Is it for me alone to bell the cat ?
I had received from someone perhaps in August last year a dossier containing a lot of documentary proof ( photocopies of sale seeds showing illegal property transactions, etc ) prima facie establishing large scale corruption by the present Chief Justice of India, Justice Dattu.  I had also received an email showing photograph of the palatial house Dattu has built in Bangalore over 1200 sq.m. land.
 I got several copies of the dossier made, and gave it to many persons, including mediapersons, before Dattu became CJI, and my only request was that the allegations be investigated.
I gave one copy to Mr. Shanti Bhushan, a very senior advocate of the Supreme Court, and former Union Law Minister, who sent his son Prashant to my residence to collect it. Next day Mr. Shanti Bhushan telephoned me and said that the allegations were very serious. I then said to him that in that case the Committee on Judicial Accountability ( COJA ), consisting of some very senior lawyers of the Supreme Court and retired Judges, should investigate into the allegations, but nothing was done.
The mediapersons to whom also I had given copies of the dossier, obviously being scared, did nothing. Nobody was even willing to investigate into the charges, though there was prima facie documentary proof of corruption by a person who was going to be made the Chief Justice of India.
I had given to Mr. Ravi Shanker Prasad, the then Union Law Minister, and presently still a Minister in the Union Cabinet, a copy of the dossier containing documentary proof of serious allegations of corruption against Justice Dattu, and had requested him to get the allegations investigated. This was before Dattu became CJI.
 I am sure Ravi Shankar Prasad showed the dossier to the Prime Mimister, in view of its importance.
So the Prime Minister owes it to the people of India to come clean and disclose what happened after he came to know of the dossier and its contents. Did he get the matter investigated, and if so, what was the result of the investigation ? Through whom did he get it investigated ?
 Or did the Prime Minister and his close colleagues think that now they have a handle or damocles sword over Dattu, and get whatever favours they wish from him, by giving him threats based on the dossier ? Certainly, Dattu's disgraceful statement praising Modi points in that direction.
 It is time that the people of India know the truth
Gandhi's motivations
Some people said how could Gandhi be a British agent when he never hankered for power or money, and lived a simple life in an ashram ?
 My reply is as follows :
 Different people have different motivations. For some the motivation is money, for some it is power.
Gandhi's motivation appears to be his desire to be regarded as a saint, a 'Mahatma', and the enormous power which he actually excercised over the Congress Party e.g. the way he got Subhas Chandra Bose removed from Presidentship of the party, calling Bose's election his personal defeat, though pretending to be not even a one anna member. However, as I said, all this is really irrelevant. What is relevant was whether he was objectively serving British interests.
 As regards his living in some ashram, I am reminded of Sarojini Naidu's famous statement " It costs a great deal of money to keep Gandhi living in poverty ". The businessmen who financed the ashram benefited enormously
Agents
 Some people ask me what proof do I have that Gandhi, Jinnah, RSS, Muslim League and their leaders, Subhas Chandra Bose, etc were agents.
 My answer is that I call them agents objectively. In other words, by their deeds they served the interests of the British, Japanese, etc ( as the case may be ).
 For instance, it is well known that the British policy was divide and rule ( see online ' History in the Service of Imperialism ' by B.N. Pande and my article ' The Truth about Pakistan ' ). The British wanted Hindus and Muslims to fight with each other so as to retain control over the subcontinent. So those who furthered this policy of divide and rule, consciously or unconsciously, wittingly or unwittingly, were British agents.
 Gandhi and Jinnah were two sides to the same coin, just as RSS and Muslim League were two sides to the same coin, the coin being the British policy of divide and rule ( see my blogs on Gandhi, Jinnah and RSS on justicekatju.blogspot.in )
 So when I call someone an agent I mean that he was objectively an agent, in the sense of furthering the policy and interests of the British ( or Japanese ).
 Whether he was also subjectively an agent, in the sense of being a conscious agent, I cannot say, because I cannot enter into someone's mind and know what is going on there. But how does that matter ? The relevant thing is whether his deeds are in fact furthering the policy and interests of the British ( or Japanese ).
 Also, when I call someone an agent of the British ( or Japanese ) I do not mean he was getting salary or other benefits from the British or Japanese. I mean that his deeds served the latter's interests, and in fact that is what really matters.
Make Rakhis of bread
After Yoga Day is coming Rakshabandhan. This Govt. is advancing from one victory to another, like the Wehrmacht from 1939 to 1941 ( Stalingrad is yet far off ).
 Since half our children are still malnourished, and no amount of Potempkin villages can conceal this fact, nor Queen Marie Antoinette give them cakes, I have a suggestion to make.
 I suggest that the Government make rakhis of bread ( surely this high tech govt. which has mastered the science of 'vikas' can find out a way to do this ), and distribute them free to the hungry Indian children.
 Till now the rakhis which sisters tied on the hands of their brothers were thrown away after a few hours or a day or so, thus serving no useful purpose. But these 'vikas' rakhis made of bread can be edible. So they will serve a double purpose---while they will display sisterly love, they will also quell the pangs of hunger to some extent. Also, there will be nothing to be trashed, it will all be in the stomach.

