Sanjay Dutt


Press Note
An appeal to His Excellency  the Governor of Maharashtra to pardon Sanjay Dutt under Article 161 of the Constitution

(Through the Hon’ble Chief Minister of Maharashtra)

Your Excellency,
            The media has reported today that Sanjay Dutt has been awarded 5 years imprisonment by the Supreme Court. I appeal to you to pardon him under Article 161 of the Constitution for the following reasons:

(i)             The Supreme Court, having found that Sanjay Dutt had in his possession a prohibited weapon without a licence, awarded him the minimum imprisonment which was prescribed under law. Section  25 (1(A) of the Arms Act states that if a person has in his possession a prohibited weapon without a licence he shall be awarded punishment of not less than 5 years imprisonment and not more than 10 years. Having found Sanjay Dutt in possession of a prohibited weapon, which is defined in Section 2 (1) (i) of the Arms Act as an automatic weapon which keeps firing until release of the pressure on the trigger, the Supreme Court awarded him 5 years imprisonment. However, there is power in the Court under Section 4 of the Probation of Offenders Act, 1958 to release the person under these circumstances of the case on furnishing a bond.
(ii)              The power of pardon under Article 161 by the Constitution is different from the judicial power. The Governor/President can grant pardon or reduce the sentence of the Court, even if a minimum is prescribed. Hence there is no doubt that the Governor can grant pardon/reduce the sentence.
For example in the case of Commander Nanavati who was held guilty of murder, the Governor gave him pardon although the minimum sentence for murder is life sentence.
            In the case of Sanjay Dut, the Supreme Court has not found him guilty for the 1993 bomb blasts, but only found him guilty of having in his possession a prohibited weapon without licence. Surely, this is a lesser offence than murder. When the Governor of Maharashtra granted pardon to Nanavati, surely he can grant pardon to Sanjay.
            No doubt Sanjay Dutt committed an offence by having a prohibited weapon without licence, but in my opinion there are extenuating circumstance:
a.       The event happen in 1993 i.e. 20 years ago. During this period Sanjay suffered a lot, and had a cloud hovering over his head throughout. He had to undergo various tribulations and indignities during this period. He had to go to Court often, he had to take the permission of the Court for foreign shootings, he could not get bank loans, etc. 
b.      Sanjay Dutt has already undergone 18 months in jail.
c.       Sanjay Dutt has got married, and they have two small children.
d.       He has not been held to be a terrorist, and had no hand in the bomb blasts.
e.       His parents Sunil Dutt and Nargis worked for the good of society and the nation. Sunil Dutt and Nargis often went to border areas to give moral support to our brave jawans and did other social work for society.
f.        Sanjay in this period of 20 years has through his film revived the memory of Mahatma Gandhi and the message of Gandhiji, the father of the nation.

In these circumstances I respectfully appeal to your Excellency to pardon Sanjay Dutt and set him free.
I am reminded of the famous speech of Portia in Shakespeare’s ‘Merchant of Venice’ that justice should be tempered with mercy.

      See for yourself how an ex judge behaves on national TV. He lost his temper and accused anchor Nidhi of being a poor TV anchor. This shows the pathetic mind set of Indian judicial intelligentsia. No wonder why the Indian judicial system is facing such dire situation where average criminal case such as this takes 20 years to give a verdict, let alone a civil case.
      Nidhi is the best anchor of NDTV. She is beautiful an extremely intelligent person. India is proud to have such anchors. This shows India’s high standard of TV journalism. Justice Katju, being an ex judge should know how to behave on national TV. Justice Katju; your behavior on national TV that was watched internationally from all over the world put 1.2 billion Indians and more than 15 million highly acclaimed, highly successful NRIs to shame.
      Nidhi, the way you handled so maturely with dignified manner taught Justice Katju (who is of your Father’s age) a valuable lesion today that dignity and honor is more important than official title one holds.
      We are proud of you, 1.2 and more than 15 million NRIs are proud of you.
      BTW, Sanjay Dutt is my favorite hero and I will pray for him and spread the message that his mercy petition be humanly considered by the government.

    14. A lot of people are upset with retired Justice mr Katju for appealing to Governer of Maharashtra for pardoning Sanju baba.

      I am not upset with him.

      I am actually very happy that he is only a chairman of press council and fortunately for a lot of us has retired from the judiciary.

      Imagine what would have happened if he was still serving as a judge.

