Corruption in Judiciary

There was a Judge in a High Court who had a very bad reputation about his integrity, and on this account was transferred to Allahabad High Court. Later with passage of time he became very senior and Acting Chief Justice of Allahabad High Court.


Some people started demanding that he be made Chief Justice of some High Court, and later brought to the Supreme Court.

The then Chief Justice of India, Justice Kapadia, had received several complaints about this Judge that even at Allahabad he was indulging in corruption,and Justice Kapadia requested me to find out the true facts about that Judge ( I was then a Judge of the Supreme Court).

At that time I had to go to Allahabad, my home town for attending a function, and while there I contacted some lawyers I knew, and got 3 mobile numbers of the agents of this Judge through whom he was taking money. On returning to Delhi I gave these 3 mobile numbers to Justice Kapadia, and suggested that he get these numbers tapped through intelligence agencies. 

About 2 months thereafter Justice Kapadia told me that he had done as I had suggested, and the conversations tapped revealed the corruption of this Judge.

After this, Justice Kapadia should have called this Judge to Delhi and asked for his resignation, failing which he would refer the matter to Parliament for impeachment, but he did no such thing,(though he did not allow the Judge to become Chief Justice of any High Court or a Supreme Court Judge)

Most Chief Justices of India are reluctant to expose corruption in the judiciary thinking that this will defame the judiciary, and so they prefer to bury corruption under the carpet, not realizing that the bulge under the carpet will show. 

Some think that exposing corruption defames the judiciary. My reply to such people is : Does corruption by Judges defame the judiciary, or does exposing such corruption defame it ?

I may give another example. When I was Acting Chief Justice of Allahabad High Court I went to Delhi and met Justice Lahoti, the then Chief Justice of india, and gave him a chit containing names of 5 judges of Allahabad High Court who were doing shocking things. Justice Lahoti asked me what should be done ? I replied that if he permitted, I would solve the problem in 24 hours. He asked, how ?

I replied that I was going back to Allahabad by the night train, and on reaching there would call the Registrar General and tell him to telephone these 5 Judges, and tell them that the Chief Justice had instructed that they would not be allowed entry into the High Court premises. Police was being posted at the gate of the High Court with instruction from me that these judges were not to be allowed entry. Their chambers had been locked, and they will receive their salary checks at home, and they need not come to the High Court. I did not want to see them inside the High Court premises as they had disgraced the High Court.

When I said this Justice Lahoti said "Please do not do this, because then the politicians will get a handle, and then they will set up a National Judicial Commission". I replied that since he was not permitting me to do this, i would not, but he may take whatever action he thought fit.

Later some of the 5 judges whose names I gave were transferred to another High Court.

But is transfer a solution ? Such corrupt judges should be sacked, but this is not done to ' avoid defaming the judiciary'. I again ask : does corruption by Judges defame the judiciary, or does exposing such corruption defame it ?

I have given only two instances of corruption in this post, but I can give several more.

  2. You could have declined to allot them work as happened in the case of Justice Ramaswami. Surely you could have done this? Much less radical then what you suggested but much more effective.Sends the right message to the Judges concerned and Public.

  3. Thomas Jefferson is another biggest inspiration to me. In 1774, when British had to fight two important wars among few others as well at that time, the King sent 40,000 troops to fight the Mysore War III with Tippu Sultan. But, the same year he King sent only 5000 troops to North America, because the war in America was only of valued as Corn producing colony vs Mysore in India which had all advanced industries of economy back then. Weaving silk, Furniture of varied degree, Gold minting, Cotton fabrics, everything you name it was there in Mysore. American colony had just Corns and Fishing in Mississippi river. However, the brains of few people Thomas Jefferson and James Madison had the writings of Divine. Those writings are the foundation for today's USA, which is the only Super power now.

That's why everything that Mr. Katju posts via his writings, no matter how nonsensical, you seem to be always in total agreement with him without doing any critical analysis of his statements just like a true clerk would do at the local government office! And at the same time you give examples of USA which are totally out of context with the current issue. But it is for sure that both you and Mr. Katju can form a good fan club of each other.

