'The Court of Last Resort'


We will proceed slowly in setting up the Court of Last Resort (CLR). The headquarters will be in Delhi, but we propose to set up state units in every state. Most of the work of CLR will be done by the state units, with the centre at Delhi playing an overseeing role. We will set up offices in Delhi and all states, where the complaints can be received. Tens of thousands of complaints will pour in in connection with people in jails (there is so much injustice in India), so we will need lots of volunteers, particularly from youth, academicians, lawyers, media, social activists, professionals, etc who will examine each complaint and send recommendations to the state unit which will then decide the course of action. Mr. Fali Nariman, the eminent Supreme Court lawyer, has agreed to be the Chairman of CLR. Mr. Majeed Memon, the eminent criminal lawyer, will be one of the Vice Chairmen, and Mr. Asif Azmi will be the general secretary. Mr. Mahesh Bhat, the famous film producer and others have agreed to be associated with us. The inaugural function of CLR will be in a press conference at my residence on 15th April at 4.30 p.m. We need the good wishes and support of all enlightened, patriotic and freedom loving people.

I have been asked from where we get the jurisdiction to set up this body ? My answer is : we get our mandate from the people, who are supreme in a democracy.

  3. If you don't have work to do as PCI chief then I have some toilets to clean in locality...It will be more helpful if you do that rather opening your loud mouth on every topic under the sun.. I pay your salary as a tax payer so just shut you mouth and do the job you are expected to do...otherwise resign and do your nautanki.. Nobody would have problem than..got it?

    2. I will request the person to use civilised language. I don't know how much tax do you pay to reimburse Mr.Katju salary but i know one thing that large tax payers do not shout from roof tops about the taxes deposited by them. Further, if mr katju is taking a case of helpless persons languishing in jail then does it mean that just because he is PCI chief he will leave doing good works for the needy. Mr Katju must not stop in his journey of helping needy people who have no voice and totally resource less.

      Who knows Katju is building a forum to rescue criminals as he argued in case of Sanjay Dutt. Either he is mentally unsound or using minority card for achieving political goals. Please note most of his blogs start with "some people asked me..." We do not know who these people are.
      On the other hand many commentors on this blog alleged Katju has political aspirations. Till date he did not rebut these allegations.

Sir, if a person is trying to make a forum to get the justice to resource less people (let us keep apart sanjay dutt for the time being) then what is the harm if ABC is nursing a political ambition. Rather it will be good if someone nurses political ambitions and get them tested at the crucibles of ballot. If people will like the programes of that person then the reflection will automatically come through ballot otherwise he gets defeated at the hustings. This is the true tenet of democracy.

      There is nothing wrong helping resource less people. Nor having political ambitions. But using one as a cover for the other is the objection. It shows insincerity towards a good cause.
      Take the case of Arvind Kejriwal. Started as some activist and quickly turned politician. Many may not like but he clearly articulated that power is necessary to serve people. Katju too has same freedom. But he is behaving like wolf in donkey's garb.

    6. Sir, but what is wrong if a person enters political arena with his/her policies and programmes. Let people test his/her programmes on the scale of their aspirations. What is wrong for a boy who is not intelligent enough taking the examinations and failing at them rather than not taking the exams at all. If Katju's or for that matter anyone's policies are not up to the mark those are bound to be rejected by the people.

      if specific wording is more important for you, here it is.
      Katju really does not have any good intentions to save some helpless people. It is only a gimmick to become good samaritan. He is already misusing his position as PCI chairman by thrusting his ideas and views in various media. Now with this he will get more publicity. He has already written enough against NaMo. So sooner or later he will get RS seat from congress. That's it. No more CLR, no more innocent Muslims.

      It is good to learn the specific wording from you. But Who you are? At least Mr. Anand Mohan had the basic courtesy to reveal that he is Anand Mohan.       Hmm... what you are interested in? Someone's name or facts? Will it make any difference if I am Aleque Padamses or Bhavana Balsaawar or Mammooty?
      I can understand your problem. People like you cannot accept even truth unless it comes from someone KNOWN POPULAR BIG. Same with Katju followers. They think CLR is great idea as it came from Katju a former Justice of Indian SC. But they do not see similar and genuine services offered in their own places.

