Letter to West Bengal CM

Dear Mamataji,

  You must have learnt that the Chief Minister of Maharashtra has ordered the suspension of the police officers who ordered the arrest of the Mumbai girl who posted on Facebook her objection to the shutdown of Mumbai on the death of Bal Thackeray.

I request you to do the same to the policemen who ordered and implemented the arrest of Prof. Mahapatra of Jadavpur University and Siladitya Choudhari, and you should immediately withdraw the cases against them and apologize to them.You should also immediately restore Damyanti Sen, the upright police officer, whom you wrongly victimized,and you should openly apologize to her for your wrong. We are all human beings and we all make mistakes, but a gentleman is one who realizes his mistake and apologizes. You should also apologize to Tanya Bharadwaj whom you insulted on the CNN IBN show.

  I can assure you that if you do so you will go up in the esteem of the people of West Bengal, and indeed the whole country.

 From what I could gather during my visits to Kolkata, your Ministers and bureaucrats are afraid to speak out their minds fearlessly before you, and are terrorized by your unpredictable and whimsical behaviour. To say the least, this is a very unhealthy state of affairs, and you will not be able to remain as Chief Minister for long unless you change your ways and become more tolerant. 

 Kautilya has said in the Arthashastra that a successful ruler is one who appoints good advisers, and listens to their advice. Of course, after listening to their advice it is ultimately for you to take the final decision, but your advisers should feel free to express their opinions fearlessly. In this connection I may mention that Sardar Patel, the first Union Home Minister, told his Secretaries (senior I.C.S. officers ) that they should express their views freely, even if their view is totally different from his own, and he would never take offence. In fact if they do not express their views freely they were of no use to him. This is the way you should also conduct yourself.

 It is still not too late for you if you listen to my advice and change your ways. I am your well wisher, and would like you to do well, and in fact, if you remember, I had praised you at one time. But of late you seem to have become increasingly intolerant and whimsical, which is only going to land you in big trouble.

    Arthashastra was written in a time when Monarchy was the prevailing system of governance. In democracy sometimes the advisers become obstinate and start putting pressure on you to act on their advice. They think they it is only their advice that must be acted upon. We have seen such instances in the past in the case of protests for the passage of the Lokpal Bil. What to do in such cases.

Mamata the brave thrown out the 30yrs rule of left in bengal..even in the past i heard that she had the same nature..but as ruler it has to be changed..positively I think If the Marxist on the opposition@ system which rules the marxist ideology it will not easy to manage the rule because of their Public agitation pointing each & evry aspect of social problems...because mamatha marched throuh the extreme left stnd for coming in to power....
    that pressure may be a reason ..so i think it might continue....

  10. सर, ममता बनर्जी के बहुत से फ़ैसले राजनीतिक असहिष्णुता का नमूना हैं, बंगाल के बहुत बड़े सेक्शन में इससे गंभीर असंतोष भी है। जनता देख रही है और फ़ैसलाकुन घड़ी में अपना निर्णय भी देगी। पर ममता बनर्जी के लिए 'अनप्रिडिकेटेबल' और 'व्हिमसिकल' जैसे शब्द यदि अपकी क़लम से निकलते हैं तो यह बहुत उचित नहीं प्रतीत होता।
    वैसे भी स्त्रियों के चरित्र और स्वभाव के मूल्याँकन के लिए ऐसे शब्दों को बहुत आसानी से कह दिया जाता है। ममता बनर्जी की राजनीतिक गतिविधियों और फ़ैसलों की आप चाहे जितनी निंदा-आलोचना करें, वे एक पब्लिक फिगर हैं ,और इस तरह की आलोचना उनकी होगी। उन्हें इसके लिए सहिष्णुता भी विकसित करनी चाहिए पर आपके द्वारा प्रयुक्त 'अनप्रिडेक्टेबल' और 'व्हिमसिकल' शब्द ममता बनर्जी के कार्यों की सही दिशा और कोण से आलोचना करने के बजाए स्त्रियों की आलोचना के लिए सामाजिक तौर पर प्रयुक्त होनेवाले नकारात्मक शब्दों को पुष्ट और वैध बना रहे हैं।
    आप ममता बनर्जी के कार्यों की राजनीतिक आलोचना के लिए अन्य शब्दों का इस्तेमाल करके इन शब्दों से बच सकते थे।

I do not find anything wrong in the use of the words 'whimsical' and 'unpredictable' and they do not seem to be criticizing women in general but specifically point towards the CM. Justice Katju has frankly expressed himself and has chosen the words which are necessary to do so, you should not unnecessarily interpret his statement as pointing to some other issue (about women in general) which he did not intend for it to point to.

