All the perfumes of Arabia

All the Perfumes of Arabia
By Justice Markandey Katju

Narendra Modi is being projected by a large section of Indians as the modern Moses, the messiah who will lead the beleaguered and despondent Indian people into a land of milk and honey, the man who is best suited to be the next Indian Prime Minister. And it is not just the BJP and RSS who are saying this in the Kumbh Mela.  A large section of the Indian so called 'educated' class, including a section of our 'educated' youth, who have been carried away by Modi’s propaganda are saying this.

I was flying from Delhi to Bhopal recently. Sitting beside me was a Gujarati businessman. I asked him his opinion of Modi. He was all praise for him. I interjected and asked him about the killings of over 2000 Muslims in 2002 in Gujarat. He replied that Muslims were always creating problems in Gujarat, but after 2002 they have been put in their place and there is peace since 2002 in Gujarat. I told him it was the peace of the graveyard, and peace can never last long unless it was coupled with justice. At this remark he took offence and changed his seat on the plane.

The truth today is that Muslims in Gujarat are terrorized and afraid that if they speak out against the horrors of 2002 they may be attacked and victimized. In the whole of India Muslims (who are over 200 million of the people of India) are solidly against Modi (though there are a handful of Muslims who for some reason disagree).

It is claimed by Modi supporters that what happened in Gujarat was only a 'spontaneous' reaction (pratikriya) of Hindus to the killings of 59 Hindus in a train in Godhra. I do not buy this story. Firstly, there is still a mystery as to what exactly happened in Godhra, and who was responsible for the killings. Secondly, the particular persons who were responsible for the Godhra killings should certainly be identified and given harsh punishment, but how does this justify the attack on the entire Muslim community in Gujarat. Muslims are only 9% of the total population of Gujarat, the rest being mostly Hindus. In 2002 Muslims were massacred, their homes burnt, and other horrible crimes committed on them.

To call the killings of Muslims in 2002 as a spontaneous reaction reminds one of Kristallnacht (see online) in Germany in November 1938, when the entire Jewish community in Germany was attacked, many killed, their synagogues burnt, shops vandalized, etc after a German diplomat in Paris was shot by a Jewish youth whose family had been persecuted by the Nazis. It was claimed by the Nazi Government that this was only a 'spontaneous' reaction, but in fact it was planned and executed by the Nazi authorities using fanatic mobs.

I have said in my article 'What is India?' (see on my blog justicekatju.blogspot.in as well as on the video on the website kgfindia.com) that India is broadly a country of immigrants (like North America) and consequently it is a land of tremendous diversity. Hence the only policy which can hold it together and take it on the path of progress is secularism and equal respect and treatment to all communities and sects. This was the policy of the great Emperor Akbar, which was followed by our Founding Fathers (Pandit Nehru and his colleagues) who gave us a secular Constitution. Unless we follow this policy our country cannot survive for one day, because it has so much diversity, so many religions, castes, languages, ethnic groups, etc.

India therefore does not belong to Hindus alone, it belongs equally to Muslims, Sikhs, Christians, Parsis, Jains etc. Also, it is not that only Hindus can live in India as first rate citizens while others have to live as second or third rate citizens. All are first rate citizens here. The killings of thousands of Muslims and other atrocities on them in Gujarat in 2002 can never be forgotten or forgiven. All the perfumes in Arabia cannot wash away the stain on Modi in this connection.

It is said by his supporters that Modi had no hand in the killings of Muslims in 2002, and it is also said that he has not been found guilty by any Court of Law. I do not want to comment on our judiciary, but I certainly do not buy the story that Modi had no hand in the events of 2002. He was the Chief Minister of Gujarat at that time, and the horrible events happened on a large scale in Gujarat Can it be believed that he had no hand in the events of 2002? At least I find it impossible to believe it.

Let me give just one example. Ehsan Jafri was a respected, elderly former Member of the Indian Parliament living in the Chamanpura locality of Ahmedabad in Gujarat. His house was in the Gulbarga Housing Society, where mostly Muslims lived. According to the recorded version of his elderly wife Zakia, on 28.2.2002 a mob of fanatics blew up the security wall of the housing society using gas cylinders, they dragged Ehsan Jafri out of his house, stripped him, chopped off his limbs with swords, etc and burnt him alive. Many other Muslim were also killed and their houses burnt. Chamanpura is barely a kilometer from the police station, and less than 2 kilometres from the Ahmedabad Police Commissioner's office. Is it conceivable that the Chief Minister did not know what was going on? Zakia Jafri since then has been running from pillar to post to get justice for her husband who was so brutally murdered. Her criminal case against Modi was thrown out by the district Court (since the Special Investigation Team appointed by the Supreme Court found no evidence against Modi and filed a final report), and it is only now (after a gap of over 10 years since the incident) that the Supreme Court set aside the order of the trial Court and directed that her protest petition be considered.

I am not going into this matter any further since it is still sub judice.

Modi has claimed that he has developed Gujarat. It is therefore necessary to consider what is the meaning of 'development'. To my mind development can have only one meaning, and that is raising the standard of living of the masses. Giving concessions to big industrial houses, and offering them cheap land and cheap electricity can hardly be called development if it does not raise the standard of living of the masses.

Today, 48% Guajarati children are malnourished, which is a higher rate of malnourishment than the national average. In Gujarat there is high infant mortality rate, high women's maternity death rate, and  57% poverty rate in tribal areas,  and among Scheduled Castes/Backward Castes. As stated by Ramchandra Guha in his article in 'The Hindu' today, (8.2.2013) in Gujarat environmental degradation is rising, educational standards are falling, and malnutrition among children abnormally high. More than a third of adult men in Gujarat have a body mass index of less than 18.5 – the 7th worst in the country. A UNDP report in 2010 has placed Gujarat after 8 other Indian States in multiple dimensions of development e.g. helath, education, income levels, etc. (see Hindustan Times, 16.12.2012 P.13)

Mr. Guha further states in his article: “As a sociologist who treats the aggregate data of economists with scepticism, I myself do not believe that Gujarat is the best developed State in the country. Shortly after Modi was sworn in for his third term, I travelled through Saurashtra, whose polluted and arid lands spoke of a hard grind for survival. In the towns, water, sewage, road and transport facilities were in a pathetic state; in the countryside, the scarcity of natural resources was apparent, as pastoralists walked miles and miles in search of stubble for their goats. In terms of social and economic development, Gujarat is better than average, but not among the best. Kerala, Himachal Pradesh and Tamilnadu are the three states which provide a dignified life to a decent percentage of their population”.

Business leaders no doubt claim that Modi has created a business friendly environment in Gujarat, but are businessmen the only people in India?

To those who talk of development of Gujarat under Modi I ask this question: Should the malnourished children of Gujarat eat the roads, electricity and factories which Modi has created?

I appeal to Indian people to consider all this if they are really concerned about the nation’s future, otherwise they may make the same mistake which Germans made in 1933.

  1. I do not buy the opinion put forward by Mr. Markandey Katju, we all know that action speaks louder than words, which is justified by Narendra Modi in past 3 state elections. Community based onslaughts existing in India prior to independence, and repeated in every couple of decades where Government act mere as spectator as also during 1980-90s in Delhi and Kashmir, which is not recalled by PCI Chairman. It's upto citizens to decide fate of there nation in legitimate way as provided by our constitution.

    2. That's your big confusion Mr. ghazali, look what your own leaders are saying : "In Gujarat, Jamiat workers on the ground have told me that in several assembly segments, Muslims voted for Modi. There is a perceptible change and circumstances are different now... Muslims in Gujarat are economically better off than in several states which have so-called secular governments in power," Madani told a private news channel."
In the just-concluded civic election, BJP made impressive gains in Muslim-dominated areas. Salaya municipal poll outcome was flaunted by BJP to drive home its point that there was a perceptible change in the attitude of Muslim towards the party. In Salaya, which has 90% Muslim population, Congress could not win a single seat.
BJP IS WINNING IN MUSLIM DOMINATED AREAS, WHERE MUSLIMS ARE 90% IN POPULATION.
      KEEP YOURSELF UPDATED MAN.

Have you observe that ? 10 years ago there are 17 (Muslim)MPs of congress from GUJARAT but now they give only 4 tickets to Muslim, than how can you balm Mr. Narendra Modi for not distributing tickets to Muslims... You should make your concept clear first Man..

  4. Dear Sir,
In democracy we have to select out of two contender. On that count Narendra Modi is certainly better then his present contender. If we go to elect our leader as per your given scale, then no party can be repeated in any election. Narendra Modi is our present national Icon because his opponent has made him so. He is the most abused leader of free India. Neither his party, nor media nor elite class of this nation ever acknowledged his stature and contribution. The ruling congress party is not acknowledging its responsibility to give any visionary leader for next generation. Third front is still occupied by its socialistic line of thinking, which has ruined the three generations of our past. In this scenario, if our middle class is looking towards him, we can not blame it. Top is vacant, leaders are absent and peoples are tired. Some one has to sing the national anthem with full vigor and commitment. He has shown that courage and hence he is the most popular leader of our time. May you and me like it or not.