      Sanju baba would be scott free, celebrating with Haneef Kadawala, Sameer Hingora and calling Dawood bhai.



      Most of us are fortunate enough and we don’t have to visit a court, and I hope and pray, we will NEVER have to, looking at the state of judiciary and its ex-officials like Mr Katju.

      Our perception about a Judge in the court is from Hindi movies where the Judge says the same GHISA PITA dialoge - “TAMAAM SABOOT AUR BAYANAT ….” Etc etc

      It led us to believe that judges make a decision based on evidences.

      If you look at his arguments for the appeal for Sanju baba, they are shocking to say the least.

      Argument 1 – Its been 20 years.

      Mr Katju should be ASHAMED that such an important case has taken 20 years to deliver a judgement, since he seems to think he was an important part of Indian Judiciary system.



      He creates a feel that Sanju was “tortured” since he had to go to the court many times, and had to get permission from the courts.

      That must be a pain mr Katju.



      Argument 2 – Sanju baba has already gone to court for 18 months. So he should be pardoned for the balance jail term.

      Mr Katju if I borrow Rs 10 lac from you, can I pay you only 2 lacs and will you forget the balance amount ?

      I’d love to borrow money from you.



      Argument 3 – Sanju baba is married and has two young kids.



      So ?

      Mr Katju what your point ?



      Have you ever thought how many kids were orphaned by the blasts in 93 ?

      I know it will be hard for you Mr Katju, but THINK.





      Argument 4

      Sanju baba is not a terrorist, he had no involvement with blasts.



      Mr Katju you are now arguing like the lawyer hired my Custom Officer mr Thapa in blast case.

      His lawyer argued that his client (mr Thapa) can be sued for corruption but not as a terrorist.

      According to the argument, Mr Thapa was “cheated” by Dawood and gang that they were bringing in Gold and not RDX.

      You wont be able to understand mr Katju what common people think about lawyers and judges.

      You are disgusting.



      Argument 5

      Sanju baba’s parent were socially responsible.



      Mr Katju they obviously didn’t believe in KARMA

      Sr Dutt, created this monster Behrampada to “protect” his constituency.

      He would have never imagined this would bite his son back.

      People he helped, provided arms to his son.

      And Sr Dutt had to seek help from Balasaheb to get Sanju baba on bail.

      So he compromised his principles and sought help from what you label as “NON- SECULAR” people ?



      Argument 6

      Sanju baba remided of Gandhiji.



      OMG. Mr Katju when kids in 5th standard have to go for a movie, they make better arguments than this.

      You need to grow up Mr katju.



      I can understand what you are probably going through Mr Katju.

      You were in a cacoon where you believed that people are scared of you, respect you etc etc.

      And no one cares.

      You still think CM of Maharashtra should respond to you in few hours ?

      You are soooo naïve Mr Katju.

      Having worked in judiciary Mr Katju, you should know how much time it takes to get a reply from any govt office.



      You probably have a weekly quota to fire letters to CMs and Governers every week.

      Writing a letter to a governer and expecting some action is like expecting Chairman of Press council to behave in a logical manner.

      It’s a long shot Mr katju.



      I feel sorry for you and Rakhi Sawant, who behave in same fashion when Media deprives them of publicity.

      Bollywood superstar Salman Khan, who is facing various court cases like hit-and-run and blackbuck poaching case, has decided to get married and have kids as soon as possible.
      He took this decision after Justice Katju wrote to Maharashtra governor requesting him to pardon Sanjay Dutt, who has been sentenced to five years in jail by the Supreme Court of India.
      In his letter, Katju pointed out that Sanjay Dut was married and had got little children, hence he should be pardoned.