She doesn't have fore-site and always do the things for her party only and refers it for "Ma, Mati, Manush" Probably it will not continue at long run.

Oh jo university ke degree ki bat karti hai waisa university he nahi hai, aur oh bilkul unpredictable aur whimsical hai. Ek mashoor lawyear aur former MLA Mr. Arunava Ghosh(of congress) ka kahna hai power without education hone se aisa he hota hai jo bengal me ho raha hai, aur ap to janti hai, power corrupts, but absolute power corrupts absolutely...

    I feel no fear to comment against you. Firstly, you alleged the Bengal CM as "whimsical and intolerant". Would you not label yourself as whimsical and intolerant because your conception on the CM changed within a few months? Secondly, West Bengal is passing through a tough time than it had earlier. Law and order of the state is deteriorating and worst is expected in days to come. But you said that you are her well wisher. Let me watch, how much time it would take for you to become a "Mamata-hater".

    Your post is absolutely correct.It is said that "History is created when an Unstoppable Force meets an Immovable Object".She created History but unfortunately her name will not be in the history books for her Deeds.She is surrounded by greedy peoples and she does not have a single human to give her good advice which on the other way round she will not listen.It is high time now for H'onarable C.M. for damage control otherwise T.M.C. will fall in no time.

    Your observation for Mamata is absolutely correct.I really appreciate your letter.I have never seen this kind of ruler any where in India.She is a dictatorship politician. She always plays the game according to the tune of madness. No political ideology. This kind of leader can never sustain for long.People must have freedom to express their opinion and that's should be the pillar of democracy.

    First of all ,I am really appreciate your concern about our state of West Bengal. It is also great pleasure that you are taken the issues of west Bengal more serious than the arrest of 2 reporters after exposing the scam of big steel baron cum politician in North India .
    If I am not wrong you praise our CM on the 22/05/2012 when you visit in Kolkata. Now you raise 4 issue 1) Transfer of Damayanti Sen 2) arrest of Sri Siladitya 3) arrest of Prof Mahapatra 4) CNN IBN show.
    Just remind you Prof Mahapatra arrested 13 th April Damayanti Sen transfer on 4th April and CNN IBN incident happen on 2O th may 2012. Please see the dates all issues are happen before 22/05/2012.
    No my question if you are really concern about these issues why you have prise Ms Mamata Banerjee on 25/05/2012?
    Why after six months suddenly you realize those issues are very important?
    You mention Mamta Banerjee in Intolerant and whimsical but we feel her main “problem” that she does not represent to INDIA Inc or Corporate India like other goody goody media’s blue eyed boy Politicians . That’s the main problem. She is from a lower middle class family and she represents the “Bharat “not India Inc. like other major politician in India.

    1. He does not SUDDENLY realize...if you read the whole article carefully, he has started with comparing her with Maha CM and asked her to emulate her Maha counterpart. As for the incidents concerned and his change of heart,it is only after the farmer's arrest that everyone including the writer thought enough was enough and criticism flowed, which was well beyond the date you mentioned.
      Like every optimist we also thought that her whims would come to an end and the "minor" past mistakes were let to go away, but.. I request you to kindly read between the lines and not come with chronicled dates only.
      As for a person born in Bengal but brought up in various part of this country, believe me we are just making a laughing stock of our-self and our esteemed history by letting her have her way.
      She might not be corrupt, but also not an appropriate leader (at least now)
      In the words of Kiran Mazumder Shaw: "Mamta is a dangerous, populist demagogue: economically illiterate but politically astute - deadly combo" (Please do n't link corporate and stuff with this comment, think it as that of one learned women over a leader)