The problem with us Indians is that we are very emotional in terms of our family, relative, blood, religion, caste etc...we believe in the picture shown to us rather than enquiring about the subject..

You also missed out aa point here Sir and that's rise in number of Fake encounters in the state...

Even when i debate with others about Modi especially educated ,even NRI's they get angry at me as Under Development package Modi is offering Hinduvta also...But people forget in a war , doesn't matter who win both side looses...

And my message to others who think that Mr.Katju here indirectly is supporting UPA should first try and gain some rationality.. There is no hidden message in this post which needs to be decodified..

I am a huge fan of your Sir and the main reason behind this is your rationality... Country needs people like you..

And don't forget this man is sitting at a quasi-judicial post. he has breached code of conducts by engaging himself in political discourse. Modi bashing has become a fashion or moreover a prestige symbol for those who boast of themselves as intellectuals. and look at the ignorance of this man, when he says he doesn't buy media stories about godhara. Is Mr. kataju trying to say that he doesn't believe in the judicial process of this country when the trial court has convicted a number of people for burning the train which brought death to 59 innocent people. But the truth is Kataju is one of those guys who start worrying about their post retirement assignments in order to secure a good bunglow at Lutyans. And once that is accomplished the only agenda they have is to somehow validate India as a dynastic Democracy. They try to behave and pose as if India has only a single Option and that is to rest its destiny in Laps of THE DYNASTY.

  6. Dear Sir,
Even after my utmost sincere respect for the Muslims brothers living in my neighbourhood, I am forced to see that no Muslim country on earth is having democracy, secularism and freedom of expression. They are not ready to accommodate others in their main streams. You can not tell a single Hindu, Jain or Boudh or Christian Individual, who came to fame in Pakistan and Bangladesh after the disastrous partition of 1947. But here we can parade thousands of Muslim brothers who earned fame and name on this part of land. Even all the Muslim dominated constituency of our nation too elect only Muslims as their leader. If secularism is in danger today then certainly it is not because of Modi but since before of Modi. Even after all the allegations you impose on our democracy in your various articles, one thing is clear. That our democracy can not be endangered by anyone including Modi. We have taught that lession to Indira Gandhi and if Modi will repeat that mistake, this Nation will throw him out too. Hence please don’t compare Nazi rule in Indian context.

  7. Everyone,

What you think? Should Supreme Court / High Court judges performance be reviewed?

We have no clue how many cases they solve, how many they transfer they make to lower courts, how many they adjourn? How long they take to solve the cases? What is fee charge of case in SC? Who are the people who access SC? Only Amabin/Birla type or Ram/Shyam/Jadu/Madhu type?

Absolutely no idea. Zero data. Nada information on Judges. It is big black hole, where everything seems to be vanishing.

Now that we also know what MP/MLA do in parliament - how many questions, how many private member bills, how many debates etc. via websites like PRS - do you folks think SC/HC judges are above everyone?

Most of the middle class work in private sector today and will not have a job for more than a year if no performance. I dot not about you - may be you have a life long security in private sector. But as I have seen many dont.

Our SC judges, take huge salary on tax payers money with loads of facilities. To be fair they also pay tax. But, a common person does not have 1/100th of facility that SC/HC judges have.

Now that we are paying the money for their package, do you think we should know? Why cases take 5, 10, 15, 20, 25 years to be solved by our Judges? Actually what is their performance?

    Shall we?

And how about the one AP judge, who cleared record number of cases? Why others can not do?

There is n o comparison between Modi and the UPA .The BJP is restless after almost a decade because they cannot as yet lay hands on the bounty.
Modi's reelection for an unprecedented third term must be seen akin to the popularity or the silence of the Germans to the perverted policies of Adolf Hitler.

If Modi says he had no knowledge of the tyranny of the Hindutva mobs and the reaction- the carnage was a spontaneous , then he is certainly unfit to rule. Because he had failed in protecting the rule of the law and providing security to all section of the State's population.
As you noted bringing in huge industrial houses with lollipops of free land , power etc does not perse trickle down or alleviate poverty. The highways, and the huge factories alone are not marks of development.
Modi's plank is of great threat to the union and his philosophy is abominable.

  10. Dear Mr. Katju,
1st I acknowledge your long term service to the society, and all the best wishes for again choosing a tough assignment where you need to go through hundreds of matters every day.
Dear friend but in view of the Column, you written todays Hindu Newspaper (15.2.13) I am sorry to say that your vision is so corrupted and you aligned towards one small selfish group.
Supreme Court itself has a verdict that ‘HINDU’ is not a religion but a ‘LIFESTYLE’
So it includes every school of thoughts towards a social and environmental harmony
You described about 20cr Muslims out of 120 cr People in India..
The fundamental way of Semitic Religion’s teaching that only their way of life leads humanity towards happiness and salvation is the main reason of conflicts anywhere in the World.
We all expect you like senior and respected people should give clear vision to the mass, instead of the bla bla bla kind of childish arguments.. which have no relevance and only make your reputation degraded, and you may become restricted to enjoy a company of selfish people who are opposite to humanity.
Narendra Modi, or Muslims, or even India should not be a matter for the visionaries, leave all these circulation circus to the concerned people because that is their bread and butter.
We expect your kind of people are matured to acknowledge the issues of 700 cr strength Humanity and their co-existence with the nature, the unequal distribution of resources are making the majority of them to struggle for their daily survival.
We expect our policy makers are intelligent enough to foresee the environmental issues of pollution and exploitation of the mother Earth, which so called development is rising,
We expect the civilized people should make their effort to spread the glory of art and culture for humanity and to make the society to engage with this kind of creativity, where their anger and stress will become irrelevant and give a way to pleasure and happiness.
Mr.Katju, I wish and we all want you to be in a place you really deserve. All the best wishes.

  11. Dear Sir,

Incredible piece again! There is lot to think! But we have to be honest, we will not get an Akbar/Sher Shah/Tipu Sultan/Sardar Ballav Bhai Patel as a national leader, not even a Nehru! Probably nearest closest people are Modi/Vajpayeeji! Manmohanji is incredilbe but as an economist not as a minister esp not a PM! And as president Kalam Sir is incredible! But in Indian democracy the PM is the main person, and who can be better than Modiji? Tell me Sir? is there anyone even near?

I am completely against what happened in Gujarat 2002 esp since Gujju people are quite nice, calm, business minded people! I guess mass hysteria, chaos, panick & religion were the major cause! But post 2002, one has to see how much peace & prosperity has been there in Gujarat esp compared to rest of India! And corruption & bribery in Gujarat? May be there have been but really really less compared to rest of India! So Modi has proved himself!

In corruption & bribery, we are competing with Russia (though I still believe as do many of russian friends Putin is less evil than many of his predecessors and is quite good esp since his main ambition is the growth and enrichment of Russia, well at any cost! Putin has also proven himself and diggin out russia out of financial crisis in 98, and russia's growth has been phenomenal of late though they rank lowly in corruption & equal distribution of wealth! Dmitry Medvedev would have been less of a dictator and better person than Putin), SA & Brazil! Anyway let us not go
deep into Powerful Russia's political condition or say that of other BRICS memebers and let us concentrate on India as of now!
We have a bigger population and more number of poor as well as BPL perncentage (of course our country is still much safer compared to those countries!)!

And now even greater threat to the safety of people, esp women? 10 years back we would not have thought how bad it would get for women in India! This is scary & appalling!

Out of sheer greed & lust, the political class are torturing and have sent India Inc growth story to the ICU! We need change in leadership and our attitude!

Modi has proven himself, and if he does become the CM, he will do a decent job if not really good, it is not that he is like Mohd Bin Tughlaq or certain other CMs who were chosen by their state in the name of change and the state suffered badly and regretted that decision later on!

All said and done, I believe we can, we may not be a new country but we got our independence in 1947! we have come ahead a good & positive deal from there!

At the start of 4th para, you wrote “It is claimed by Modi supporters that what happened in Gujarat was only a 'spontaneous' reaction (pratikriya) of Hindus to the killings of 59 Hindus in a train in Godhra. I do not buy this story. Firstly, there is still a mystery as to what exactly happened in Godhra, and who was responsible for the killings.”
In the next few lines you again say “ It is said by his supporters that Modi had no hand in the killings of Muslims in 2002, and it is also said that he has not been found guilty by any Court of Law. I do not want to comment on our judiciary, but I certainly do not buy the story that Modi had no hand in the events of 2002.”
I want to ask why it’s is not evident to you that Godhra incident WAS actually an act of inhumanity. If you consider the act of 2000 Muslims inhuman, why won’t you consider the killings of 59 hindus inhuman. So if there were 2000 burnt Hindus in the train , would you have taken both the incidents equal then ? You say there is a mystery as to what exactly happened in Godhra but you openly crucify Modi considering him the perpetrator even when he is not convicted by land of the law.