Abductions of children from USA
There are over 3 million people of Indian origin living in USA.
There have been several instances where a couple of Indian origin is living in USA, and the wife surreptitiously leaves with her child or children for India, and then refuses to return to USA. In such cases sometimes the husband obtains an order for custody from a U.S. Court, but it is not honoured in India. What is the law in this connection ? I myself had some such cases before me when I was a Judge of the Indian Supreme Court.
 The law is that both the parents have joint custody of a minor child. So it is illegal for one of the parents to surreptitiously take away the child, and deny joint custody to the other spouse.  In USA  this is a crime under the  Parental Kidnapping Crime Act.
 Apart from the above law, there is a Hague Convention on Civil Aspects of International Child Abduction, 1980, which came into effect in December 1983. This provided for returning an abducted child to the country from which it was abducted.
However, India has not signed the Hague Convention, and so the Indian Govt. is not bound by its provisions.
 As regards, judgments of American courts for restoring custody to the father, these are not binding in India, vide Dhanvanti Joshi vs. Madhav Unde, JT 1997 (8) S.c. 720, Sarita Sharma vs. Sushil ASharma, JT 2000 (2) S.C. 268, Sahiba Ali vs. State of Maharashtra, JT 2003 (6) S.C. 79 etc, though they are a factor which can be taken into consideration.
 The Indian Govt. will not comply with orders of custody passed by American courts, as these are not binding in India. India is a sovereign country having its own laws and its own courts.
 If the father of the child files a petition for custody of the child in an Indian court, the law that will apply is the Guardians and Wards Act, 1890, and, in the case of Hindus, the Hindu Minority and Guardianship Act, which provide that custody of a child below 5 years of age should ordinarily be with the mother. However, the law of custody is well settled, that the paramount consideration for the court in awarding custody is the welfare of the child. So even if the child is below 5 years of age, the court may not grant custody to the mother if by evidence it is established that it will not be in the interest of the child's welfare to award custody to the mother, e.g if she is a prostitute or drunkard or drug addict or is otherwise unfit to look after the child
A French Revolution is coming

I had earlier sent it to several leading Indian newspapers and journals, but they all seemed to have chickened out, probably regarding the contents too explosive.
  What I have written may appear scary to many, but how long can people turn a Nelson's eye to the harsh glaring and worsening realities of India ? Should we keep behaving like Mir Saheb and Mirza Saheb in Munshi Premchand's story ' Shatranj ke Khiladi ' who deliberately remained oblivious to all that was happening around them, till the British army entered Lucknow ?

Email to Michael Steiner, The German Ambassador to India, who is retiring in two days ( 25th June ) :

Michael and Eliese,
 Michael would be retiring in 2 days time. On the occasion of his farewell party please request someone to read out the following statement to everyone :