      Mamata played dirty politics with the peoples of Singur-Nandigram. They have realized the fact, after 1.5 years. So, now most of them are asking for money instead of getting back their lands. Because they don't have any faith left in their CM.
      Bedsides TATA's Nano Project; Infosys, Wipro (Second Campus) did not get land and SEZ facility, so they left W.B. Mamata even does not have any idea, how big these companies are. (15+10) = 25 k engineers could get job in these two companies. Siemens has stopped their production in Kolkata, ABG was kicked out from Haldia. Our C.M. is bzy in organizing Bengal Builds, Bengal Leads and delivering her meaningless lectures. What are the outcomes of all these craps (Bengal Builds, Bengal Leads)?
      There is no Environment for building new industries in Bengal.
      Being an employee of an IT company, I know how much a fresher suffers to get a project in Kolkata (It is true for any MNP), because there are lac of new projects in Kolkata. Where cities like Bangalore, Pune, Hydrabad, Chennai even Bhubaneswar s are in much better conditions. So we are going out from Kolkata to get better opportunities.
      Mamata is literally illiterate...like her blind followers...

    She is doing some good jobs also which is not written by media. Today Schools, Hospitals, Offices are not run by trade unions. Today Traffic police controls kolkata, not CITU. Today, rickwala's don't have to pay Rs.500/- per month to any political party (there may be some exception). Please verify the facts.

    I admire your pointed criticism. Lawlessness has reached an extremum in the last few months. Even taxi/autorickshaw drivers or rickshaw pullers have started behaving like hoodlums. Every other day we hear cases of theft, dacoity, murder, molestation etc.The criminals think their patrons are running this government. Most importantly the way this CM trivialises her constitutional obligations is alarming!In short this is a government of an autocrat, for the self-seekers, by the ruffians!

Her own minister says that his fellow travellers are guilty of extortion. Her long-time aide was roughed up day before yesterday by his own party supporters, and the whole ruckus happened in Calcutta University campus ! Kattu wrote an articullage entry full of lies that moguls did not destroy much in India and Islamic invasion was not brutal it seems. He is insulting the great Hinduism as well as the people who suffered. Take his articles as full of lies.

  39. Mamata may be a honest person, true to her heart - a good people's leader. But what she lacks is any form of managerial skills - where she needs to visualize the future and plan to achieve it. West Bengal was a leading state few decades ago, but it hurts to see WB falling much behind compared to other states. The failure is evident in all phases of governance and people's lives. Someone in her council of minsters really needs to stand-up and point out the flaws - and lead towards a constructive dialogue. They can even learn from the other states. The only problem is, will Mamata listen and understand..............

    1. I second you, just wanted to add that the main reason of lagging behind day by day is lack of education. Bengalies are known as a thinking community, but the truth is, apart from some exceptions we are no more an intellectual class. The education system is destroyed by the earlier govt., and I don't think people from this govt. can sense and take measure to restore it. Thinking level of the common people has gone down to the bottom, and in my opinion I don't see any glimmer of hope in near future. Only we can hope that the education level of the state will improve, starting from the primary to the highest- without compromising with merit. But we ALL have to act.

We the common people of Bengal have been through Hell in the past regime for over 35 years. We expect anyone who likes to criticize any of her work or her attitude should weigh their own achievement and passion towards people of India before doing so. We know who stood beside us during those awful days, we know who gave us the strength that we can make the change, we know it is none of the criticizers. So please don't get bothered by what she is doing now or by her attitude as we the people of Bengal and Didi have a time tested relationship and we know very well on whom to depend.     I don’t agree with you 100 %. There are several reasons behind it.
    1. CPM was governing before Mamata Banerjee. Thus, people loyal to CPM are all over. For example, Prof. Mahapatra was a CPM follower and he ended up getting job at Jadavpore University mostly because of his loyalty to CPM. People who have degree from Harvard University may hardly make at Jadavpore University otherwise. Because they hired only them who were loyal to them or CPM. Whatever he did regarding cartoons is totally to show his loyalty to CPM. Whatever he has been doing now could be to utilize the situation for future purpose. What I meant by that is that he could be MLA or MP in future if he keeps showing his loyalty?

    2.Mamata Banerjee has to be strict in order to deal with people like him who are everywhere in west Bengal.

    3.It may be true that leaders may be afraid to speak up in front of her. But most of them are power hungry. Most trinamool leaders are no different from Indian politicians who and whose relatives and friends make immensely while they are in power except Mamata Banerjee. Mamata Banerjee has to be really strict to keep the party. The congress party is WB is nothing. There are many fractions. There are 2-3 leaders who try to show up before TV. They need to say something against Mamata Banerjee to be close to Congress high commended especially at this time.