My point is that why can’t you be neutral and accept what happened in Godhra was wrong. I am not justifying Modi as right but I cant overlook the burning of 59 CarSewaks at the same time. You have given the example of burning Ehsan Jafri alive . Don’t you think burning those many people inside a train was similarly inhumane. You yourself told that the Gujarti that sat along with you in plane said the Muslims were creating problems in Gujrat. Why will a common person in his senses say something like that?
Again you have penned an example of Nazis who massacred Jews due to killing of a German diplomat and tried to connect with Gujrat riots. I disagree again. While the Nazis were known for their brutality openly, Narendra modi didn’t had any such past before 2001. He may be non-secular but he didn’t had any brutal character. Hence to put a blame of a riot upon him in entirety is entirely wrong in my view. I am again not defending him, neither trying to justify what happened after Godhra was right. If found guilty , all culprits , those who were in Godhra or elsewhere in Gujrat, including Modi should be punished equally.

Now coming to the point of development , you have only said ” To those who talk of development of Gujarat under Modi I ask this question: Should the malnourished children of Gujarat eat the roads, electricity and factories which Modi has created?”
so you agree that Modi has at least developed road, electricity, and factories. Can you tell me the name of 2-3 CMs who has done the same on that level. I agree to the point if children are malnourished , it’s shameful…but at the same time you are overlooking the good deeds done by Modi. Modi may be cynical , but he does his job well …at least better than the present lot of shameless, evil , greedy , corrupt bunch. Exceptions will be here.

Sir, I have full respect for you and my views totally align with
yours in certain respect , but I find your take on Modi as utterly flawed, biased and NON-SECULAR. Here’s a LEADER who has shown zeal to develop the nation, to bring down poverty, to counter terrorism etc. and you have defied him asking not to vote for him for the reasons which are not adequate. I think you should have also mentioned an alternative to him in case he is not elected. I hope you get my point.

    Yours Truly,

    1. Agree!. I suspect Katjusab has some hidden agenda pleasing the Sonia brigade. Otherwise, I do not find any logic behind Modi bashing. While I agree with his views of most issues, I beg to differ with him on Modi. He is playing into the hands of you know who?. Let's sincerely hope he will change his outlook, lest he should lose his credibility.

  22. No superman in India can turn our society to the higher state of development overnight. There are numbers of structural constraints for our development. Thus in this imperfect society which is in the phase towards maturity ,we will have no absolutely perfect leader.Rational action here would be choosing less harmful leader ,Considering the case i would say Mr.Modi no less harm.

  23. Letter to shree Markandey Katju
    Dear Shree Markandey Katju,

Thanks for your articles on recent political situations in India. I read your article and your appeal to not cast my franchise for selecting modi. following are my comments.

Sir i would like to say that i also do not agree with your observations on Gujarat riots.
Sir how can you fail to understand that Gujarat has had a history of Riots in 1969, 1985, 1991 and 1993. Riots happened for one reason or the other and so did the 2002 Godhra. The Supreme Court supervised SIT too ruled that Mr Modi did his best to save the lives of Human beings. The provocation which lead to riots was so intense that hundreds of people (read Hindus) had to be shot dead by police to contain the riots. Infact thousand of lives were saved due to strong resolve of Narendra Modi to contain the riots. Paid Media which is responsible for branding Narendra Modi had also to report this incident in which thousands of lives were saved. Sir, Modi as communal is an image planted by media on the directions of its political masters , today we can see through it.

Sir, you went further and compared Narendra Modi with Hitler, Hitler was guided by extreme ideology of "hate towards Jews" however Narendra Modi is guided by ideology of Swami Vivekananda. I am sure a person of your knowledge knows the philosophy of Swami Vivekananda. Inspired with the philosophy and life of Swami Vivekananda, Modi ji left his home in early youth and joined RSS. He has worked hard all these years to raise the standard of people across Gujarat. Shree Modi believes in the ideology of development of all communities and does not indulge in appeasement but empowerment. A change is happening in the Indian politics after so many decades where elections are being fought on development issues rather than cast.

Sir, you yourself said that 90% of Indians are fool and vote on the basis of cast and creed. Modi has changed the trend. Last election in Gujarat was fought on development issues. Today the mass appeal that he has got is due to his development work being recognised by people of India. I have got some muslim friends in Gujarat and they too have joined the chorus of "Modi for PM" thus refuting your observations that Muslim live amongst fear.

You also doubted development happened in Gujarat and compared Gujarat with some other states of country. Sir why did you not compare Gujarat with Germany ? I think it would be fair if we compare current state of Gujarat with what it was 10 years ago. Sir the mass appeal that this leader has got is only due to recognition of the work that he has done. Modi has been selected as CM of Gujarat for the third time consecutively. Is this not recognition of his work.

And voting for the present government which is neck deep in corruption and is epitome of arrogance and inefficiency it would be tantamount to betraying my nation. Sir, i will turn down your request because i am sure if Modi becomes the Prime Minister of India, you will soon be proud of my decision.

    Jai Hind

Thanks for your articles on recent political situations in India. I read your article and your appeal to not cast my franchise for selecting modi. following are my comments.

Anna, Ramdev movements circus shows, says Katju

Few months ago when i read your article in which you compared Anna and Ramdev's anti corruption protests with circus shows i was shocked that someone of your stature could say such things about the movement which has country wide appeal. Almost Everone who was not beneficiary of corruption lead support to the movement.

Baba Ramdev's fast against corruption was violently crushed even before it could start and it was a slap on the face of our constitutional right of freedom of speech and protest. The present Govt which can be easily be given a honorary degree of D.Lit in scams went even further and muzzled voices speaking against it. Sir people like me have no axe to grind but we are really concerned about the state of our country, it hurts when people of your eminence discredit the voice of people and our effort to rebuild India.

Sir voices like yours provide succor to the govt which is being battered from all sides. Govt has now resolved to buy opinion by doling out 100 crore which some of us call as "Twitter NREGA".
So congratulations fellow Indians we will soon have paid social media too in addition to paid media. People will soon be airing views of the govt for money. In addition to it those who speak against corruption CBI investigations are being set up against them as a tool of vendetta as a gift for nationalism.

At times it is necessary to look into the past to understand any event fully. The same is true for the Gujarat riots. The state undoubtedly saw riots after Godhra in which about 1,000 people were killed. Had the same number of people been killed in communal riots in, say, Nagpur city of Maharashtra, it would indeed have been considered as ‘large-scale riots’. This is because, Nagpur region is a region which has hardly seen any communal riots since 1927. But since the riots took place in Gujarat, the events have to be viewed in totality, in view of Gujarat’s history of communal violence.
If one looks at the past history of communal riots in Gujarat, one would understand that the Gujarat riots of March 2002 were absolutely nothing as compared to the past communal riots in the state. The state saw far worse riots in 1969 and 1985. It also saw riots of a larger scale in 1980, 1982, 1990-1991- 1992.
Hindu-Muslim conflicts have been going on for the past 1300-1400 years. But in Gujarat, communal riots between Hindus and Muslims have been going on since as far back as AD 1714, i.e. since the medieval times. This was hundreds of years before the birth of any of the organizations of the Sangh Parivar. The Rashtriya Swayamsevak Sangh (RSS) was founded in 1925, the Bharatiya Jana Sangh was founded in 1952, the Vishwa Hindu Parishad (VHP) in 1964, the Bharatiya Janata Party (BJP) in 1980. Even today, conflicts continue between Muslims and Hindus in India, Muslims and Buddhists in China, Muslims and Christians in Nigeria, in Algeria, in Philippines, in Morocco, in Chechnya etc. It is not the VHP or the Sangh Parivar that is common in all these places.
Hindus and Muslims have clashed in battles, wars and riots since as far back as AD 636 when Arabs invaded Thane (near Mumbai) and were repulsed. This attacks on India started in 636 AD within 14 years of establishment of Islam in AD 622 (beginning of Hijra, first people to become Muslim converted in AD 610, Khadija) and within 4 years of Muhammad’s death in AD 632-the Prophet of Islam. Even before AD 712, the battles were taking place in western kingdoms of India. In AD 712, Mohammad-bin-Qasim invaded Sindh and defeated its king, Raja Dahir. Even before this event, ever since the Muslims attacked Thane in 636 AD, they kept attacking western Indian kingdoms. A brief summary of this is given in the book (“Gujarat Riots: The True Story”) but is not available on this site. For just a brief and cursory (very very brief, and very very cursory) history of Islam in India, see this.
    http://www.islaminindia.org/category/islam-in-india-history
The great revolutionary and freedom fighter, Swatantryaveer Savarkar wrote in his book, ‘Saha Soneri Pane’ (Six golden pages of Indian history) that the Hindus kept on defeating and repulsing invading Muslims at India’s western borders for as many as 300 years at a stretch, i.e. from 712 AD to 1001 AD, when Mahmud of Ghazni invaded India.