      “Salman had always feared that he might get a stringent punishment in one of the cases, but he saw a ray of hope when Katju wrote that letter. He went through the letter to find out what all it needs to be eligible for being pardoned despite a SC ruling,” a close aide of Salman told Faking News.
      Katju has listed six points why Sanjay Dutt should be pardoned, and Salman found that he fulfilled five out of those six criteria.
      The first reason cited by Katju was that the incident was old and Sanjay Dutt had suffered a lot during the period, such as going to court often and facing professional problems. Salman too had been doing the rounds of courts and thinks he has suffered a lot.
      The second reason cited by Katju pointed out that Sanjay Dutt had already spent some time in jail. Ditto with Salman Khan.
      In his fourth point, Katju argues that Sanjay Dutt was not a terrorist; similarly Salman Khan was not a drunk truck driver killing people or an illegal poacher making bucks by killing bucks.
      The fifth point put forward by Katju argued that Sanjay Dutt’s parents were good people and had done a lot for the society. Salman scored even here as his father Salim Khan had written the story and dialogs of wonderful movies like Sholay, which helped the Indian society grow and mature.
      The sixth and final point mentioned by Justice Katju hinted towards the movie Lage Raho Munnabhai starring Sanjay Dutt, which revived the memory and the message of Gandhiji.
      “Well, even Salman Bhai has done movies like Dabangg, which spreads the message of victory of good over evil, and socially responsible movies like Bodyguard, which spreads the message of equality between people despite a person doing menial job – something even Gandhiji said,” the close aide of Salman Khan argued why Sallu bhai was similar to Sanju baba.
      “The only point not matching is the third one, where Katju cites Sanjay Dutt being married and having children. Bhai will soon marry and solve this problem,” the aide confirmed.

    17. @ Mr. Anand and Mr. Prasik, I certainly value your comments for being critical, but aren't we being too harsh and rationale less in opining so..??

      It makes no sense in comparing with different cases. Every case must be seen in its own ambit, else I fear we may end up with a wrong decision.

      I certainly do not support in letting him free but remission can be done under Article 161.

      Please understand its easy to criticize senselessly. I feel so. I may be wrong..!
      Lets hope for the best.

    This was not expected from a learned person like you. I thought that you are visionary. You FAILED us here.

    FIRST of all: It was NOT Sanjay Dutt of MunnaBhai fame who deserves the credit.
    It was idea of Vidhu Vinod Chopra and Raju Hirani.

    SECOND: Sanjay Dutt was merely lucky to grab this movie. Shahrukh Khan was first choice.

    THIRD: Will you tomorrow support Salman Khan as well? (If he found guilty. Which movie will you quote?)

    FOURTH: If Gandhiji was famed by Sanjay Dutt in one movie. Do buy DVD of Khalnayak. (IF movies are to be taken in account).

      we had convicts sitting in jail waiting for their appeal to be heard and a certain rudal shah case wherein the person ws in jail for 14 years without committing any crime,
      and here is the man who charged 3-5 crore per movie, has the fanciest car collection in bollywood, endorses expensive jewellery and watches brands and not done a single thing to rehabilitate any of the 1993 blast victims ..i agree the charge is on possession of illegal arms..but then a crime is a crime and we would be setting a wrong precedent by pardoning him

    What practical application your argument (a) non-availablity of bank loan (b) has spread Gandhism has in reality?
    Law should be same for all, if someone has been paradoned before.. please feel free to bring him to books again instead of asking the Governer to set free a proved accused & anti-social element.

    Mr Rajat Gupta's talent and service in his choose field was BIGGER contribution than 'a'/'any' Sanjay(s) of the bollywood.

  7. Thanks to you Sir, for trying to save 5 Peoples life. Sanjay Dutt, His wife and 3 kids. He committed mistake and he admitted it. He's been through worse than a prison throughout his life. In these 20 years, He didn't investigated for a single OTHER crime. He's not professional criminal, Its his starcast that is bringing him troubles.   9. It is biased of you to say that Sanjay Dutt revived Gandhi's memories. He was a part of the team that made the movie. And being team work, everyone is responsible for its success or failure. Would you have watched the movie, if it had badly written screenplay or dialogues? Or if it was shot badly? No! He made 1 film that revived Gandhi's message. But he has also played the bad man's role in two other movies. So, why shouldn't this be taken into account? What he faced as an under-trial is less worse than what most others face. He was backed by wealthy people and politicians. He got bail and could go around earning his livelihood. What about those who can't afford bail? Such under-trials are languishing in jails despite them being eligible for bail. Plead to the governor for mercy on them.

    Sanjay Dutt may deserve pardon if he has done some good work or sacrifices for the society, not because his parents have done that. For that, people are electing Priya Dutt as their M.P.