    Lastly I agree with you however in some cases where she made big blunders like incident happened in case of Damyanti Sen. That is part and parcel of life as human beings are prone of making mistakes. Remember, she removed left from power what was sounded impossible before election. I believe that small mistakes she has had committed so far will surely be corrected in near future. I am sure about the fact that she is much smarter than that.

    Thanks for the blog which has aptly resonated the sense of discontent among the people of Bengal, and when I mean people of Bengal, I consider both the rural and urban population.
    You had said earlier that Mamata is an honest politician. I am not sure if you hinted at her embodiment of personal integrity that she and her followers project. However, in my views, she might be an honest politician but definitely not politically honest.
    Let's take the example of Amit Mitra. When he was projected as a potential finance minister prior to the election, the urban population had a very high expectation given Mitra's track record and credibility as the Chairman of FICCI and his known views on issues like SEZ and FDI. To me, this had been a key feature in making Mamata acceptable to certain section of the urban population with a hope that she is willing to follow a flexible approach in her economic vision. But today, when I see Amit Mitra reduced to a mere spectator in the government with almost no power to influence the chief minister with the views that he has been practicing till he became a Finance Minister, I do not see it as a tragedy with Mitra, but a tragedy with people like us who unfortunately form a very small portion of the Chief Minister's Voting Target Customer. The Chief Minister in her cry for "Ma Mati Manush" can easily survive giving us a damn and can continue to remain in power. But then, it would have been an HONEST call from her part had she projected an orthodox economist instead of Mitra, because that would have matched perfectly with her and the party's (?) manifesto. It is very much like the business houses which promises all kinds of lucrative offers to the customer before winning the bid and then turning a blind eye to those sections which do not generate revenue. If you brand the business house as dishonest then, how come Mamata becomes an honest politician? Personal integrity is definitely a "necessary condition" but NOT a "sufficient condition" to be an honest politician. And even today, there are millions of people who are fit to satisfy this necessary condition, but then can we expect to see each one of them in the CM's chair? Bengal has never lacked politicians whose personal integrity is beyond question. Buddhadeb Bhattacharya lives in a two bedroom modest apartment, Biman Bose still lives in the Alimuddin Street Party Office, so did Pramod Dasgupta. But the mediocrity in their vision and lack of proper implementation is something Bengal has never questioned or seriously introspected. Mamata is just an autrocratic version of the same sterile lineage of mediocrity , which Bengal is compelled to choose time and again, as alternatives are practically nil.

    By far, our own state, West Bengal has become completely lawless society – let’s be honest to accept it. CPI-M gets the major credit for this rare fit and now TMC has started to prove that it is capable of taking this rare fit into next level of success, facilitated by our own beloved leader Ms. Mamta Banerjee, who often without much insight quotes “…government of the people, by the people, for the people”.
    My humble questions to her, if she believes that government is for the people – why then people are getting harassed by stamping them as Maoist when they ask legitimate questions? The situation of poor farmer of Singur is well known – what happens to her promise of good governance for the people? Why an eminent leader like Shobhandeb Banerjee got harassed, why an efficient police officer like Damyanti Sen was victimized for not following her wish – is it an example of governance by the people? The list goes on and on…

  51. The big question is how do we get rid of such polical leaders. They are plague for the society. I am deeply hurt with her comments "Raja chale...". What is her evaluation of common people and people her own party? If you draw and analogy : People who blindly supports her are all 'blue-blooded' and anybody critisizing or trying to pin-point her short-commings belong cannine family ? I am sure people of Bengal must be cursing themselves for bringing such a power to rule over them. It was sheer desperateness to get rid of CPIM govt. and lack of alternative in Bengal that has brought her from rags-to-riches.

    After all these high drama in the centre now TMC is politically untouchable - nobody gives a damn to TMC anymore nobody cares what TMC leaders have to say.

    Now, both willing and un-willing farmers of 'Singur' are fed up , becuase both of them are starving. One deprived of job and another deprived of land.

    Youths are unemployed and asking for random money from business-men , promoters and even farmers.

    Women are being insulted, raped and murdered.

    Hospitals are reporting crib deaths.

    Is this the change bengal wanted ?


    Is this the future we are going to give to our next generation.