Riots are nothing new to India. For the past 125 years, since about 1880 riots have frequently occurred in all parts of India. But among all the Indian states, Gujarat was by far the most communally sensitive state.
If we take the history of Ahmedabad for last five centuries, the city was ruled by the Muslims and the Mughals for about 340 years the rest by Marathas & the British. Coming to the incidents of communal riots during this era of five centuries, the major incidences are:
    (1) The 1714 Holi riots:
A Hindu named Hari Ram while celebrating Holi with his friends at his residence unintentionally sprinkled ‘Gulal’ a red powder on one Muslim, and the casual frolic was strongly protested by the Muslims. A mob got assembled near Jumma Masjid under the leadership of Sunni Bohra Mullah Abdul Aziz. The Afghan soldiers of the Muslim viceroy also joined the mob seeing the situation. A Kazi interfered for cooling down the angry mob. But the mob set on fire the house of this Kazi. The rioters thereafter looted the shops of Hindu Mohalla, Shops and set their houses to fire. The rioters could be controlled only by armed guards of a Hindu, Kapurchand Bhanshali.
    (2) The 1715 communal riot:
The 1715 communal riots were due to looting of shops of the Hindus by the Muslim soldiers. The riot came to an end with replacement of Muslim viceroy Daudkhan.
    (3) The 1716 Id riots:
Consequently during the third year also, communal disturbances broke out during Id in 1716.
The Bohra community, a Muslim sect, gathered cows and buffaloes for Id celebration. A Muslim Havaldar just out of pity released one of such gathered cows. The Muslim protested before the Kazi Khairullakhan seeing no outcome to their expectation, the Muslims resorted to riots arson and mass looting of Hindu establishments. The situation could come to normalcy with Hindu viceroy Ajitsinh’s concerted efforts.
    (4) The 1750 temple demolition:
The 1750 riots by Muslims were provoked simply with an excuse that their Namaz was being disturbed due to noise of ringing of bell in an adjoining temple. The Muslims while returning from the Masjid after Namaz totally destroyed the temple and thus wounded the Hindu sentiments.
    (5) The September 1927 Ahmedabad riots:

Muslim prayer in a mosque and Hindu song in a temple were the apparent cause of conflict.
    (6) The 1941 riots:
Communal disturbances broke out on 18th April 1941. The Muslims diverted to Muslim League programmes after the incidence of these riots.
    (7) The 1946 Rath Yatra riots:
1st July 1946 was a Rath Yatra day. Rath Yatra as usual was passing through Shaher Kotda police station area, on this auspicious day. There took a hot exchange between a Hindu Akhada man and a Muslim watching the procession. The incidence turned into breaking out of communal violence, viz. arson, cudgelling, stone throwing, stabbing etc. There was also a police firing and curfew was finally imposed to control the situation.
    (8) The 1953 Ahmedabad riots:

The Ganapati festival and Moharram were the occasions of riots in the city of Ahmedabad
    (9) The 1965 Sikh incidence:
The 1965 riots were resulted out of the murder of two Sikh rickshaw drivers by some Muslims. The aggrieved Sikhs took out funeral procession of both these dead bodies. The situation got disturbed at Delhi Darwaja and got converted into a communal riot soon.
    (10) The 1969 historic communal riots:
It was 18th September 1969, the last day of Urs. The violence crept up in the evening time on the ground that Jagannath Mandir cows going back to temple premises disturbed the Urs. It may be mentioned that movement of cows was a daily routine irrespective of Urs celebration taking place simultaneously. A hot discussion took place that provoked communal tension with a series of violent incidences killing, linking, and soon in various parts of the city.
The riots of 1969 were biggest of its type in Independent India having taken lives of thousands of persons.

    1. Why these riots?. One can find the answer in the following. Poor muslims are misled by the clergy on principles of Jihad, with the promise of all good things in life as you can see from the following translation of Jihad song. Education is the only way one can change the mindset and bring them in to the mainstream.

The Delights of Paradise. – The JIHAD.

“THE PLEASURES of wealth or of family are not equal to an atom of celestial happiness. Our most venerable Prophet has said that those who die in battle can see the houris who will come to witness the fight. There is nothing in this world to compare with the beauty of the houris. The splendor of the sun, of the moon, and of the lightning is darkness compared with the beauty of their hair which hangs over their shoulders. Their cheeks, eyes, face, eyebrows, forehead, head are incomparably lovely. Their mouths are like corals of gold, their teeth like the seeds of the thali flowers. It is not possible for the minds to conceive the loveliness of their breasts and shoulders. If they spit in the sea, the salt water becomes as sweet as honey, as fragrant as attar. If they were to come down to this earth, and smite, the sun, the moon and the stars would be eclipsed. Mortals would die if they but heard the music of their voices. When they wear red silk bordered with green lace of seventy folds, their skins, muscles and bones can be seen through. Such is the splendor of their body. If they clap their hands, the clash of their jewels will be heard at a distance of 50 years’ journey. They clap their hands, dance and sing, as they come like the swans to the battle-field. If a human being were to see their beauty, their dance, or their smile he would die on the spot. Gently they touch the wounds of those who die in battle, they rub away the blood and cure the pain, they kiss and embrace the martyrs, give them to drink the sweet water of heaven and gratify their every wish. A horse caparisoned with precious stones will be brought and a voice will say :- Let my men mount : let them dance with the celestial houris. Then the celestial coverings will be placed on heir heads, they will mount the beautiful horse which will dance and leap and take them to heaven, where they will live in unbounded joy…………………………………………………………

The above is a translation of a part of a song composed in sacred memory of the 47 martyrs who, in the first decade of the last century fell fighting in defense of a mosque against the retainers of Para Nambi , a landlord of Malappuram; the Malappuram nercha is celebrated annually in their memory and every Moplah carries with him whenever possible a copy of the song, a portion of which is quoted above. This is also the first recorded Moplah outbreak during the British supremacy.

Among others were the 1985 bloody riots in Gujarat, the 1980, 1982 riots in Ahmedabad and Godhra, the 1990 and 1992 riots.
What follows is a write up by Hemant Babu published in Himal magazine dated 6 July 2003 reproduced by www.countercurrents.org :
… “A sign of this normalcy is the number of incidents of communal violence in the state as recorded officially. Judicial commissions of inquiry, the Justice Reddy Commission and the Justice VS Dave Commission, were instituted after two major riots, of 1969 and 1985 respectively. Both commissions referred in some detail to Gujarat’s history of communal violence. The Justice Dave Commission traced the history of communal violence in Ahmedabad as far back as 1714 when a bloody riot was sparked off during the Holi celebrations. The city then was still under Mughal control. Subsequent riots broke out in 1715, 1716 and 1750…
Hindu-Muslim violence continued in the centuries that followed, with the pace and intensity picking up in the second half of the twentieth century. When communal riots broke out in 1941, curfew had to be imposed for over two-and-a-half months. The Justice Reddy Commission identified as many as 2938 instances of communal violence in the state between 1960 and 1969, that is, an average of approximately three riots every four days during this ten-year period…
During this period, riots began to spread over a much wider geographical area of the sate, affecting towns like Veraval, Junagadh, Patan, Godhra, Palanpur, Anjar, Dalkhania, Kodinar and Deesa, all of which have been hit by the ongoing violence.
… But violence of a different, more systematic and sustained order was inaugurated in 1969. The Hindu-Muslim riots of that year mark a major break with the hitherto prevalent pattern of steady if unspectacular social conflict. More than two years of hectic Muslim and Hindu fundamentalist activity preceded the outbreak of these riots. Communal violence in the state acquired a more organised form against the backdrop of the India-Pakistan war of 1965.

    ReplyDelete
  39. contd.....4
A riot of this magnitude, unprecedented in both scale and duration, had a foundational significance for the politics of the state and the techniques of mobilisation and orchestration that increasingly came into use. The discrete and scattered violence of the preceding period can be presumed to be manifestations of everyday class, caste and community struggles arising from socio-economic conflicts of a more or less local nature. To that extent, their individual histories and repercussions were confined to the respective localities of incidence. The 1969 riots had the critical mass that lent it state- and nation-wide visibility and gave it a prominent place in the historical inventory of community grievances. This riot could now be invoked at will, not just in Gujarat but wherever else tension had to be engineered. In effect, this was the first explicit politicisation of both communalism and public violence in the state.
Most importantly, the riots of 1969 took Gujarati society past the psychological threshold of normally tolerable public violence, and this not just of the communal variety. Once the barrier to the use of violence in inter-party conflicts was crossed, its repeated use acquired a tacit legitimacy as the social conscience became gradually more immune to the incremental doses of it that the polity administered
… The BJP’s active influence on the 1985 agitation explains many of its more curious features. The riots began on 19 March, the day after the newly elected Congress government assumed office, and was directed against a policy measure declared more than two months prior. In January, the Congress government had announced an increase in the quota of jobs in government and seats in public educational institutions reserved for backward castes. The riots lasted six months, much after the policy had been revoked by the government. … South Gujarat, which had previously been unaffected, now found itself on the riot map of the state. The social base of the violence expanded to include gangsters, bootleggers and professional killers. Various reports of the period quote doctors who described the stab wounds they attended to as the work of trained hands. The agitation finally degenerated to a point where sections of the state constabulary abandoned their uniforms and relinquished their responsibilities to join the riots.
…Gujarat again witnessed riots in 1992 when the disputed Babri Masjid at Ayodhya was razed to the ground a few hours after kar sevaks stormed the monument. Surat experienced intermittent disturbances over a six-month period. In 1993, more riots followed, after the blasts in Bombay, allegedly masterminded by the Muslim underworld. Perhaps these riots were attempts at forging a Hindu unity that, on the face of it, seemed impossible. Whatever the intention, there is no denying that the rath yatra precipitated a political crisis in which the existing intra- and inter-party equations began to break down. And, there is no getting away from the fact that, though not uniformly successful across India, the BJP from the 1991 general elections has secured more than 50 percent of the votes cast in the state. Remarkably, for three years following its assumption of office in Gujarat in 1995, the state was free from communal riots. The BJP was clearly living up to its boast of ensuring a riot-free administration, prompting critics to cite this as proof of the party’s monopoly of organised public violence. At any rate, this peaceful interim was part of the established pattern of violence erupting and subsiding according to the clearly discernable designs of politics. The inference, therefore, that violence had become a crucial raw material of electoral politics controlled by a cartel is unavoidable…”