    2. Steve its my first time to write to you. I am not concerned who is write or wrong in the discussion. What Mr. Katju has brought to notice seems preety good as he has brought the corrupt practices in the judiciary but the timing he made the shot is suspected, if he knew about it earlier.
      What about I am bothered is that whether the Indian Judiciary is going to improve or will deteriorate after the implementation of the new Judiciary bill 2014. After all judges are also people and how some of a few among them can't be corrupt? Are the politicians not corrupt?
      Recently the Anti Corruption has awarded the Police No. Corrupt and MCD the No. 2. Are these going to be replaced due to this corruption or they are going to be overhauled? It is the fact that the justice delivery is detoriating day be day, and it is also a know fact to atleast me that the higher judiciary is not so much corrupt as it is been projected. Why to change the system when by rejuvenation the things can be improved.
      The CJI R M Lodha has stated that the collegium system has failed. So what does it mean? Can the CJI do anything if the Bill is passed and can stop the government be from doing this by the Supreme Court as it did when the UPA Government was passing the bill for favouring the criminalisation in the polictics? What will be better for the common man as whether the judiciary becomes more corrupt or the politician or the system, its only the common man who has to face the heat.What a common man can do in all this collegium and new judicial bill, where the common has to face the heat but he has not been asked that what he wants, whether he wants the existing Collegium to be repaired or wants that the new judicial bill to come in action? what will be the best for the common man? Is the Supreme Court so helpless at this stage that it is bound to follow the decision of the government? Is the government to powerful that it can implement the judiciary bill without the approval of the Supreme Court? If the Supreme Court is so helpless then will it be able to protect the common man in future? will the court will be able to be considered the custodian of the rights of the common man and the constitution? Are all the acts from the cancellation of the collegium till the implementation of the new Judicairy bill are going/will go following all the instruction as guided by the constitution? What were there with the common man to put his stand regarding the improvement/transparency in the collegium, though the common man efforts have not ever been seen in this regard in the past? What are at present means left with the common man in regard if he feels that the judiciary bill should not be implemented? Can a common man oppose the bill, if after its implementation he feels that the new bill has made the judiciary more worse than the collegium system? Will the criminals become more powerful or weak after the implementation of the new judicairy bill?

What ails us now: It is preoccupation with possession, more than anything else, that prevents us from living freely and nobly.. corrupt judges fracture and divide communities by keeping alive the sense of injury created by unjust treatment and mediation. Judicial systems debased by bribery undermine confidence in governance by facilitating corruption across all sectors of government, starting at the helm of power. In so doing they send a blunt message to the people: in this country corruption is tolerated...
    Reminds me of Firaq Saheb at the Coffee house in Allahabad with Mr. LR Bagga and ehsan Saheb-Addl. Labour Comm.-Knp...He told me that over the Throne of Mohammed Bin Fateh, "La Ghalib Illalah" was engraved, meaning "MAN CAN WIN ONLY, GOD conquers"...further he said,we also see in Courts engraved "Satya Maiv Jay tay"... who reads and follows...Tark ker diyai Bandhan aur Saaz... recited ??
    Time has proved that Firaq Gorakhpuri has not yet moved..moved oue souls.. INDIA!

  11. The same very orders which are believed to have been obtained on extraneous considerations do not get stayed or reversed when appealed on priority. If the higher judiciary is so concerned, it should set up example by demonstrating a mechanism whereby such corrupt orders do not survive longer than the time it takes to appeal

  12. Mr Katju, your views on this please.:: My observation. There is an inherent flaw in the Constitutional setup for States. There is only one election which determines the Legislative branch and Executive Branch of the state government. A party or a coalition who forms the Government at state also controls the Legislative assembly. There is this Checks and Balances are missing, politicians have used this nexus for their benefit all these 60+ years. Don't we need to re-visit the Constitution, to revamp it so Executive branch( replacing CM post with Governor giving complete Executive powers) is elected by people Directly. Legislative is elected separately, with Legislative has Impeachment powers to remove corrupt Governors out of office. Governor also has certain powers so Legislative can not hijack the Executive branch of Government. Well, most people know this. This is how USA constitution is setup. The present ceromonial Governor's position is abolished!.

  13. A wonderful piece. It is the moral authority more than any legal power that sustains the judiciary. When stakeholders stop respecting the moral authority, the system collapses. I hope that the judiciary cleans itself fast and in public eye, so that the rot is stopped before it is too late. Removing a few bad apples does not tarnish the judiciary - letting lawyers and litigants know that favorable judgments are available for money kills the system

  14. Mr Katju I was appalled by your evasive reply instead of calling Ram , Nariman, sorabjee as idiots in your TV debates on chennai high court judges. Your duty is to inform your superiors which you have done. Legally you are required to that much only. Only Chief Justices did not perform the duty , should be punished for dereliction of duty. Ignorance of law is not an excuse. Even the senior idotic advocates cannot have that excuse. asking to resign , you replying you resign all appeared silly. Arnab another idiot taking the debate around, when you have done your duty correctly , not questioning the CJI why there was no action was another silly act.