    Bengali's need to start thinking of alternative outside TMC and definitely outside CPI(M).

    forgive me if I speak without doing my homework on the subject,and with no legal knowledge whatsoever,except for the fact that many leaders in our country have spoken volumes about the importance of the "right to free speech" in any healthy democracy.Yet,these incidents only make you wonder if those in power really want the people to speak out their minds.There was an incident in UP where a student criticized Mayawati in his examination paper,and was arrested and roughed up for the same. I'm sure there must be many more incidents that sipped under the radar of the media.
    My only query here is,shouldn't action be taken against those who lodged the complaint?Aren't they the ones who need to be discouraged from misusing the law to meet their personal gains?
    From the little knowledge I have of history,it seems clear to me that Maharashtra is slowly turning into a fascist state.

    Your letter is extremely biased and politically motivated. First of all I want to say that I am a professor of an IIT. Obviously you understand my earning does not depend on pleasing political leader. What I want to mean that by writing that I don't want to satisfy anyone. Now I will justify my first line in the following way.
    1. When you criticize someone for betterment, the criticism should be in a constructive way that means you should also appreciate or mention few of the words on good efforts put by anyone. Her effort to bring normalcy in Janglemohal deserves appreciation. Developmental work in the villages are taking a lot of momentum. You have closed your eyes intentionally.

    2. The case of Ambikesh Mahapatra happened long back, even the other two incidents but you felt this is the perfect time as she has withdrawn support from Congress Government.

    3. My request to you don't try to do politics just by showing your face of Ex-justice or as an journalist. We welcome you in the politics. Following "Anna" is not easy without having any good motive.

    4. There is an extremely band trend of the news channel in the recent days to criticize the Government by telecasting even the false news to keep their TRP high. Don't write something just to get temporary appreciation.

    Congratulations for freely articulating your views in the public. You intend to act as a safety valve on behalf of civil society which is very good. Having said that, the question that immediately comes to my mind is: is the safety valve working properly and more than that is it working in an unbiased manner?
    Pardon me for raising doubts about the efficacy of your safety valve so prematurely but certain actions of yours in the public have forced that. On 22nd of May, 2012 you have been generous in praising Ms Mamata Banerjee. Before the just mentioned date, the CNN-IBN incident, carton incident on Facebook, and transfer of Ms Damayanti Sen, IPS had already occurred. As the Chairman of Press Council and as a safety valve, you must have been aware of these incidents. Yet you praised Ms Banerjee. However, on 29th of November, 2012, you in an open letter criticised her on these very same issues which definitely raises questions about your safety valve role.
    You have been critical in your position as Chairman of Press Council of India regarding whimsical and intolerant nature of Ms Banerjee. But I am again forced to raise questions regarding the efficacy of your safety valve when you have been remarkably silent regarding the intolerant and arrogant approach of the Prime Minister of India, Dr Manmohan Singh in his dealings with the opposition, unaccounted money in foreign banks ,CAG official Mr Vinod Rai and with respect to serious corruption charges against his government be it allocation of coal blocks, 2G spectrum, Commonwealth games, deliberate and one sided action in allowing FDI in retail without any concern about its effects on millions of jobs, deliberate action in removing subsidies on fertilizers, diesel and cooking gas causing irreversible damage to the livelihoods of millions of poor farmers who are getting worse as the days go by and millions of lower-middle and middle class families who have know been kicked straight on their stomachs. You have also been remarkably silent when the Congress leaders were deliberate and arrogant in their speeches castigating an octogenarian like Mr Anna Hazare and Mr Arvind Kejriwal. You have been silent when a Congress MP from Haryana who is also a well known industrialist openly supports murderous khap panchayats, when Haryana government (run by Congress) does nothing to stop khap panchayats, when an IAS officer is transferred just when he finds evidence against Mr Robert Wadhera, son-in-law of Ms Sonia Gandhi in land scam case.
    As you advise Ms Mamata Banerjee to be more sound and tolerant and careful in her actions failing which you fear that she cannot continue even as a politician leave alone as Chief Minister will you, in the same spirit kindly come out clearly in the public as to why you have been silent on similar incidents of political intolerance during the same period both at the centre and in the states? As a public servant and definitely as a safety valve, you definitely owe us an explanation and we will not rest and keep on reminding you regularly if not daily in whatever means and mediums that are possible in the public till you have made yourself clear.