    1. yes,very correct.Even a non legal and very common man can understand that one after other bail or interim applications, filed by defense lawyers, prolonged final implementation of decision in the case.Once it was decided by trial (TADA) court,it was convict who went in appeal-NOT THE PROSECUTION.In fact,once out on bail~ by engaging costliest lawyers and filing appeal after appeal and adopting delaying tactics ~ Mr Sanjay Dutt purchased 20 years of freedom.Everyone connected with field of law,jail or social reforms knows that there are hundreds of thousands of accused in jails, awaiting beginning of court proceedings in their cases in our country.In some cases even charge-sheet is not filed in court and accused is in jail since years for a petty crime committed years ago. No legal or judicial luminary writes even for early hearing of their cases...And here suddenly everyone who is someone in our country is bleeding his heart out for Sanjay Dutt. How can one say that convict,who was roaming free on bail, suffered during pend ency of the case ?

    -in most criminal cases, the parents are good samaritans. Sanju is no exception,or pl let him nominate a member of his family to do the jail term for him

  30. While he is guilty of possessing a prohibited weapon Sanjay Dutt has been acquitted of the charges of terrorism and conspiracy. This punishment to Sanjay Dutt, is to give common man a false sense that justice has prevailed. The more disturbing fact is that this is being perceived as giving those affected by the blasts, a false sense of closure. I am not commenting on whether Sanjay Dutt deserves his punishment or not. I am just annoyed at how his sentence is being portrayed as victory against the terrorists who schemed and executed the 1993 Mumbal blasts.

  31. I would like to narrate a quick story from Mahabharat for Mr. Katju. Four people one Priest, One Trader, one Warrior and one Gangster together murder a person. Case comes to court of Dritharashtra. After the accused found guilty king asks Suyodhan and Yudhister to proclaim sentence. Suyodhan says priest cannot be punished so he should be let free. He awards fine and jail to Trader and Warrior. And awards death to Gangster. When asked Yudhister reverses Suyodhan's verdict. Lets the Gangster free and awards death to priest. He explains a priest is learned one and knows murder is sin. Yet he committed the sin so he must be punished. Whereas the gangster does not have proper discretion of good and bad.

    SD came from a popular and responsible family. Both of his parents served as MPs. Also well educated. Yet he commits a crime as per law. Mr. Katju emulating Suyodhan to pardon someone who instead should be punished even more rigorously.

The former was a case of homicide by an upright and morally sound naval officer of his wife's paramour after he allegedly refused to marry her.Though the actions of the officer are worthy of punishment, the public support in favor of the officer can be attributed to the social fabric of an era when adultery was not as acceptable as it is today. This ultimately led to public support in favor of his pardon by the polity who could ignore it no more(even if one fails to mention his close ties with the Nehru-Gandhi family).
    On the other hand , Sunjay Dutt's case presents a totally different picture. Here is a person born into an affluent and well regarded family---both his parents were household names----, received the best of education and facilities and values unlike many under privileged children of the time; yet chose to mingle in bad company and get addicted to psychotropic substances and associate with criminal elements. This person had every chance to reform himself before bringing disgrace upon his family. Even though the Hon'ble Supreme Court has not found him guilty of conspiracy, the fact that he permitted and had knowledge of the banned automatic weapon to be concealed in his bedroom in a time of great national tragedy (1993 blasts). Despite of him being in a social position of public trust---where no one would have suspected him of doing anything remotely so---- is simply a breach of public faith. Moreover he had many resources at his disposal for communicating to and assisting the authorities before the blasts.Fear of physical harm from criminals does not preclude one from doing his/her civic and moral duty.Many fine young men,far better than him ,have laid their life in the pursuit of such duty. As for him having kids, it would not be as though imprisoning the man would make them orphans and have an impact on their financial and developmental needs.The argument that he has done service to the nation in the last 20 years through his films holds no water as whatever he has done was in his professional capacity as an actor against a remuneration as do millions of Indians for their livelihood.If he is pardoned, it will send a wrong signal to the citizenry that the nature and quantum of punishment is decided based on your social standing, popularity and philanthropic deeds vis-a-vis the unbiased interpretation and enforcement of the rule of law. A case in point is the conviction of millionaire Rajat Gupta for insider trading in the USA.A strong signal to the enemies of the nation would also be sent via this punishment and would thwart their efforts to recruit sympathizers from our society by presenting an argument in favor of our weak policing, investigation and lengthy system of justice and that the influential go Scott free.

