Syed Salman Chishty

My friend Syed Salman Chishty ( email salmanchishty@hotmail.com, mobile 9829174973 ) is the Gaddi Nashin of Dargah Ajmer Sharif, which I hold in high respect, particularly since the great Emperor Akbar, whom I regard ( along with Ashoka ) as the greatest ruler the world has ever seen, was a regular pilgrim there. Salman is also Director of the Chishty Foundation.

 Salman was born and raised in the Chishty family, a celebrated family in India, who are hereditary custodians of the 11th century Sufi shrine of Hazrat Khwaja Moinuddin Chishty in Ajmer. His family has been serving the dargah for the last over 800 years. I have met Salman several times. He is a great man.

 In response to my appeal posted recently he has sent me the following email :

 I personally spoke on telephone to Mohd. Nazir and extended all support that they need on behalf of the Ajmer Dargah Sharif and Chishty Foundation. Also, I have asked some friends of Ajmer Sharif who live in Agra to personally go and meet the family and extend whatever support they can to the family.
 I have also told the father that the family can come to Dargah Ajmer Sharif and live in our Sufi Khanqah Chishty Mahal as and when they feel like. We can take care of their stay and food throughout, along with employment option to their eldest son who is 20 years old to work in Ajmer Sharif with us. They can come to Ajmer Sharif during Ramzan, and we shall take it from there after discussions with the father as to how to address the needs of the family.

Monsoon progress in India

The monsoon progress in India is reported to be sluggish. Here are some sure shot, time tested,  solutions to the problem  :
1. Begin an akhand yagya, and carry it on till the rains come, feeding 10,000 Brahmins daily day and night.
2. Ask your ladies to take off their clothes at night and go nude to the agricultural fields and start ploughing with hoes.
3. Perform the marriage of a  a male and female frog
4. Sing raag megh malhaar, like Tansen or Baiju Bawra,
or if the above do not work
5. Commit suicide, like the farmers of Vidarbha and elsewhere

Urdu Poetry


 Firaq Saheb ( the great Urdu poet Firaq Gorakhpuri ) used to often point out some defects in Urdu poetry. For instance, it has very little nature poetry, e.g. the nature poetry of the English poet Wordsworth ( see 'The Daffodils', 'Solitary Reaper', 'Tintern Abbey', 'The Prelude', etc ) and ' Meghadut ' of Kalidas.  It also lacks the maternal love poetry e.g. the maternal love of Yashoda for the child Krishna in Surdas and Raskhan, and in the Tamil poem 'Tiruppavai' by Andal.

 However, there is one aspect from which perspective Urdu poetry is the greatest in the world.

 I have read the poetry of several countries--England, America, France, Germany, Russia, Spain, the Latin American countries, Persia, etc and also the poetry of India e.g. Hindi, Sanskrit, Bengali, Tamil, etc.

 In no language does the voice of the human heart come out with such power and with such elegance ( andaz-e-bayan ) as in Urdu. In that respect Urdu poetry is the greatest in the world ( see my article ' What is Urdu ' on my blog justicekatju.blogspot.in and on the website kgfindia.com )

What a tragedy that this great language was sought to be suppressed by some bigoted idiots in the land of its own birth !

Are Tagore and 'Netaji' holy cows for Bengalis ?


One evening at Allahabad when I was a Judge there I was at the house of one of the High Court Judges along with some other Judges,chatting before dinner.

 I mentioned my view about Subhas Chandra Bose, that he was a Japanese agent. At this one of the High Court Judges who was a Bengali reacted almost hysterically, and started shouting at me, and threatening to walk out. I was taken aback, and became mum thereafter, as I did not want the party to be broken up.

 But I have witnessed a somewhat similar reaction by many ( not all ) Bengalis if one speaks against Tagore. It is sometimes impossible to talk rationally with many Bengalis about 'Netaji' and Tagore.
 Are Subhas Chandra Bose and Tagore the private property of Bengalis ? Can no one criticize them in their presence ? If Bengalis regard them as public figures, not the private property of Bengalis, then the public surely has the right to assess and criticize them.

I have expressed my views about Bose and Tagore on my blog justicekatju.blogspot.in and I do not intend to repeat them in detail.

 I regard Tagore as a British stooge who was promoted by Yeats and used by the British to divert literature from the revolutionary direction Sharad Chandra Chattopadhyaya was taking it ( see  his novel ' Pather Dabi', which was banned by the British. At one time the price of one copy was the same as that of a Mauser pistol ).

