?
DeleteIt's like when ASIAD games were to first come to India, our 'socialist'-minded politicians said, why spend millions on games when thousands are malnourished and poor? The point is, yes, one should tackle poverty, but in the meantime, progress and social change will continue.
I fully agree with Justice Katju. After the political class, the media is yet another example of what self-regulation can do to an entire institution. From their primary responsibility of "reporting" news, many prominent media persons have begun "creating" news, often to appease the powers-that-be in politics and business (who patronize them). The way some of the popular TV anchors interact with some of their panelists on their TV programs shows the camaraderie in their relationship. So, when such media-persons criticize these very politicians they lose credibility. Certain scandals in recent past (Radia Tapes ?) prove this beyond doubt. It was shocking to know that popular TV anchors who seemingly chide the people on their shows, are more than willing to make bed with them subsequently. No wonder Justice Katju has been unpopular within the media space due to his questioning of malpractices in the profession / institution. But, as in politics and higher judiciary which too are self-regulated, the media must also clean up its act before an external pressure forces them to mend their ways sooner rather than later. Kudos to Justice Katju for 'flowing against the tide'.
ReplyDeleteWell the internet is the new form of media. The age of tv off over or will be over in a few years and the fact is people gave little importance to it and didn't care if it went unregulated. Now they will pay for their mistake. The way America is paying right now

ReplyDeleteKeep going sir..!!
Sir,
ReplyDeleteIs it really you on facebook? http://www.facebook.com/justicekatju ... We are all confused if someone is impersonating.
Obviously He is justice Katju..Plz see the facebook badge on top right of the blog.
Deleteindeed media has flouted its priorities.
ReplyDeleteThe mainstream media - both print and electronic media - seem to have lost sense of direction too! Probably their coverage caters to their readership and viewership, hardly bothering about the rest who are toiling to meet their ends meet day-in and day-out.
ReplyDeleteWe appreciate the bold article by the author.
http://indiatoday.intoday.in/calendar/288/2012/magazine.html go through this unnecessary article of india today
ReplyDeleteI had stopped reading India Today sometime in the late 1990s. I don't know anyone personally who reads India Today. Many may have it on their table but no one I know reads it. It will die in a few years.
ReplyDeleteI don't even get the argument here.. If a women earns good, isn't she supposed to groom herself ? You expect them to donate their salary to "poor" people of India ? Why should she ? Do you donate your salary and savings to the "poor" people of India? No right ?
ReplyDeleteYes India is a poor nation but that doesn't mean those who can afford it shouldn't do what they like ?
Yes if a women wants she has all the freedom to do whatever.... the article is not denying it.the point here is speaking of private parts and a pic on cover page??! dont you think it is shame on indian women?See i'm not some hindutva thing talking about our culture, yet we should be ashamed of it! we so called indian women are so accustomed to such things that we no more feel embarased of such things :(
DeleteIf a guy want such thing on his private parts and we have an article on some national magazine with such a picture how do one look at it? Dont we feel embrassed? but when it comes to a women we are accustomed to it to the point that we dont even know that it is not the right thing! some may even say it is ones right to know about ones body yes, but on cover page?
i dont want to argue either i'm tired of such things hopefully :) we are sailing in the same boat in this point! :)
Media freedom is not given for this nonsense and shameful article.
ReplyDeleteSir media has the responsibility to cater to all section f society, not only poor. And if media raising their(rich) issue whts wrong wit that .Aftr all they are also citizen.
ReplyDeleteSir, I've always liked your writings, not only because of the perspective that you share in them and the legal elucidation that they carry, but also because an ex-judge is not restricting himself from putting forth his conscious views and opinions; realizing his responsibilities as a citizen, unlike the general trend of bench of keeping much to itself. It is understandable for the judges to stay away from public while in office, but I think such erudite minds must not constrain themselves from active participation in the socio-political affairs after they quit. You're putting a great example, Sir.
ReplyDeleteDear Sir, these type of activities are not for poor Indian. this is for Metro Cities Women who want to look attractive and ready to show her body parts. actually Indian media is not able to understand about this nation. All media personalities are crazy about US or other western countries. They are trying to convert this nation and willing to kill the soul of India. Every Year, India Today is releasing article regarding thinking of Indian women about Sex and sex related issue. are we really need this? I think no. Second, have look into times of India Delhi times or Mumbai times, half of the pages are having pictures with very less clothes. what we want to do by showing this? are we willing to change the mindset of a four or five year old child? this is really stupidity and misuse of democracy. We should understand very important point, " with great power, you will have more responsibilities". but India media is not mature enough to handle power of democracy or freedom. Few percent people are continue killing values and history of this part of the world. a nation without language, history and custom is like a body without head.