      Whether it is Armchair, wheelchair or no chair at all, I am better than Katju. Limiting myself to a specific blog on cyberspace. Whereas Katju is on rampage across India by forcing his opinions on people in the capacity of PCI chairman.

      It seems you are contradicting yourself. Here Mr. Katju has presented a method to address certain issues and facts in our Indian Society. I am not concerned whether it is coming from Mr. Katju or anyone else. In my opinion, we need to address the issues raised by Mr. Katju. You have voiced a prejudiced opinion that since Mr. Katju has raised it, it will not be worthwhile since he is using it for cheap publicity.

      I did not say the issue is worthless. I said any issue is worth for people like you, i.e. Alex Varghese, only if it comes from big people. Yes I said Katju is using this for cheap publicity but not that the issue itself is worthless because Katju is using it.

  12. The idea of arbitration may be good but the concept of justice is different for different people. Will the result of arbitration have any legal standing? The person against whom the verdict of CLR would be held may appeal against the decision made by CLR. Does not it mean as more cases getting piled up in our courts?

  21. The effort should be to fix the system, not to add another system on top. If there is so much "injustice" as Mr.Katju points, then why not prevent the injustice from being meted out, so the "knights in shining armor" does not have to come and the rescue the victims. Granted it is not as glamorous as the "court of last resort".
    Somehow this looks like another attempt for publicity more than improving the system.
    Ensure the accused get good lawyers, that they get bail, steps are taken to help or assist the cops in demonstrating innocence. This way "court of last resort" will not be needed.

    "Here it is not a question of whether rebellion against an industry is good or bad; to be approved or condemned. Here it is the question of whether so many workers are indeed guilty of the accusations against them of violence, murder and destruction? Even if so, whether a fair trial is being given to them. Normally if a charge sheet is not filed in 90 days they should be given bail; this is mandatory. Also once the charge sheet is filed, it means investigation is over or almost complete and hence the accused should be given a good opportunity for arranging his proper defence and for that purpose also bail is necessary even if the charge sheet be filed within 90 days. It is inconceivable that hundreds of workers are left to rot in jails without bail. Let them file a writ of Habeas Corpus in the High Court of Delhi or even in Supreme Court through a letter to the Chief Justice and his companion Judges and send that letter through the Jail authorities."

  25. Katju will not take up silly cases. He will take up either celebrities or vote bank groups. Here he is talking to help to undertrials and in Hyderabad he is asking CM to grant remission to killer of ACP. The killer belongs to the popular vote bank.

Sir, will this CLR also take up the injustice being done to faujis by the ministry of defence/honourable judges ignoring the statutory regulations and deciding the pension cases on perception and misuse of power. they just do not agree/allow/arguments to read the law. there is blatant violation of the Constitution but they do not care and deciding cases Arbitrarily. a fauji can not afford well know face-advocate. you honour had said " law must prevail" but not for fauji ( being treated as slaves). please help. in any case i am with you. beniwalg@ymail.com

  29. The members of committee all belong to that "community" or are apologists of the community.
    The idea is good if it is applied across religion/caste/creed but I am sure it will be grossly misused in the near future by various governments, HR groups etc...
    If there are indications in future that this idea dilutes fight against terrorism then Katju has to be blamed for it and criminal proceedings should be initiated... Unless this is agreed CLR shouldn't be implemented...

To answer the fool: This is a civil society initiative and not a Court in real terms. No jurisdiction is needed for creating a private association. Then Master Yoda replies: I get mandate from the people who are supreme in democracy. To him: What kind of non-sense answer is this about a question on jurisdiction. Just say it is a private association to help people.

  41. I hope this forum would take all sorts of reform related to court. Let me cite few example.
    1) court takes summer vacation ( today perhaps only kinder garten and primary schools takes) I think during British time judges(mostly European)used to go to hill station in summer. In independent India how can such vacation of court be accepted?
    2) When Judges takes sudden leave , his office is not bound to inform various people about cancellation of date of case and successfully waste valuable time of so many people. In today's world with so many communication medium including internet, there can be many ways of information.