  15. It is typical kamjor-aadmi's mentality whose wife/girl is raped, but he keeps mum out of fear that "log kya kahege". Then all studs make a bee-line, and it becomes fate of the family-head to live in shame forever. Exactly the same, top bosses of judiciary have done as they didn't take judicious and punitive action on corrupt judges, but sent numerous commoners in jail for similar sins. Result is judiciary is sick & on death bed because of greedy, corrupt and lechers, who know that they have immunity of no FIR & challenge to their integrity, as their bosses are afraid of "judiciary ki jhoothi izzat". I am sorry that top bosses have really harmed the national interest by keeping "luti hui izzat wrapped in ghar ki chaaddar". Sir, top bosses must accept responsibility of present corrupt judiciary due to their own protective attitude instead of being punitive as per their duty of doing justice to one & all. I am sure that judiciary is also inclusive & within the all. It is better late than never. It is time for tougher & punitive laws strictly applicable to one and all including judiciary. Is Hon’ble Modi sarkar is listening and ready for really a great over-haul.

  16. If transferring corrupt judges is no solution, even barring their entry and delivering their pay cheques at home is not. The only solution is to sack the corrupt judges and bring them to justice. Ot is because of these judges that the lower judiciary has become so audacious that bribes are exchanged with court employees in the VERY FRONT of the magistrates in district courts!

Mr. Katju what service are you doing to the nation by spilling the beans now when you can not do anything which is diametrically opposite to when you could take action against the corrupt judges while you were in service! You could have taken appropriate legal action against the judges while serving as the Chief Justice of the Allahabad High Court even without involving the CJI of that time. But you chose to pass the buck to the CJI when you could have initiated legal action directly against the corrupt judges that were in your full knowledge. However, you only performed a clerical duty of verbally informing your superior. If you did not want to take action directly or were not empowered to take action then at least you could have put your complaints in writing to the CJI so that he in turn would be forced to initiate appropriate action and also for the sake of official record. But you did none of this having your own self interests in mind and now you wish to take the moral high ground!

    Secondly, I also wish to state here that the process of impeachment for the removal of judges should be abolished as judges are not elected by the public but are selected for doing a public service job with well defined service rules. Therefore, the judges should also be treated at par with other civil servants with regards to criminal, corrupt and immoral conduct during their service period. There is simply no justification in giving them legal immunity in the form of having to remove them only via the process of impeachment. Because the impeachment process is based on political views and not facts of the case. Hence, this illogical systems should be abolished and done with.

    1. Steve, these are meritful arguments. There was jury system but it was abolished in 1960s. The judges were intended to run the trial, and all court
      procedures were setup under jury assumption . But jury no longer exists. This anamoly led to deviations and corruption became obvious.

Even if we don't have a jury system now it doesn't matter because to address corruption in judiciary as a whole (from lower to upper most) we need to setup proper systems for the appointments and removal of judges in all levels of courts. If we can weed out the rot in the very beginning at the time of the appointment of a judge and also devise a mechanism for their swift removal and criminal action against them as per the law of the land then we can address judicial corruption to a large extent. But still I would not claim such system to be a 100% fool proof system as there is nothing in this world that is created by mankind which can prove itself to be 100% foolproof. However, it would still be far better from the current system.

      The most surprising element about judiciary in the present setup is their system of removal via the process of impeachment in which a judge of any level is treated at par with the President or the Prime mister of our country who come via an election process while the judges are selected or appointed by the government judicial services! This system is utmost stupid. Why should any country waste its time in discussing and debating the removal of a corrupt or immoral judge in its parliament when there are existing competent authorities and laws to deal with it? The job of the executive is to govern the country and create new laws as per the demands of time and not to waste its time in removing judges! The executive is neither competent enough to do so nor are they required to do so. Hence, we do need a change and take back the bearer form blank cheque the country has given its judges! We now need to cross this cheque and make it accountable and make it conditional.

    3. Omprakash: Very valid points. I don't know history behind impeachment process how it got into the system. May have come from British laws. You are right. The nation has to wake up. Lower court judiciary appointments cannot happen in dark. People should demand transparency in such appointments. Its not the ruling party to decide how judicial vacancies are filled. In Tamil Nadu, I was told that it goes to highest bidder. Time that young people take up this cause.

    It seems to me that you have never been to a court in India in your lifetime till now! Otherwise, you would not engage in such a disproportionate Katju-Bhakti like you seem to be doing now! I suggest that you should start reading newspapers and watch TV news and debates instead of the Daily Saas-Bhu Sob Operas that you are so much used to watching. Once you follow my advice you won't need any Katju to tell you what the world already knows enough of and thereafter you will stop worshiping ordinary mortals like Mr. katju.