  40. A staunch anti-BJP man wrote this article. The website that reproduced it; www.countercurrents.org is one of the most anti-BJP ones on the entire Internet. Yet, even in its horribly anti-Sangh Parivar article, the writer discloses some very important things. And one of them is Gujarat’s bloody history of communal violence.
We already have seen the bloody history of Godhra town of engineering riots since 1927-28. The following is the report of the Vishwa Sanwad Kendra on the comparisons between the 1969, 1985 and the 2002 riots:
“Comparative analysis of Government response to communal riots during 1969, 1985 and 2002
The communal tension in the state of Gujarat is not an unknown phenomenon. Prior to the present situation, all communal disturbances before Godhra incident, two major communal incidents took place in 1969 and 1985. To inquire into the factors leading to the communal violence in 1969 and 1985, the State Government appointed Judicial Commission to thoroughly inquire into all the aspects leading to communal violence and the response of the state Administration. Both the Commissions have come to specific conclusions and while coming to the conclusion they have come to specific conclusions and while coming to the conclusion they have also made specific observations.
On September 18, 1969, a major communal riot broke out in AhmedabadCity and subsequently spread in the other districts of the State. The incident which sparked the communal violence took place on 18th September 1969 at 3.45 pm in Ahmedabad near LordJagannathTemple. Hon. Justice Jagmohan Reddy inquired into the violence which broke out during the said communal disturbances. After 1969, a major agitation and communal riots broke out in 1985. Justice Dave Commission inquired into the incidents which took place during the course of anti-reservation agitation and also communal disturbances during February 1985 to July 1985.

  41. The response of the State Government in the earlier incidents and the recent incident brings to the fore certain important facts which are as under:
In 1969, the incident of violence reported on 18th September at 3.45 pm. The army was pressed into service on 21st September 1969 at 16.30 pm in limited areas (three Police Station only) while army was deployed in the entire city on 22nd September 1969 at 18.00 hrs. In 1985, the riot broke out on 15/4/85 and the army was requisitioned on 16/4/85. By then, 177 deaths had already been reported. Compared to this, the army was requisitioned on the same day, i.e. on 28th February itself. It is very relevant to note that unlike the earlier occasions, army at this point of time is deployed on the border. Therefore, the deployment of army was difficult at a short notice. However, Hon. Chief Minister impressed upon the Hon. Prime Minister and the Defence Minister to deploy the army forthwith in view of the prevailing condition in the State. The Central Government also reacted very fast and army was airlifted to Ahmedabad the same night. The army was in action from next day of the incident, having completed all the formalities of nominating Executive Magistrates, allocation of vehicles etc.

  42. contd....
The incident in 1969 occurred on 18th September 1969 but the situation was out of control, even on the 5th and 6th day. The violation incidents continued to be reported even after the 6th day. The disturbances in 1985 were spread over a period of five months from February 1985 to July 1985. However, in the present case, the situation has been brought under control within three to four days only.

Internet, television ,3D paraphernalia has always remained one man like cinema superstar show. The supporter of Modi are very pleased and they think that Modi has given Gujarat a global platform!Modi announced 3D address which was cost 100 crore show.He is playing with sentiment of Gujarat not real development of Gujarat. He has been creating Modi hysteria only as cinema star.
Modi only pays attention to some industries not others social development. Others side have been neglected
more than others state in India. Only dream development stories have been published by modern media and always trying to hide real development, social justice, human rights issue ,malnutrition, criminal activities, situation of women, freedom of speech, insecurity of the minorities , poverty, the situation of farmers, labour, back ward classes, minorities and dalit. There are a lot of basic need problems in Gujarat like drinking water, unemployment has been bypass intentionally by throwing only propaganda and advertisement. Modi pays attention only his carrier and dream. He never think about common peoples of Gujarat. This is the new style politics only dictatorship Moditwa propaganda magic dream dirty politics. Modi ia a Criminal.corrupted ,communal CM of Gujarat!

    1. Remove the 'Justice' tag from your name.
    2. Change the name of the blog.

I don't think it is wise to question the intelligence of 60 million people of Gujarat by rubbishing Modi. People are not that foolish to elect a person for the third time if he is such a despot.

  49. Hi,

I totally agree with Justice Katju's words. No secularists, no real democrat, no humanitarian, no self-respecting gentleman and nobody who respect others right to live and lead a decent life will support Mr. Modi. He is being supported not by the youths of India, but some fanatics who think that all Muslims are bad. The Hindutva ideology propagated by the RSS and all are nothing but lies. Mostly, you guys can see South Indians are not that much interested in these things, except some power hungry guys in Karnataka and we can very well see what happens there. Modi is not an answer to India. What we need is a secular democrat, but alas, we can't see any such person here.

also get your understanding clear in governance and sanctity of any public post. Ethically you cannot mention any political views when you are on a public chair

Also look at the arrogance of this man who is calling his own country men "so called educated class". does this kind of a language suit him as head of press council of india.

You are abusing youth and the heart of this country middle class. Why... may I ask you? Is it that we don't have freedom to think that what is wrong and what is right? After seeing six decades of misrule by a family, people of this country are tired and want to take breadth in the fresh air. Did you ever shouted on UPA govt for their loot of this country? Can I expect a next article from you on congress PM? You were an important part of Indian judiciary and so you can comment on it. If he is not found guilty in court, why make a fuss about it. Are you trying to say our Indian judiciary is inefficient ?
"This was the policy of the great Emperor Akbar, which was followed by our Founding Fathers (Pandit Nehru and his colleagues) who gave us a secular Constitution."
Secular constitution to India was given by Dr. Ambedkar and his committee, not Nehru. Calling Pt. Nehru founding father does not seems legit(you can call Mr. Jinnah for Pakistan)but you can claim him as founding father of patriarchal politics in India.
The case of Ehsan Jafri that you have used as example it only indicates that police commissioner could have known it but how do you see CM of state in it. I don't know law, neither i claim to be a better scholar than you but you have not made any point in this.
People of every religion are in various economical classes. If development of Gujarat is happening, all the people will be benefited with it.

Modi talks about development politics which most of the politician are afraid to bring in. Even the so called youth icon of UPA, Rahul Gandhi has not talked about development politics.

If you are really interested to show the truth to people of India as a person in chair of PTI, write down a article on the works of UPA-2, big Scams in recent times, Mr. Rahul Gandhi's work(as he is also the next PM candidate from Congress).
He is in second tenure as MP but has not taken any position of responsibility in govt. Why don't you write something about him to enlighten the people of India, 90% of which you declared idiot.

Please do not indulge into one sided politics. You must say the truth but the complete truth.

  74. Reading the comments it seems there is a campaign underway by hired recruits (read goons/stooges) to undermine the thoughts put across in this Article. Sadly the goons commenting should have been properly trained both in Governance, History of the Riots and of course English to efficiently undermine Justice Katju's remarks. Because the comments above fail to drive educated informed opinions their way. I also fail to understand how they are qualified to Contradict a former Chief Justice of the Nation and that too using diction and a tone that can be equated to women fighting in a chawl over the single tap that they have.