Her distasteful and immature comment is not actually surprising, but point to be noted that she shamelessly claims herself as the king, which she in particular is not. She is the chief minister serving the people of Bengal (who are supposed to be the actual kings).   85. Respected Justice Katju, I would like to thank you for your bold remarks. However, your good advice will certainly fall in deaf ears. Politicians ,across the world, has long ceased to heed good advise and remain vigilant about their deeds. The problem is we elect our Parliament and Prime Ministers or Presidents in a completely flawed manner. Election can not be won by money and muscle power, but also otherwise phony, if not illegal, manner. And one of these manners is rabble rousing, the way Hitler came to power in Germany. We live in a political settings in which Parties are elected on certain issues but pretend to assume the mandate of taking any decision. So effectively, we are living in a 'democratic tyranny'. I think we need a overhaul of our political system. Incentives to join politics should reduced as much as possible, governments should founded on the basis of issues not numbers, post-electoral alliance should be proscribed, all government agencies should be made constitutional bodies, negative voting should be initiated so that corrupt politicians can be scared away, No political party should be allowed to form if its manifesto can be proved distinct from those of others, if elected no governments should be allowed to act beyond what their manifesto suggests.

    News has been circulating through a leading Bengali daily that your sudden outburst against Ms Mamata Banerjee is probably due to the fact that you have been infuriated over her for not attending your Kolkata Press Club meet last Sunday at 15:00 after you had send instructions to Ms Nandini Chakraborty, Secretary, State Information & Cultural Affairs Department at 13:30 hours on the same day to ask Ms Mamata Banerjee to attend your press meet which was totally unscheduled. Can you explain under what powers can you summon the Chief Minister of the state unscheduled and that also just to attend your press club meet? Isn't it also a bad example of intolerant, arrogant and whimsical attitude on your part of which you have accused Ms Mamata Banerjee just last night in the public. You need to answer and we will keep on reminding you daily till you answer this.

Please understand the difference between a "Summons" and an "Invitation"....Agreeing to the fact that calling the CM may have been unscheduled but I believe that Justice Katju would have sent an invitation and not a 'summons'. Being a law student, I can tell you that there is a very deep meaning to the word 'summons' in the field of law which is totally different from how you use this word in a general sense so there has been no 'summons' as such here.

      I remember that I asked for reply from Justice Katju and not from you. By the way, the way Justice Katju asked Chief Minister to be present through Ms Nandini Chakraborty at such a short notice sounds more of a summon and less of an invitation because as a student whether of law or not you should know that an invitation is sent well in advance of the scheduled event to allow the invited person to make it part of his/her schedule more so when the person concerned is the head of the government of a state. Only if the matter is of urgent and very critical nature a person is called at a short notice of 90 minutes and that is nothing less than that of a summon. And the pres meet of Katju last Sunday was nothing of that nature . Had he been so eager to invite Chief Minister he should have sent invitation to the CM using his good offices to allow her to say either yes/no to it.As a law student you should at least know the difference between an invitation for an event and a call equivalent to summon.

      By the way, this is not a legal forum but a personal blog to share views. If you are confused on this, then I pity you. I have also consulted the Oxford dictionary regarding the usage of my words "summon" which means to call or to order to something for example meeting which is totally different from the meaning of "summons" that you have used. Please re-read and you will find that in my reply to Justice Katju I have used the word "summon(ed)" and not "summons". Please read the case briefings properly in future before you proceed to argue.

      Lets come on a point by point basis to the logic as proposed by you,
      First you mentioned that there is news circulating in newspapers about the cause of Mr. katju's outburst. And you have based your argument on the premise. But how robust is the hypothesis in itself?Newspapers are meant to give information, not pass on judgement. It is for us to decide which part to take and which to negate. So the premise itself seems illogical.
      Secondly, by your own definition of summon as taken from oxford dictionary mentions it as an "order" as respect to invitation. I hope all of us understand the slight nuances that exist in both words.
      3. Even if for an instance we take that Mr. Katju's outburst is because of the reason as stated by you, does it make her less gullible? I believe we are missing the whole point. We should be more concerned about our CM than others.

      Since it is in open forum, I just gave my views with respect to your comments. It is not a reply. May be the concerned person will take care of that. Correct me, if I am wrong.