  21. Justice Katju deserves all the praise for the courage he has taken to speak what people, in any case, whisper. These kind of people are in short supply. Some people have raised the bogey of timing: by raising time issue, the point of argument is deflected and this is what the gentlemen are good at. May be somewhere they feel affected by the truth and suffer from cognitive dissonance. The argument is: can corruption colored justices deliver justice?. Why people can't take and tolerate others point of view? After all, this is the spine of democratic conversation. Discussion got to be debating the issue and not attacking the opponent: attack the argument and not Justice Katju and the timing. In fact, the very reasoning of timing, suffers from logical fallacy - " Argumentum Ad Hominem". Justice Katju please keep fighting; it is not defaming the judiciary. In fact, corrective measures would strengthen the institution and would bring fame only to it. There is no doubt, we have an A class judiciary institution and Justice Katju and many others are an example of it. By recognizing the bad spots and suggesting the corrective measures would add to the fame and not, by all means, it is a defame equivalent.

  22. In a democratic system, checks and balances are essential. But laws alone cannot ensure such a thing. If the head is rotten, the rot spreads too fast. So it is essential that the selection of constitutional authorities in a democracy is done with utmost care. It is better that the concerned authorities in Judiciary, executive and such other systems do the cleaning themselves, wisely at the appropriate time. Otherwise at some point of time they would be cleaned thoroughly that some new systems come to being. And that is the learning from history.

    1. Mr Mathew, Self Cleaning-the process you suggest, has not worked in Political Spectrum. It has not worked in Law Enforcement. It doesn't seem to have worked in Judiciary. It definitely has not worked in Parliament. One can't wait for 100 years for self-cleaning to work.! Do we need new Laws, or Constitutional Amendments or what?

  23. The Pros and Cons of the above issue in my humble opinion can be analysed as under,
    a) Whether the disclosures made by Justice Katju are defaming and will defame the judiciary, the ultimate protector of our constitution and rule of law?
    b) It is said that a man can control the whole world through his material resources but to control him we need a law which is above him and whether such revelations are going to undermine the authority of the judiciary?
    c) The judiciary gains its Strength from the confidence of the people in the justice administration system. But presently everyone in the country are fed up with the present justice administration system which is highly time consuming, uncertain, whimsical and increasingly seen as corrupt by favouring corrupt.
    d) Even the Honorable CJI when he took over, spoke about the need for 365 day working, discouraging unnecessary adjournments. He further canvassed and said that if good people are elevated as judges the entire problem can easily be addressed. This clearly shows that the present collegium system cannot be the only remedy for all the ills that are plaguing judiciary.
    e) Justice Katju's statements in my humble opinion should be taken in the right spirit. A man of proven integrity and capability is making and revealing such information which is known to many. His views should not be written off and should be encouraged as it will surely cleanse the system.
    f) Honorable Supreme Court, number of times said corruption is the cancer in the society, corruption is a human right violation as it bleeds poor and downtrodden. So what should a person suffering from cancer do? Should he put his disease under carpet? Or should he go to a doctor and get the surgery done?
    g) No doubt no one is perfect, No system is full proof and No one is above law. We are in a dynamic world which calls for changes and that can be brought in only through revelations, discussions and finally on the basis of majority opinion.
    h) In democracy it is the people's voice that is ultimate and superior. All the constitutional authorities are servants of the people. There can be no doubt about it. No one should consider that the present revelations are going to damage the confidence of people in judiciary, and indulge in criticising Mr. Katju. We should rally around Mr. Katju and strengthen his hands so that the will of the parliament in bringing the legislation in the judicial accountability is respected by one and all.
    Finally no one should forget that India is the only working and successful democratic country and it is because of Honorable Supreme Court and the Brave, Honest, dedicated judges and every citizen of this great county will bow down for their services. But that should not prevent the change through discussions and deliberations which is the core of democracy.

    1. I would want respond from my end to your items listed from a) to h).

      a). Do we have a measure to define defame?. I don't think there any defaming of Judiciary. It can only strengthen Judiciary if more transparency and Video broadcasting of Court Sessions are allowed. Even China allows Video broadcasting of Court proceedings. The time has come, India can't procrastinate Video broadcasting of Court sessions, at the least the Trial Courts.
      b). No way.
      c). The Executive started corruption. Its was like Domino effect. It started with Emergency call, openly defying a Court Directive for personal gains disregarding the national purpose. Slowly other branches of Governments picked up momentum in Corruption. The 1984 Prevention of Corruption Act only promoted the Corruption openly, at least in Tamil Nadu its happening brazenly.
      d). I support this.
      e). The apathy of many showing frustration and blaming Mr. Katju, exposes the real social impatience, uncivilized and madness. Not good for India, if disregarded.
      f). Well said.
      g). I quote American Constitution's one beginning line....."in Order to make more perfect Union'.... You are absolutely right.
      h). In other words, Democracy is always a Work in Progress. People should remember this.