There are few cardinal principles and basic etiquettes , which ought to be followed during any democratic debate . YOU MUST NOT INSULT A PERSON EVEN IF HE/SHE IS NOT PROFICIENT IN ENGLISH . ( in India hardly ten precent population can speak/write English ) .This sentence reflects your general awareness - " former Chief Justice of the Nation " . Justice Kajtu was never a CHEIF JUSTICE OF INDIA . he is a former judge of supreme court . get your facts correct . AT THE SAME TIME DONT USE PHRASES LIKE " women fighting in a chawl " . this reflected ur misogynist / chauvinist and stereotyping leanings . YOU LOSE ANY MORAL GROUND TO CRITICISE OTHERS WHEN YOU URSELF INDULGE IN SUCH A LOOSE TALK . LASTLY EVEN A NOBEL LAURATE LIKE V S NAIPAUL IS NOT SACROSANCT FROM CRITICISM . EVEN GLOBAL GIANTS LIKE SALMAN RUSHDIE / ASHISH NANDY HAVE BEEN SNUBBED BY COURTS . HERE IN THIS ARTICLE RESPECTED JUSTICE KATJU HAS CALLED GUJRATI MUSLIMS AS DEAD/MEEK/IMPOTENT/VOICELESS ( graveyard silence ) . HE HAS LABELLED ALL GUJRATI HINDUS AS RELIGIOUS FANATICS ( sweeping generalization extrapolated from just one man he met in plane ) . LASTLY HE CUNNINGLY/SHEEPISHLY FAILED TO MENTION THE 1984 DELHI ANTI SIKH RIOTS AND RAJIV GANDHI's STATEMENT JUSTIFYING THE VIOLENCE .It seemed easy for [former Prime Minister] Rajiv Gandhi to say, ‘When a giant tree falls, the earth below shakes.’ Our trees fell and we can still feel the tremors.” -Victim whose husband was burned alive during the pogroms.
instead of replying , he chose to maintain " silence of graveyard " if i can borrow his phrase . HE HAS RAISED DOUBTS OVER INTEGRITY OF SUPREME COURT OF INDIA AS WELL AS SIT CHIEF R K RAGHVAN . EARLIER HE HAS CALLED 90% OF INDIANS AS FOOLS / IDIOTS AND 80 % INDIANS AS COMMUNAL . I WONDER HOW IS HE ARRIVING AT SUCH ABSOLUTE % FIGURES . WHAT IS THE USE OF STATISTICAL TOOLS THEN ? NSSO ? No wonder loose cannon DigVijay immediately came for your defence! Since you seem to have so much time in hand for Modi-bashing, please take time to go through Modi's speech in SRCC Delhi; he spoke ONLY on development, animal husbandry, reaching farm-produce to market with least damage etc. I know it is inconvenient for Sonia worshippers like you to understand the language of development! 80. I have been a great fan of Katju's writing, and never miss an article written by him esp. in "The Hindu", This article is nevertheless one well written article, However unfortunately Katju hasn't really used the facts correctly to convey his message. Undoubtedly, the facts are true to the last word, but I have a big problem with how these facts have been used and many facts that have not been used for this article.

There are two ways to arrive at a conclusive statement such as this: "Muslims in Gujarat are terrorized and afraid..." – Statistical or Empirical

    Statistical
After consulting with one Gujarati businessman on a plane (sample size of 1) and arriving with this statement is a not even close to a joke. I do not think this was the method of arriving at the conclusion. I do not see any mention of other surveys in the article to get people’s perception, so it cannot be statistical evidence.

Empirical evidence based on prior and current Facts (comparing Apple yesterday with apple today)
If this was the method adopted, Katju mentions about the Godhra massacre (2002), comparing it with the 1938 Nazi Holocaust. Also surprisingly dedicating a whole paragraph for Ehsan Jafri (before calling the matter a sub judice). However except for a factual reference (killings of 59 Hindus in a train) there has been no mention of what caused these riots. The article cleverly manoeuvres to Ramachandra Guha’s statistical data of today’s Gujarat. Yes these figures (48% Guajarati children are malnourished, 57% poverty rate in tribal areas etc) can fool a reader to question the administration of Gujarat. However, what is cleverly concealed is the fact that how Gujarat has been growing rapidly than any of the other states in India and how these malnutrition, poverty figures, have been reducing at a faster pace than rest of the other states in India. Gujarat is definitely not the best developed state in India, it is the far most the quickest developing state in India. I am not convinced with this comparison where apples are either being compared with oranges, or with nothing at all.

So if both these methods are not being used to arrive at the conclusion, then it surely points to opinionated article and hence has been rightly chosen by Hindu as an Op-Ed piece.

So, just like Katju can express his opinion, I believe all the rest of the Indian Citizens have the same right to express their opinions, just that it may not make this amount of noise at the parliament or in the media.

Even i am an ardent reader of Justice Katju. i liked many of his bold opinions. does he mean that a common man would not get any benefit from an industry or business? did he forget what industrial revolution brought to the west? surviving in political arena and at the same time doing good for common man need lot of skill. One positive point in his election is that Modi did not treat his voters as beggars,as in the southern states, by throwing free TVs,laptops and a score of unviabe cheap schemes. our choices are very narrow. Let Justice Katju, a great thinker, do more balanced thinking.

    3. Ramgopal....I cleaned up my earlier comment....
you have asked a good question...essentially hinting at a term coined long term ago when the "free enterprise system" was on the rise (in the time of Thatcher and Reagan)...the term was "trickle down economics"....which basically means if there is overall GDP growth then the effects would trickle down to the masses....
there is a lot of debate on that and there is a growing sentiment (especially in developed countries like US, UK( that it doesn't work)....trickle down economics has been tried before as well albeit with a different name (horse and sparrow theory)...
Before I point you in the direction to find out why it doesn't work, it is necessary that we define what we mean when use the term "common man"....This is a very difficult question....it is difficult because there is no straight answer for that even in statistics...you gotta look at the data distribution and then decide....it could be average, median or even modal value....however in India's case, I suspect (because we know a huge population is still agrarian and below or close to pverty line), common men/ women can't be people living in Metros or even towns...it can't be people using the internet as well....I like Naom Chomsky's quote in this regard which may seem counterintutive but bear with me on this one -
"The internet is an elite organization; most of the population of the world has never even made a phone call."
Think about it....does it make sense to you?.....how would you validate that statement....what data would you look at?
I suspect you would find that the common man in India doesnt have access to internet, he doesnt own shops...he doesnt probably even have a bicycle...
If that is the common man we are talking about then lets ask what should be the real measure of progress of trickle down economics...
The easiest solutions seems looking at real wages - real wages means taking nominal wages and adjusting it for inflation over time...but should we stop there?....if overall wages in India increase by 20% and inflation is 10% then surely Real wage calculation would say we are better off....as we have grown wages faster than inflation...hence we can afford more things and hence we are better off....
Lets go a little deeper now....what if the wage increase was disproportionately distributed.....lets say top 40% got 18% and bottom 60% got 2%....now if inflation for each segment is the same then what happens to the bottom 60%...are they better off?....what if the distribution was 24% and -6%?....just hypothising but I want to elucidate that we need to look for the right metric and be sure what it means....also on inflation - does it tell the whole story?....is the basket of goods universal?....perhaps somethings are fundamental than others....for instance if I am in the bottom 20% - I really wouldnt care how cheaper laptops and cellphones are getting (even though it maybe in the basket calculation for inflation)...What I care about is food, water, sanitation, health care, education and safety.....we all know food inflation is higher than overall inflation...perhaps it hurts the poor disproportionately?....all other aspects are also worth exploring (e.g., water, sanitation)....I would wager that poor is disproportionately hurt on all of those as well....in short...poor makes less and pays more for the same quality of life.....lets not go by my word for it.....lets get the data....and before that lets really define the common man....

    4. ..................What I care about is food, water, sanitation, health care, education and safety................................!!. Yes, very rightly said. Thanks.

  81. After going through the article of Justice Markandey katju in his blog , the present chairman of the Press council of India, on development of Gujrat and controversial role of Narendra Modi. This article of Justice katju is in fact a sample of harsh criticism on development of Gujrat and role of its chief minister. Before making any discussion on his article, or coming to any conclusion, let me elucidate what the criticism is all about and what are its purposes. Let me also throw some light on the journey of changing meanings of criticism since its appearance in 14th century to the 21st century, so that it may become easier for us to construe the intention of Justice katju in writing the article and judging its implications.

    ReplyDelete
  82. Now, in order to understand the implications of this article written by Justice Katju, it is also mandatory to have some knowledge about purpose of 'criticism'. The purpose of criticism is not a "malicious accusation" rather it makes effort to improve the condition of the problems for which somebody or something is being criticized. It should have positive intentions, not mala fide. There is a very popular and basic rule about criticism known as "rule-of-thumb" which usually psychologists recommend for 'critics' while criticizing. According to this rule, "Respect the individual, focus the criticism on the behavior that needs changing - on what people actually do or actually say." The basic principle behind this rule is that if individuals are attacked for their personal characteristics (for "who they are") they can't do much with that , except to fight it off , which in fact , is happening in this case that is Modi and his supporters or well-wishers are reacting strongly on Katju's such comments. What a personal attack is likely to achieve, is that the individuals feel rejected; not accepted or liked; unfairly treated; degraded; dishonored; or humiliated. Therefore they are much less likely to consider the criticism seriously either, or do something about it, simply and only because they feel mistreated by the 'critic'.