  43. I would like to make five quick points
    1. The same Justice Katju was criticizing the media for publishing stories about the death of a bollywood star on the first page and not in a startling U-turn is conveniently ignoring the fact that what this bollywood actor did was an act against the nation. Katju is now putting this bollywood star over the national interest.
    2. He makes a point that Sanjay Dutt suffered a lot in last 20 years. But that is entirely his doing. And his problems of not getting a loan or not being able to go abroad according to hi whims and fancies are negligible compared to those whose lives have been completely destroyed due to delayed justice. Take those young guys from Hyderabad who were lifted for being involved in terrorist attacks. Moreover, it was Sanjay Dutt who decided to go to Supreme court against the ruling of TADA court knowing fully well that it will cause further delay in sentencing.
    3. People like Sadhvi Pragya, who is rotting in jail for years without any charge sheet and she does not even get a bail to visit her ailing father. Sanjay Dutt's father who apparently was a great social worker used all his political connections to get release orders for his son who was arrested for an antinational activity. In fact, Sanjay used his family name as a shield to hide such deadly weapons from the law-enforcement agencies. He should have been given the strictest of punishments.
    4. He makes a point that Sanjay Dutt is not a terrorist. Of course not. If he was one, he wouldn't be let off after merely five years in jail.
    5. Sanjay Dutt is married is another ridiculously funny point. You are right Mr. Katju, if he was unmarried or divorced, he should have been jailed for 10 and 5 years respectively. The fact that he married thrice, according to equation (3), his term comes down to 18 months which he has already served.

    Mr. Katju is the king of hypocrisy. He is the most arrogant person at any important position in India today. Only Manishakar Iyer could come close if he were a minister.

    Your appeal to Maharashtra Governor to pardon Sanjay Dutt even before his sentence awarded by Supreme Court could be executed is an unfortunate thing. This is a stark reminder of the sorry state of affairs in our country where law punishes only the poor and ordinary man harshly but the crimes of rich are treated as venial offences even by leading public intellectuals. Sanjay Dutt has been found guilty of breach of a law and there is no reason why he should be given any preferential treatment. Would any poor and ordinary person guilty of violating Arms Act be treated in the same way? Have you made such appeals for the poor also? Your suggestion makes a mockery of the equality code of the Constitution and undermines the majesty of law.

    As a citizen of India, I am gravely disappointed and as a student of law, you have undermined my belief in the majesty of law and idea of equality.

    We have never heard of this mercy petition under Article 161 of the Constitution of India by your office or when you held the prestigious position as a Justice (and not only a Judge) of the Supreme Court for any other common man.

    You will appreciate the fact that a Supreme Court Judge is abstracted as 'Justice' himself and your comments owe a place in newspapers and newsrooms because you once held this position.     Every human who is repentent deserves a second chance, but after due punishment. Unlike the hundreds who died partly because of him, Sanjay minted money, had affairs, married and had kids in the 20 years. His lousy life is not because of anyone else but him. He comes from a privileged family and yet didnt have the sense to behave appropriately.

    Sanjay Dutt didnt bring out the relevance of Mahatma for Mahatmas sake but because he was paid to do so and boy did he rake in the money.

    He deserves the sentence and he has to pay for his deeds.

  59. I feel a little annoyed with the comments above.I feel there is no favoritism in his plea for the mercy. I guess there is a huge cry because a celebrities name is involved in it. If someone commits a crime should he/she be tormented till death? Is that what we call justice? Its the criminal within that needs to be killed from any person and Sanjay Dutt has repented a lot for his mistake. He did all that when he was young and young blood is often impulsive and immature. But he has grown a lot and understood his mistake and that is the whole purpose of justice. I dont see how 2/3 or 5 yrs will make a huge difference.Calm down people.And remember what Gandhi said-Anger and intolerance are the enemies of correct understanding.

They negotiate their crime with traffic police by way of bribes of any and all kind.   69. The delay of 20 years is not an exception in the Indian legal system. This is the case with most judicial proceedings in India – so what you are suggesting is in effect taking a softer standard for a celebrity.

    The judgment does take notice of the fact that he has undergone 18 months in jail, and allows the time undergone in jail to be adjusted. What you are suggesting is the decision of sentencing in the first place, which as you would know, is the discretion of the judge. I’m curious, would you be very happy if someone questioned your judgment?

    And I hardly think that marriage and having children, or the philanthropic bent of family members, or the nature of some of the movies in which he starred in the capacity of an actor (his profession!) warrant any extenuating consideration.

    What you expose here is the very very dangerous temptation of bias, which unfortunately dilutes the impact of other relevant observations that you have made in the past, or may make in the future.