Friends,
  I regret I am unable to join you on this occasion as I am in California, and shall be returning only next month.
 On this occasion I wish to say that Michael Steiner has been, in my opinion, the most outstanding of all the Ambassadors in India, and has endeared himself to the people of India, particularly the people of Delhi. So his departure will be a big loss to all of us.
 Most Ambassadors usually do not mix much with the people of the country to which they are sent, but that way they do not get to know the culture of their host country.
 Michael, and Eliese were not like that. They often mingled freely with Indians, even with poor people, and learnt about our culture. They heard Radhika Chopra singing beautiful Urdu ghazals. They participated in the Pongal Sankranti day function at my house, in which former President of India, Dr. APJ Abdul Kalaam was Chief Guest. Michael was Guest of Honour in the Sanskrit day function organized by India Heritage Foundation, in which Michael gave an excellent speech mentioning the great contributions Germans had made to Sanskrit. Michael was Guest of Honour in the National Press Day function 2 years back, in which he spoke on the freedom of the press in Germany. Many more such examples can be given.
   Michael was deeply interested in bringing German technology to India, and in this respect he was a real friend of India, because it is only through modern technology that India can face its massive challenges and overcome poverty and its associated social evils.. For this purpose he organized visits of several German delegations to India, including one led by the German Foreign Minister Mr. Frank Walter Steinmeier, whom I had the privilege to meet in the German Embassy
  Many Delhiites, including myself and many of my friends were delighted to be invited to the World Cup soccer matches shown on a big screen in the German Embassy in Chanakyapuri, where we also enjoyed excellent German wine and sausages.
  To me, Michael and Eliese's departure will be a big personal loss. I do not know how it happened, but over the years Michael and I had become very close to each other. I used to tell him, in lighter vein, that he and I were both brothers in our previous life, who had been killed in the battle of Stalingrad, but have been reunited in this life.
 As regards the beautiful Eliese, I told Michael that he had stolen her from me. I used to call her ' La Belle Dame Sans Merci ', after the famous poem of Keats, and addressed her as ' Your Divine Ladyship'. I often sent her Urdu poetry like offerings to a goddess.
  Michael and Eliese, I will miss you both very much. Thank you for your kind invitation to visit you in Munich where you intend to settle down, but let us see whether I can avail of your hospitality

The Truth about the Rashtriya Swayamsevak Sangh ( R.S.S. )

A few months back a friend of mine wanted to join the B.J.P. and consulted me. I advised him against joining any political party as in my opinion none of them have genuine love for India or its people, and are only interested in power and pelf.

 A few days later he again met me and said  he had made some enquiries and came to know that the persons who rose high in the B.J.P. government or organization were those who had many years background as a member of the R.S.S. Also, the 'ghar wapasi', and speeches of BJP MPs like Mahant Adityanath, Sadhvi Niranjan Jyoti , etc ( e.g. calling Muslims 'haramzadas' i,e. bastards ) and other reactionary policies and statements of BJP/RSS leaders had antagonized him. Hence he decided not to join B.J.P.

 The truth is that the B.J.P. is dominated by the R.S.S. and all its top ministers and party officials have decades of membership of the R.S.S.

What is the R.S.S. ? It was an organization created with British backing when India was under British rule, and its object, like that of the Muslim League, was to further the British policy of divide and rule. So both are two sides of the same coin.

 I have interacted with many R.S.S. officials and members, and found that they are rabidly reactionary, anti Muslim and anti Christian. They have closed minds about Indian history and culture. According to their way of thinking, all Muslims and Christians are devils, and Muslim rule in India was a period of slavery for India. Also, Hindus invented aeroplanes (as 'pushpak viman' is mentioned in the Ramayana ), atom bombs guided missiles, genetic engineering and head transplant surgery ( as was done to Ganesh ), as claimed by Modi.

 R.S.S. and B.J.P. thrive on hatred, that is, communal tension and communal riots, because that is all they have in their ideological arsenal. All the talk of 'vikaas' was really hogwash, as Arun Shourie, who had earlier supported Modi, has pointed out now. It has been replaced by stunts like Yoga Day, ghar wapasi, beef ban, swatchata abhiyan,

The RSS spokesman Mr. Rakesh Sinha recently tweeted "
" if @mkatju don't apologize for his offensive remark on Dr Hedgewar in 48 hours, I will file case against him. He will den know who are we "
 To which I tweeted in reply :
" O, so you like to give threats. So let me tell you. RSS and Muslim League were 2 sides to the same coin, both serving the British policy of divide and rule. So both were British agents. All RSS has is hatred of minorities, especially Muslims and Christians, which is anti-national "