ReplyDeleteplease save this nation.
What sanctimonious, holier than thou nonsense! While I respect Justice Katju's constitutionally protected right to express his opinions, no matter how archaic or traditional they might be, but as the press council chairman his mandate is to protect and promote the freedom of the press - not ram down the throats of the media his agenda of what the news should be like. Justice Katju forgets that the freedom of speech and expression is perhaps more sacred a right than the right to equality - which would amount to naught if you couldn't air your protest about unequal treatment in the first place. Food for thought, ladies and gentlemen.
ReplyDeleteYou are absolutely right sir !
ReplyDeleteBig Deal.. those who are interested in referring these magazines may do it... what do we have to do with it... all the people cannot be expected to think in the way what we think is appropriate. I really don't get the logic put forth here. More over we have generalised the state of women in India here.
ReplyDeleteThis time we 100% agree with Justice Katju and India Today has just used cheap tactics to increase the magazine sale, just like other cheap adult magazines like "Debonair" and "Fantasy" in the market. Also agree that media has totally lost its priorities and sense of proportion, toady its only, How we can sell more magazines by making cover page sexy, INDIA TODAY goes to every school library, even 6th class student reads INDIA TODAY, with all this rubbish it should get "A" certificate like other magazines like "Debonair".
ReplyDeleteI totally agree with Justice Katju that significant portion of media has lost its vision and common sense and it has sold itself to the so called corrupt politicians and the rich people. They do not care how horrible is the life of common men in this country..they are living in a different world....Shame on such media houses.....they are just running away from their core responsibility as a 4th piller of democracy.....
ReplyDeleteTotally agree with justice katju.
ReplyDeletethe point of these kinds of add is to make you realize that something is not normal with your body and you will fell inferior in some aspect whether its related to your height , weight or as in this case "breast" so that they can make money out of that .we all see adds in the newspaper which wants to cash on our fears. May be the "india toady " has done it for the first time but i'm sure there will more to join the group. it is a kind of irony that the media which reputes to act for the people actually acts for the same group of people for whom it shudn't
ReplyDeleteI strongly agree. One point I'd like to make is that the journalists have not being following the norms while writing about any happening or incidence or any issue. It feels like I am reading a court verdict rather than a newspaper article. They portray an accused as a convict. Words like "allegedly", "reportedly" are not in their dictionaries. They have forgotten that a person is innocent until proven guilty.
ReplyDeleteI disagree, A media can focus all the sections of Society.
ReplyDeleteIf not, you should not be a justice but a farmer.
PERIOD.
Well done Sir,
ReplyDeleteI really appreciate our thoughts, in today 's society
we need someone like you who can speak truth fearlessly , bluntly, and show the mirror to the so called Mirror of the society "MEDIA".
To All Those who are disagree with this article
Just make a short visit to any government HOSPITAL
of Rural or backward area where people can not afford 10 to 50 rupees to save their lives. And this the reality of much larger part of our country. Then You will realize that media should give first and foremost attention to these kind of issues rather then telling people how many Lacs could be affordable for the perfect size of breasts.
Anonymous WOMAN,
ReplyDeleteWe have the highest number of MALNOURISHED CHILDREN IN THE WORLD.It simply means that we also have the highest number of women who do not have
enough MILK IN THEIR BREASTS TO FEED THEIR CHILDREN. And because of that millions of infants and children are subject to premature DEATH and fatal diseases. But this matter is not serious enough to be the top story of the leading magazine....WHY??? because we have have more serious issues like "The Booby Trap ", Cost of breast augmentation...etc People are free to make such things as cover story, WHY ??? Justice Mr.Katju I'm not anonymous and as former advocate of the Supreme Court of India and solicitor of the Supreme Court of India and as an author I say that without India's substandard Supreme Court Judges India would not have been in this state today. I have evidence and this is not a wild allegation. If you want to understand why I called judges like you sub standard(not because of your Bad English though as English is only another language) but for substantive reasons. Before you take out defamation or contempt proceedings against me please have a look at the link and then seek independent legal advice.
Yours faithfully,
Johnson Thomas Karingozhakal

It will be a good idea if you could show this article to your friends in the Supreme Court so that they realize in all rule of law countries and democracies in the West the Indians are doing exceptionally well except under the very nose of the "Bad English" speaking Indian Judiciary!
thanks