When you agree to the fact that the word summon means to order or call, please think over why you chose to use that word because an 'invitation' can never be considered to be equivalent to an 'order', the mere fact that an invitation is given at a very short notice does not make it an order...further I never stated you asked a reply from anybody else than Justice Katju so kindly do not interpret my acts to be more than they actually are...and also...I never stated that you have actually used the word 'summons' here... also, considering that you agree that this is not a legal forum, I wonder why you chose to ask 'under what powers' was the call made because by that you shall be interpreted to mean that you asked as to what was the law that granted the power to make the call....had you simply used these words 'why did you summon ?'       If you correctly recall that Mr Katju's comments in his open letter are all based on the information that he has gathered from his sources during his tour of Kolkata. Then going by your argument, shouldn't it be equally applicable to Justice Katju's comments that how robust is that hypothesis or for that matter how reliable are those sources? And going by your logic why is it illogical to base my arguments on the premise of circulated news in a daily; if you think that it is illogical then what is logical - to blindly accept what Justice Katju is saying or for that what media houses like ABP, NDTV are saying and shut out to any other sources of news just because they do not satisfy your whims. Sorry Anonymous but I must say that if you are really concerned about CM then keep your senses open to all sources not just to some particular sources- that is also equally illogical that you have opined about me.When you are rebuking somebody in the public then you should also demonstrate a credible moral standing otherwise you will lose your face.       If I go by your logic of the last sentence then nobody can question anything even if that person is the leader of the opposition because going by what you have said we can only use such words in legal community or inside courts - we cannot use such words to question the scope and limitations of the authority of any body whether an individual or a government or a regulatory body or legislature or executive- we cannot discuss such things in our day to day discussions. Well if that legally bound democracy implies then I have nothing more to say.     1. Ambikesh Mahapatra's case fall under sec 66A of IT ACT 2000 because He SENT 'malicious' emails to other people with ill will and malicious intention to cause annoyance. The IT ACT 2000 is not legislated by Mamta !! It was legislated by Central Govt. Now, if police executes laws that are placed in books, Why the hell Police is guilty?? If there is any problem in the laws, It is the duty of the Court to judge it. How the hell police can judge a law whether it is constitutional or constitutional !! It is the duty of the police to execute Laws that are legislated.
      Suppose, someone sending me email with malicious intention with malicious contents and I report it to police, Police arrests the Email sender...under a Central Act, and Media starts shutting "look ITS MAMTA PUT THESE PEOPLE BEHIND BARS" ...   92. I think what current regime is doing a replica of what earlier regime did and I've to say that, in some cases, it's worse. So, for people of bengal, there is no change (paribartan) for good, only for bad.

    I haven't seen any CM who talks so much and most of these are rubbish. Cheap talk. She could identify a maoist in a student or a farmer; she could identify within no time without any investigation whether a case (however grace it's) is genuine or false; she has the technical skill to identify whether a cartton is super-imposed (or super-composed, in her dictionary).

    I think people world over pity us that we, people of west bengal, land ourselves from a misrule of 34 years to a bugger mess and no end is in sight!

    I think the minimum we can do is change the regime every 5 years, if this trend continues.

    You have all the right to criticise West Bengal's Chief Minister. You have the right to advise her. But then you are putting up the fact that West bengal is under horrible condition and Mamata Banerjee can't be CM for too long!