Since we don't have the guts to stand alone against the Powerful System, hence whenever somebody from "that" strata falls on our Terra Firma, we jump like pack of hungry wolves & try to take revenge of our exploitation by tearing him/her apart... This is a reaction of a completely frustrated & depressed society... We all have lost touch with our individual sensitive souls in the daily grind of meeting our both ends...

    Why are we all venting their ire against an already cornered convict?

    Does it make any difference to any of us if a certain Mr.Dutt is punished or pardoned?? If yes, then please enlighten me how... And if no, why bother???

    This is exactly how a Mob behaves when they catch a prey... All pent up anger against the failures in our regular life or angst against the system is vented out on that poor soul & is beaten to near death situation before handing them over to Law...

    C'mon, we all are angry because of something or the other; may be Inflation, may be bad personal equations, may be of a bad work place... But that doesn't mean we should pour that acid on someone who has absolutely nothing to do with it...

    Remember, we all are taught in our childhood that "Kshama Daan is Maha Daan"... I am neither FOR nor AGAINST anyone or anybody; but I detest this un-necessary hue & cry against Mr.Katju's appeal... Although the points stated as ground for Pardoning doesn't feel justified enough but reference to a Condition Precedent is valid... The Law is mature enough to reject or accept the plea...

Because if we respect the Law & want Law to be enforced, then its a common sense that if the architects of Constitution of India which governs Law of this Land has kept a provision of Pardoning, then there must be some sense in it, isn't it???"

  76. I respect Mr. Katju for his contribution as a judge and I presume he knows his jurisprudence better than most who have posted their comments here (including myself). However, though I follow his blog and comments in the media regularly, I disagree with his plea for pardon for Sanjay Dutt. I have several reasons for the same -
    1. Sanjay Dutt was old enough to know the consequences of possessing an unlicensed weapon, that too at the height of communal strife in 1993, when he was caught with the same. So, he can't be deemed to be 'innocently' possessing the dangerous AK47 assault rifle which even policemen won't have except with special sanction.
    2. Sanjay has had privileged upbringing and has greatness thrust on him, thanks to his illustrious parents, not of his own accord. Hence, he has all the more reason to uphold the high standards of probity and morality than do 'commoners'.
    2. Besides, being a film star, he's considered a role-model for hordes of youth who are obviously influenced by his actions - legal and illegal.
    3. One's parents' good work can't be a basis for pardon / leniency for their wayward wards. Hence, despite Sunil & Nargis Dutt's contribution to society, Sanjay has remained a delinquent and the original enfant terrible (before his close buddy Salman Khan usurped that epithet) of Bollywood, setting a wrong precedent for his fans and the youth.
    4. Most civilized societies (read Western Countries) award harsher punishment to those who are influential celebrities as their demeanour influences many who idolize them. Similarly, when law enforcers break the law, they are awarded stricter punishment than would commoners get. I agree with such a premise, that those in responsible or influential positions ought to demonstrate greater dignity and morality, as their actions are more closely followed by many people, leading to good / bad consequences. So, unless such high & mighty get the punishment they richly deserve, they will tend to take law lightly and abuse their position more often (which is already known in many cases).
    Let this be a lesson for celebrities that their otherwise sparkling personalities can't bail them out of legal wrangles and they are expected to abide by the law of the land as much as every citizen of India does.

    Are you saying you can do any crime and get away with it if You start behaving like a holy man afterwards.
    First,

    You have really made me think, if Judiciary overall, also thinks the way Justice Katju thinks for famous people who are convicted to find a espace.

    You should have been hugely worried about the ages it takes in India to deliver Justice(20 Years).

    You should be worried Justice delayed is Justice denied.(Than justice should be tempered with mercy)

    You should be worried, we do not become a dynastic society and parents good deed do not influence the crimes and justice system.(His parents Sunil Dutt and Nargis worked for the good of society.....)

    You should be worried time and again Rich Powerful Famous and Connected people twist the law and investigation.Many such unfortunate people have also have family and children but no money and connections. (Sanjay Dutt has got married, and they have two small children.)

    But, one thing now i know, how much rewarding the post of Governor can be. Is Justice Katju targeting the post of Governor next???

  97. Mr. Katju, going by what you said, every accused who has spent sometime in jail during the trial should let go scot free because of a prolonged trail.

    How long the trial goes is a matter of fact?

    A person having got married for third time, having billions of rupees in property, swanky bikes n cars and kids from the age 20 years to 2 years is "tortured".