      My another observation: Indian leaders in UPA govt, failed to allocate ample for Foundations of a flourishing Union. Education, Judiciary and Law Enforcement. These foundations should have been improved tremendously prior to opening Indian economy to the world. Look at some fall outs. The 4 child who died in Car suffocation is due to lacking common sense in them. The car is a foreign car with Child Safety locks. Which means the Car can not be open from Inside, after the locks is set. My question to the society is this: Do we need the knowledge of Car first, or the Car first! MMS and PC thought let us first get the Car. And we learn the knowledge later. So, the nation is paying a huge price in many different safety violations, because the people of the nation is not equipped for modern India yet.

    To make the Indian judicial system better, one also needs to look at the provisions of the Advocates Act 1961 which needs thorough revisions to make it in line with the time and to ensure that the public offices created under the said Act are being managed with honesty, accountability, independence and transparency. Essentially, no operator can be regulator of his own conduct. This is not only against the principals of natural justice but such biasness also vitiates the independence, accountability, honesty and transparency in the system.

    We often read in newspapers that a member of Bar Council is alleged involved in the wrongdoing and arrested . But such members of Bar Councils have no duty, moral or otherwise, to maintain the standards expected from them while the Advocate Act was enacted in 1961 by our learned fore fathers.

    It is also understood that the complaint against the Advocates are being adjudicated in unfair, partial and biased manner as the office bearers elected by the Advocates are biased to adjudicate the complaints against the Advocates. You will not be surprised to know that nowadays the Bar Councils have become the centers of harassment, threat and extortion and some office bearer use their position to mint money.

    Notably, such conduct of the officer bearers of, and functionality of, the Bar Councils not only maligning the image of the profession of Advocate but it also acts as cancer to finish the faith of general public in the Indian legal system as Advocates are an essential part of the Indian legal system.

  25. Sir, it is equally important to eradicate incompetent persons appointed as judges at all level right from Munsif Courts to High Courts. In fact, I deem incompetency is much worse factor than corruption. If you have chance please pay visit to lower courts at various Taluks, you will be astonished to find most of the Presiding Officers if not corrupt are lazy, untrained, imprudent and without basic knowledge of procedural law and practice function like a Lower Divisional Clerks. It is at this level of courts most of the litigant public suffers injustice and they do not have means to enter the arena of Higher Courts. The courts at grass root level have to be cleansed and systematized for better administration of judicial process. Appointing highly qualified, trained and competent persons with honour, honesty and dignity at lower courts is also more important. But like in any other Department of the Government Agencies, in Judiciary also we have allowed incompetent persons and corrupt persons to occupy at all level.

    No comission or forum can help discourage corruption as long as there is no constitutional provision to punish the corrupt judges. If even after impeachment, judges can continue to receive their salaries and retain benefits what would discourage them from being corrupt? There are quite a few cases where judges are being appointed merely due to their political affilitiation some times as a quid-pro-quo to a favor done by them to a political leader while they were in subordinate judiciary.
    Why can't they be tried in public television and shamed in public?. As an example I recall the kind of questions Bill Clinton had to face when he was impeached. Some of the questions were denigrating and would appear to belittle a sitting president. I am sure Clinton was taught a lesson.
    Also the impeachment / trial must be done by an independent eminent jurist and not by legislative members or other members of judiciary. Chief Justice's role should be limited to presiding role. No interference from him should be tolerated.
    With all due respects, the founding fathers of the constitution didn't anticipate that the quality of legislative members and vis-a-vis the quality of judiciary would deteriorate over time and that was a grave blunder they committed. Modern white collar crimes require modern progressive thoughts.

  32. One magistrate did not obey the order of the Hon'ble High Court.
    When I filed contempt petition in Hon'ble High Court, my petition was dismissed stating that it was not maintainable by misinterpreting Sections in Cr.PC.

    Kindly suggest what I have to do.

  33. High court of Gujarat has filled suo moto contempt of court proceedings against me. saying that u have done baseless allegation of corruption against the judicial office a d achariya. High court of Gujarat has fill fir against the same judge and others at Vigilance's polish station at high court of Gujarat. U/s of IPC and preventions of corruption act. Now high court has withdraw the suo moto contempt of court proceedings against me. And said than there are no baseless allegation made by u. So now it as clear that my complaint was true. So fir should lonch against the accused. Help me what should I do suggestion of your all how fight against the corruption.