    ReplyDelete
  83. So, the crux of the above rule is that as soon as there is an attack on personal characteristics of an individual, the whole purpose of the 'criticism' vanishes at that very point of time. The same thing has happened in case of Justice Katju's criticism about Narendra Modi. Inversely, if an individual is respected with a bit of humour , and due credit is given to his/her positive intentions as human beings, it is vastly more likely that the criticism will be understood, and taken seriously. Unfortunately, this is the point where "critique" of Justice Katju is lagging behind.
A good criticism is an attempt to improve the condition or to find a pragmatic solution of the problems by evaluating the ability of an individual, its hidden potential, action, or idea. A good critic should present alternative perspective or suggestions about the problem he/she is discussing, both of which facilitate improvement. But, the criticism of Justice Katju doesn't put forth any idea, any alternative perspective, or any pragmatic solution of the problems he has talked about. Being seated on a quasi-judicial post what Justice Katju has stated may only be considered "Old wine in new bottle" or a different narrator of the same story.

    ReplyDelete
  84. In continuation of my previous comment, with all due respects Mr. Katju I think you should focus on current issues that are affecting the general public starting with the scandals of 2G to the VVIP helicopters where Billions of dollars are sitting in one man's or (more correctly) a woman's pocket (don't want to be a sexist at this point).

Leave the choice of who should lead the campaign to the party and the politicians and their patrons.

Or else please take a side and patronize a political party..

Quite disappointed with this article, I am sure you would have lost a fair portion of readership due to this.

  85. In last Para of his article, he has appealed to Indian people, not to make the same mistake as Germans made in 1933 which indirectly means not to prefer Narendra Modi as the next prime minister of India. But, what should people do? whom they should elect? who is perfect?, these are some questions which remained unanswered in his article. He ended his article, leaving common masses in a state of dilemma or a situation of be wilderness. People know adequately the things he has repeated. What he was supposed to do was to come with the solution of this problem that is about the issue of leading the nation which was the chief agenda of his article but instead of that he too has come with the problem itself, making people mourn about the pathetic condition of the country again, who are already witnessing the worst condition of the country due to "Dirty Politics".
Thus the final conclusion is that, the article of Justice Katju was not a "Good Criticism" , as it mentioned only about the problems and didn't give any explanatory remarks about its solution, due to which it seems to be only a "Sort of accusation" rather than a good standard of criticism.

  86. The most disturbing facts which Mr. katju has underlined in his article is the "modern" youth... In other words, this kind of Modi glorification was expected from certain people, but to see the so called progressive Indian youth treading the same path is heartbreaking to say the least...

As far as Mr. Katju is concerned, his only motive behind all of his articles is to develop harmony between Hindu and Muslims, and looking at the present day scenario, highlighting Muslims and Hindu as right and left part of a single body is needed. Katju has nowhere favored Congress, except for the reason of secularism, but has brought the flaws of Modi-rule.

I request Mr. Katju to understand that giving the nation in the hands of a capitalist (i.e. CEO) is better than an idiot prince, whose father and previous generations have exploited the nation for centuries.

    2. Was Congress and Rajiv Gandhi is not responsible for that riots ?
    3. Can you please make us clear about Kamal Nath’s Involvement In “November 1984 Sikh Genocide” ?
4.You are saying that A Chief Minister is responsible for RIOTS in his state than Why Rajeev Gandhi is not responsible for SIKHS RIOTS ?
Whatever I know is from- http://en.wikipedia.org/wiki/1984_anti-Sikh_riots in which clearly mentioned "CBI is of the opinion that the acts of violence were well organized with support from the then Delhi police officials and the central government headed by Indira Gandhi's son, Rajiv Gandhi.[6] Rajiv a hindu extremist and anti-sikh congress member, who was sworn in as the Prime Minister after his mother's death, when asked about the riots said "when a big tree falls, the earth shakes".
Can you please make us clear about all these RIOTS.
That all things I don't know because I was not born.
    Now What I know-
    1. Can you please explain 2G spectrum scam(FYI- http://en.wikipedia.org/wiki/2G_spectrum_scam), Who is responsible for that. Indian Prime Minister is not responsible?? Can I get a article or remark from you ?
    2. Adarsh Society Scam, Can I get a remark from you ?
    3. Commonwealth Scam, Can I get a remark from you ?
    4. When Baba Ramdev was protesting in Ram lila maidaan, at 2 am night Delhi police brutally beats women and children, (in which one women died)than Home minister of this country is not responsible, he is not a killer ?
    5. When Foreign Minister of Pakistan Hina Rabbani says that they are far better than Indian Government because they never beaten women at night in the capital of country, did you ever feel shame on her statement ???
    6. Can you please explain the Why Lokpal bill is not passed ??
Apart from that lets back on topic, in 2002 when RIOTS was started,Narendra Modi suddenly send fax to MP, Maharashtra government a FAX that they required more police than why Mr. Digvijay Singh and other congress Chief Minister were able to send their police force, are they really want to restrict the riots than why they sit keep silent when Modi asked for more force ??? (FYI- http://www.youtube.com/watch?v=-ruZLBeelhs ),
Can you please write something on this, because youth who born in 90ies have not much knowledge about all that ??? If you can than we will able to vote the correct candidate.

  108. Dear Sir,

You have talked about post-Godhra violence and put the blame on the state government and the Hindus of the state.

But, I fail to understand, why you are talking only about Gujarat?
Riots have happened many times before. For example, the riots that happened in 1984 after the murder of Smt Indira Gandhi is famous. So, why you are not talking about it and telling that Congress is responsible for killing of Sikhs and hence Congress is communal?

Nearly a million Kashmiris were driven out of Kashmir in 1990 and thousands got killed. But, you are not talking about that violence.

So, are you not partial and prejudiced in your analysis?
Why should people agree with your views!?

    Regards,
    Narendra

  109. Dear Sir,

You are trying to tell that there was no country called India and it was created by Nehru (founding fathers)!
So, when Alexander told that "I want to conquer India" to his teacher Aristotle, which India was he referring to?
When Columbus, Vasco Da Gama and other sailors set out to find India, which India were they searching for?

    Regards,
    Narendra

  110. This is probably the biggest blunder that MK has so far committed in print. The stupid analogy he draws seems to have been totally lost in his prejudiced head and thoughts. The closest that comes to the Nazi reaction he quotes for one single individual being killed is not Gujarat but Indira Gandhi.

Because her Sikh guards killed IndiraG, thousands of Sikhs were brutally killed, homes burnt and families destroyed. I suppose Katju probably thinks the killing of one individual (IndiraG) caused a “spontaneous” reaction but burning and killing of 59 people in a train brought about a “planned” reaction. Sheer nonsense as his own example proves. If we apply his Nazi logic at all then it is the IndiraG murder that caused the Nazi reaction he talks about.

And no, the founding fathers (if they can be called that for an ancient country) didn’t insert the word “secular” into the constitution. It was inserted by IndiraG during Emergency. The secularism practiced by Nehru’s party is now prominent as pseudo-secularism.

Great roads in Gujarat: Okay, but what about malnutrition?
Great infrastructure in Gujarat: Okay, but what about malnutrition?
24X7 Power supply: Okay, but what about malnutrition?
Water in Sabarmati: Okay, but what about malnutrition?
Special incentives for girls: Okay, okay, but what about malnutrition?
Crores of investments: Yeah alright, but what about malnutrition?
Women can move safely: Who cares? What about malnutrition?
Modi is not corrupt & incorruptible: Corruption is normal, what about malnutrition?
Sex-determination tests banned: Minor issue, what about malnutrition?
GDP growth over national average: Fine, fine, what about malnutrition?
DoubleDigit Agri growth for years: See the “larger” picture, what about malnutrition?

So, now that everything else has failed the last straw to clutch is the magic word called malnutrition. And I promise you, you will hear this word over and over again in the next one year.

  111. Mr. Katju was not even fit to be Teacher, keep aside Chief Justice of India

Excerpts from Mr. Katju's Article in Hindu
"The level of intellect of many teachers is low, because many of them have not been appointed on merit but on extraneous considerations. To give an example, when I was a judge of Allahabad High Court I had a case relating to a service matter of a mathematics lecturer in a university in Uttar Pradesh.

Since the teacher was present in court I asked him how much one divided by zero is equal to.

    He replied, “Infinity.”

I told him that his answer was incorrect, and it was evident that he was not even fit to be a teacher in an intermediate college. I wondered how had he become a university lecturer (In mathematics it is impermissible to divide by zero. Hence anything divided by zero is known as an indeterminate number, not infinity)."

Not surprisingly, two wise readers of The Hindu corrected the Thief Justice of India

He was wrong and the lecturer was right because any non-zero number divided by zero is infinity. It is zero divided by zero that is indeterminate.

While I can understand the plight of the poor lecturer who did not have the courage to correct the judge hearing his case. Poor Lecturer.