    As you are the Chairman of Press council of India, I hope beside reading ABP, you have read India Today's State of States Survey! Where West Bengal is at 6th place this year compare to 17th last year! Among that incredible improvement has happened in Governance. West Bengal is at 2nd Place compare to the 10th last year! And in Education West Bengal is up at 3rd position compare to 17th last year! I hope this is called Improvement! And if there is this kind of improvement of our state, I personally is very much ready to have "whimsical" and "unpredictable". Ms. Mamata Banerjee as my Chief Minister. For your kind information, large amount of people have voted her keeping in mind of her attitude, as she has not changed a bit in last 15 years! She is same - Our Didi, Our Head Mistress and now Our Chief Minister! We common people always find her beside us when we are in trouble! I was a big supporter of "Poribarton" (change) and massively campaigned for Trinamul, to the best of my capacity - just because we hoped for a change. Change has come, for the worst and the state has become like a funeral parlour. CM is acting like Caligula and inevitably running towards the same fate, as history suggests. Previously I used to vent my anger in facebook, but after seeing the reactions, have stopped it in fear of reprisals, not only from the Police,. from the stupid uneducated and corrupt trinamool workers. In CPM time, there was at least a semblence of order, some rule of justice, now that is no more.     Thanks for your observations, advise and comments. Someone had to bell the cat. In west Bengal it is not very easy to oppose the ways of CM Since ( as you rightly said ) she is intolerant , whimsical and devoid of the mindset to accept any positive criticism. The people around her and in her ministry , specially persons with intellect and knowledge are getting increasingly frustrated by her adamant and headstrong attitude . She has to understand that since last 1 and half years she has become the CM and no longer a street fighting firebrand opposition. Criticisms will come on her way as a part of Democratic set up and without taking them has personal failures she need to take them in her stride and rectify the mistakes made by people in the Govt. machinery. When we criticise any incident we only expect her to take a unbiased and just action after proper inquiry and not outrightly reject everything as " politically motivated " ," to maign her Govt." I am still in favour of her uncompromising stand against " forceful aquisition of land" or " against FDI" of Price Rise" even I do not bite all her arguments and consider her as one of the most honest politicians but I am also the last person to accept such "fasist" attitude . I am totally against her recent rhetoric " Raja chale...." and denounce them as utter tasteless. We, who wanted a "Change" after the " Amra -Ora" (We- they) regime of arrogant Lefts really wanted something different, more humane and tolerant political governance.

    Mamata played dirty politics with the peoples of Singur-Nandigram. They have realized the fact, after 1.5 years. So, now most of them are asking for money instead of getting back their lands. Because they don't have any faith left in their CM.
    Bedsides TATA's Nano Project; Infosys, Wipro (Second Campus) did not get land and SEZ facility, so they left W.B. Mamata even does not have any idea, how big these companies are. (15+10) = 25 k engineers could get job in these two companies. Siemens has stopped their production in Kolkata, ABG was kicked out from Haldia. Our C.M. is bzy in organizing Bengal Builds, Bengal Leads and delivering her meaningless lectures. What are the outcomes of all these craps (Bengal Builds, Bengal Leads)?
    There is no Environment for building new industries in Bengal.
    Being an employee of an IT company, I know how much a fresher suffers to get a project in Kolkata (It is true for any MNP), because there are lac of new projects in Kolkata. Where cities like Bangalore, Pune, Hydrabad, Chennai even Bhubaneswar s are in much better conditions. So we are going out from Kolkata to get better opportunities.
    Mamata is literally illiterate...like her blind followers...

    with all due respects I would like to bring the fact in front of you that the honourable Chief Minister of the state of West Bengal is far above to make any kind of apology to any one, not just because of that she has the backing of 294 seats in the assembly, but she has had overthrown a Government of the well organized (and democratic as well,) Goons (Harmad-bahini) after a long 34 years that has no comparison in world history.
    The very soon after she had conquered the Writer's Building she gave a message to the opposition leader to stay back with a sticking plaster on the lips. We believe that is just not for the honourable minister but for the people of the state as well. Therefore the Ministers and the bureaucrats are certainly not afraid of her or anything until they recite Tagore and/or Bannerjee...as they live in the modern age, not of the Kautillya.
    Prof. Mahapatra, Mr.Choudhari, Ms.Sen they are certainly not the victim of the new Government but they all have been strictly governed by the hands of law ( no matter if the law belongs to IPC or TMC).
    Sir, if you are aware of the headlines of the newspapers of today then you must know the reactions of the Lady ( and the Government as well)to your letter. As you are a man of law with vast education and experiences I would like to ask you for a more frequent open letters for the common people and not for the Government, ( I am not including the Lady if you can distinguish her from her Government), hence it is a more public concern than a personal/Government one.
    Until the people of the state has a faith upon democracy let the people decide who will be on the chair (read 'throne'). Considering the political heritage of Bengal enriched by the contributions from Sri Umeshchandra Bandopadhay, Deshbandhu Chittaranjan Das and all the others till date, you should leave the matter in the hands of the masses. And as per Tagore the poet, " a King is never wrong, and he remains no king if he's Wrong".
    Once again I congratulate you for your concern for the state and thank you for your letter.

Comment of opposition has no such value. So more strong personality from neutral zone is required to come forward like you to clean the dirt in the governance.     Anybody who speaks against her will become her enemy as well as enemy of the state.

She never fits any of such civilized paradigm! Democracy has fewer loopholes but people like 'Mamata' uses such loopholes and do whatever expected from them!