    If that's the criterion, then there are thousands of people in the country who are in much worst position then him, u never sounded concerned from him, why?

    Since you are still holding a position which can influence, your act clearly amounts to influencing the delivery of justice. A highly shameful act from a person of your stature.

    So your next post will be for saving Saif Ali Khan and Salman Khan in poaching case because ever they have been tortured for 15 years and the matter is still in the trial court.

    No doubt, as long as we have people like you in this country, justice would for rich only and not for ordinary citizens.

  99. one thing i agree with justice kadju is every person must have speedy trail .if a person state cant meet its burden then obvious choice is to found him not guilty. i am sure in sanjay dut case and salman khan case there is some foul play or state of India does not have enough mechanism to meet its burden which is finding the proof to convict them. it is not fair or just to keep any person in prison until you find proof to convict him.

I raised the question that the salary paid by government to Chairman of PCI but S.C. Judged paid by Consolidated fund of India..you aredoing wrong comparison to junta when... he blocked me... this is the standard of Mr. Katju.

I raise just valid point about the payment done by Government for Chairmen of PCI while The Judge of High Court paid from the consolidated fund of Republic of India.   103. Most of the people posted comments here did not think of fundamental concept of punishment.

    All punishments, except capital punishment, are aimed at reforming the offender.

    I think that no purpose will be served by sending Sanjay Dutt to jail for 3.5 year more after lapse of 20 years. Since the Supreme Court has already pronounced the Judgment, the option of pardon is required to exercised.

    First such bomb blast must not be used by anyone for furthering ambitions of cheap politics or mishandling will bring situation like forgotten plight of Kashmiri Pandits even by J Katju because highlighting plights of Kashmiri Pandits will not make him Governor or Rajya Sabha MP and he must benevolently consider resigning in the name of unwritten propriety which he professed frequently in judgments in HC and SC, from present salaried post for not focussing in his job like former army chief,although projecting honest image.

    Mostrespectfully ,let me quote page 40-41 of Judgment in appeal by A-117 no 1060 of 2007-
    Quote"Confessional Statement of Manzoor Ahmed Sayyed
    Ahmed (A-89)
    Confessional statement of A-89 under Section 15 of
    TADA was duly recorded on 24.05.1993 (11:15 hrs.) and
    26.05.1993 (17:30 hrs.) by Shri Krishan Lal Bishnoi (PW-193)
    the then DCP, Zone III, Bombay. The said confession reveals
    as under:
    i) A-89 was a good friend of Abu Salem.

    Mostrespectfully ,I have to bring on record that 2 fit cases of life imprisonment has been benevolently turned into few years of detention by Hon'ble Supreme Court.In full knowledge of handgranades recorded as under by SC ,Justice Katju is belittling SC by saying Self-defence when Dutts already had 3 licences of weapons.
    Begum Kaji receives ammunitions twice in 8 days,after checking the bag,both times being told that they will be used in Bombay blasts.Retracted statement when taken under TADA act with due procedure giving 48 hrs of time is still admissible.Justice Katju misleading President and PM by writing "a Prohibited weapon"while Sanjay Dutt kept handgranades which were later barbarically thown on SCHEDULED CASTES of Machhimar colony.If educated men of 34 years could not understand 25 handgranades brought by gangsters to Mumbai and accepts those on phone call by Annes Ibrahim Kaskar,brother of Dawwod,only J Katju can recommend him pardon to become political executive soon.
    In case of Bugum Zaibunissa Anwar Kazi,who received handgranades etc with due checking by her twice in 8 days with full declaration of purpose of use in Bombay blasts,Life sentence is a fit case and CBI must be advised to file Curative petition for greater punishment to her.
    J Katju is doing OB van politics like Arvind Kejriwal by taking only cases which will bring him media attention.Letters of mine citing relevant confessions recorded in SC Judgments is chosen to be ignored by J Katju.Which is similarly unfortunate as he rushed to appeal to Governor ,who does not have powers in Arms Act.Now writing to President and to feign his ignorance of law sending copies to PM and HM and not to Governor.On lighter note,J Katju is danger to employment of similar politician practicing appeasement like Digvijay Singh.
    Letters written to J Katju follow with the request to dismiss him from salaried post for misleading President and PM by selective citations and causing instability in state by belittling SC sitting in salaried position and hurting sentiments of majority community thus demanding the impossible to cause rift between 2 communities.