    1. Dude...get your fundamentals straight....indeed a finite number divided by zero is indeterminate and not infinity.....even a wiki search would give you that:

      http://en.wikipedia.org/wiki/Division_by_zero

If you really wish to understand the deepness entailed in infinity I suggest you read the following book:

      http://www.flipkart.com/search-books?query=One+Two+Three+.+.+.+Infinity%3A+Facts+and+Speculations+of+Science&from=all&searchGroup=all&autosuggest[as]=off&autosuggest[as-submittype]=entered&autosuggest[as-grouprank]=0&autosuggest[as-overallrank]=0&autosuggest[orig-query]=&autosuggest[as-shown]=off&selmitem=All+Categories&otracker=start&_l=kHKbQQIaxhdVidRxlMIbvQ--&_r=RsuiHvNUWzIGQmMYN5OGLg--&ref=16e7be94-a1e7-4cc6-9fa2-bb8556e0494a

If you want to start from the basics perhaps you can listen to some Khan Academy lectures on youtube....no dearth of knowledge if you are open to go deep and really understand (rather than relying on half baked knowledge)....

  112. Sir
I would like to seriously ask you, that as a judge, you should not be discriminant.

You should also write about the 1984 sikh riots in which more than 3000 innocent sikhs were killed brutally by pure Congress people. Still no major convictions have been made.
Write about 2010 Assam riots & more than 100 riots in UP under Akhilesh Yadav's rule.
Why haven't you wrote about that?
And all other riots since 1947 under Congress rule.
Does only the most developing states in India which are under NDA your target?
Can you write about a single non-NDA state as an ideal developing state like Bihar & Gujarat?
Write about the brilliant decline in corruption in Gujarat,Sabarmati river, 72% jobs in 2011 accounted from Gujarat alone,Best citizen security & many such reasons. But no,you won't write about it. Then how'll you get popularity.

Unlike Gujarat in which many convicts have been given lifelong imprisonment. This is the only of its kind judgement since 1947.
Considering the fact, none of the adjacent states provided Gujarat with extra forces when asked to. These include Maharashtra,Rajasthan & MP.
All Congress ruled states at that time.

You as a Kashmiri Pandit acting like this is really strange. You should've firstly written on Kashmir's situation,AFSPA,extremists,Lal Chowk & the wash away of Pandits from the valley.
But this doesn't bother you. Such tolerant person like you is bothered by Modi? Strange.
Is this your fear from Modi?
Or the honesty that you are showing to the job given in PCI by the current govt of Congress?
Such poor attempts by the govt won't work Modi storm.
Katju people are not stupid. Honor SC Judgement. Don't try to act over smart.

  114. Some states in India are better in one category and some in other. So quoting malnutrition wont be wise. Said that Modi was in the power when the 2002 riots took place, according to the investigation he is not responsible, that is almost equivalent to a verdict\clean chit.

BUT ( read it in CAPS ) Modi could have certainly prevented the violence, he being a CM of the state should had stopped it. It was a failure on his part and so he is morally responsible to it. Please please don't say it was a spontaneous act, a state govt has immense ( abundant ! ) power to control the law-order of the state. He failed to exercise those powers.

This article by Katju was poorly written, his arguments are layman-ish ( like - ...eating streets and road.., cheep land for business ). These could have been put in a better way.

Talking about Modi now makes sense, talking about 1984 now does not make sense and has no relevance.

The court verdicts are immaterial as they need evidence that is hard. Such evidence by personalities high enough cannot come by as they are smart enough to not leave hard evidence.

Babu Bajrangi's sting account is enough evidence that court of public opinion should take into account. Modi's other statements at his yatras have exposed his inner feelings and state of mind, but that do not make him guilty. It is the statements of Babu bajrangi and slowly as you start to remove layer by layer and see the encounters, comments by others involved, in public opinion, it starts to become clear that there had to be an involvement at the highest level.

1984 RIOTS ARE THE WORST NIGHTMARE OF MODERN INDIA . 28 LONG YEARS NOT A SINGLE CONVICTION . CBI IN ITS USUAL WAYS GAVE CLEAN CHIT TO RIOTERS WHO ARE NOW VERY INFLUENTIAL . A REAL SHAME . IT WILL BE ALWAYS AN ISSUE . JUSTICE DELAYED IS JUSTICE DENIED .
It seemed easy for [former Prime Minister] Rajiv Gandhi to say, ‘When a giant tree falls, the earth below shakes.’ Our trees fell and we can still feel the tremors.” -Victim whose husband was burned alive during the pogroms.

  127. Dear Mr. Katju,

Somehow me and many of young Indians will not be comfortable with your theory.
We can have discussion pointwise and get clarifications from all our friends:

    - Narender Modi as Prime Minister, as per your opinion why
everybody is talking our NAMO as PM, but why can't we, we
doesn't only mean BJP or RSS; WE means INDIAN YOUTH.
India is a democratic country and we can have our opinion. Many
of your friends from UPA are having opinion of making Rahul
Gandhi as PM. Would you please explain on what basis? What RG
has done till now for India or Indian Youth? Whether it is
corruption, scams or rapes, he has not been able to speak to
    people any time.
So, I don't think WE (YOUTH) are wrong if we can choose Narender
    Modi as our PM candidate.

    - You are talking about your aeroplane experience. You should be
happy atleast a gujrati is happy with his chief minister. I am
not able to find any person happy with his/her
chief minister/prime minister as per today's circumstances.
KOI TO KHUSH HAI SIR....why we are so worried about this?

    - You are talking about 2002, but you don't want to talk about
GODHRA, you don't want to talk about 1984, you don't want to
talk about indian judicial system. First of all, if you think of
being capable of writing all above, you should also talk about
    the issues I have mentioned.
It was really unfortunate whatever happened in 2002, but only
and only Narender Modi should not be made responsible for same.

    - You are talking about secularism in INDIA.
As per WE (YOUTH) knowledge, I dont think we as INDIA are not
secular. The HINDU population in all other countries is
declining and percentage of other nationalities whether MUSLIM,
    CHRISTIAN increasing in INDIA.
We have SIKH prime minister and many more at other big posts.
So, please don't try to mislead our YOUTH (WE).

    - You have given full fledge story of one person in 2002 riots.
Sir, there are many more of GODHRA and 1984 riots. and apart of
these many more happening everyday in INDIA.
Please don't forget recently happened rape case in DELHI.
    Capital of UPA led government.
Indians are facing all these things everyday, at each step. How
    do we help??

    - The main issue - Development. ME and I think most of us have
read that development can be measured through numbers, different
indexs etc. But there are many verticals to it. e.g. let us take
TO DECLARE a state FULLY DEVELOPED we have 100 VERTICALS (areas
you can say) But we are doing good on 60 out of 100 verticals,
yes we are not fully developed, but we are developing. and this
is the case of GUJARAT. On this score card of 100, Gujarat will
get better marks than most of the states in INDIA.

For a while let us forget all above. Sir, what WE (YOUTH) want from you is the solution for all above not a different type of story once again. Most of us have read all this may be
hundred times. NEED YOU HELP not your OPINION.

    Thanks and Regards

  130. If it is the case of Narendra Modi, What was done by congressmen after Indira's assaisination is also of Same kind. They have also killed Several Sikhs in response to killing of Indira Gandhi. This is not a comment for justifying Modi's massacre regime, but this has been a practice in india for several years which is to be eradicated. When Babri Masjid's demolition happened, mumbai blasts were planned in 1991 by muslims. Its the same old proverb wrongly followed "TIT FOR TAT"

  132. Mr Katju should check his facts first 790 Muslims and 254 Hindus were killed in Gujarat riots not 2000 as he insinuates. Also how come no one speaks up for Kashmiri Pandits and how they have been brutalized and systematically cleansed in the valley. No one speaks about the 3000 Sikhs snuffed out in Delhi and how continuing violence in South Bengal by illegal immigrants is never reported in our media....Mr modi has got the nonsense out of the way and has focused on the stuff that matters. Gujarat has voted thrice for this mandate. Give the man his due...Modi may be cynical , but he does his job well …at least better than the present lot of shameless, evil , greedy , corrupt bunch of congressi's.... Mr Katju has totally lost it..why are you playing political games on the name of religion n caste n sects..trying to appease muslim votebank or some political move or perhaps Congress must have paid you to speak against Modi...i really feel shattered wid dis government n its chamchas..

You should not act on behest of government of the day. Also your article was not only biased but you appear to be economical with truth.
You are doing the same job of framing opinion based on your fancies. We can understand your motivation but your article looks like a paid news.
Kindly consider this case and introspect.
Your reply in this regard shall be highly solicited unlike your article in the Hindu.

  137. Interesting article, Mr. Katju. There has been lot of hue and cry about this recently. I think you should tell these people that these are not only my views but the views of most powerful country in the world, i.e. United States.

US has repeatedly denied visa to mass murderer Modi citing:

"foreign government officials are considered ineligible for a visa should the State Department view them as “responsible for, or directly carried out, at any time, particularly severe violations of religious freedom.”

BJP and people who are creating so much fuss should snap all the relations with US. In fact any FDI from US must be opposed specially in Gujarat.

Also Mr. Katju have you ever written anything about Sikh pogroms in 1984. If yes can please give me a link of it as I was watching the news with my father and he immediaely shot back why dont he say anything about Sikhs?