See in this connection my article ' The Role of Art and Literature ' on my blog. I have explained there that there are broadly two theories of art and literature, one is called 'Art for art's sake', and the other is called ' Art for social purpose '. In a poor country like India only the second theory is acceptable. Tagore belonged broadly to the school of ' Art for Art's sake', propagating spiritualism and mystical nonsense ( see ( 'Gitanjali', 'Agni beena Bajao', etc ) and Sharad Chandra to the school of ' Art for social purpose'. The British were scared of the writings of Sharad Chandra, and so they promoted their stooge Tagore.

Am I not entitled to even present my view about Tagore before Bengalis ? Do I not have freedom of expression ?

 I regard Bose as a Japanese agent, otherwise why did he give up the struggle against the British in 1945 when the Japanese surrendered ? If he was a real freedom fighter he should have carried on a guerilla war against the British, as the Chinese had done against the Japanese. In a guerilla war one fights with the weapons of the enemy, by snatching them from the enemy.

 In fact Bose was only being used by the Japanese Imperialists, who would have bumped him off once his utility was over. Would the Japanese  fascists have given freedom to India if they had defeated the British ? No, they would have looted it, and slaughtered a lot of Indians, the way they looted Manchuria and North China under their occupation, and slaughtered tens of thousands of Chinese in Nanking, Shanghai, etc. ( see on Youtube about these massacres ).

 I have great respect for Bengalis, many of whom are my close friends. I would only request them to ponder about what I have said, and not treat Bose and Tagore like holy cows

Gandhi or Bhagat Singh ?


A real freedom struggle is always a violent struggle. This is because no imperialist power gives up its conquered country without an armed struggle. Did George Washington fight against the British rulers of America from 1775-1781 with an army ( the Continental army ) or by presenting the British flowers and bouquets ? Did Bolivar fight the Spanish rulers of Latin America with his batallions, or with lollipops ? Did Ho Chi Minh fight the French with guns or by satyagrah and fasting ? Did the Chinese fight the Japanese with salt marches ?

The British left India not because of Gandhi, but because in the Second World War Germany attacked and weakened England, and because of American pressure on the British

 So our real freedom fighters were Bhagat Singh, Surya Sen ( Masterda ), Chandrashekhar Azad, Ashfaqulla, Rajguru, Khudiram Bose, Ram Prasad Bismil, etc. They were taking our freedom struggle against the British in the correct revolutionary direction, and had they succeeded we would have had a prosperous India today. But instead our forefathers stupidly deserted them and followed that British agent Gandhi who diverted the freedom struggle towards a nonsensical channel  called satyagrah which would be harmless to British interests, and because of our forefathers'  stupidity we are still suffering today with massive poverty, unemployment, malnutrition, lack of healthcare and good education for the masses, etc

Ram Prasad Bismil

Another of my heroes, Ram Prasad Bismil,  the guru of Ashfaqulla. His birthday is coming on 11th June.

  You fools have forgotten your real heroes, and made that fake 'Mahatma', who was in fact a British agent, as your hero. That proves my point, that 90% of you ( or is it 95% ) are idiots.

 The real Father of our Nation was the great Mughal Emperor Akbar, but you have forgotten him, and made that fraud Gandhi as your ' Father of the Nation'.

Kejriwal is right

On this issue Kejriwal is right

As I had mentioned in my interview with Rahul Kanwal, how can a government run unless it has officers in whom it has confidence ? After all, it is the officers who have to implement the policies of the government.

Najeeb Jung's claim that he can appoint senior officers of the Delhi government at his own discretion (meaning the discretion of his masters ), and not on the advice of the Delhi Chief Minister, is wholly unacceptable in a democracy.

 Kejriwal's claim that Shakuntala Gamlin wanted to trick his government into giving Rs. 11,000 crores to power companies may or may not be correct. But one thing it certainly proves is that Kejriwal has no confidence in Ms. Gamlin. How, then, can she be thrust as Acting Chief Secretary on an unwilling Chief Minister ?

 As I had pointed out in my interview, Delhi is not an ordinary Union territory like Andaman Islands or Lakshadweep, which have no legislatures or Council of Ministers, but are run by an Administrator appointed by the Central Government. Delhi ( and Pondicherry ) have both a legislature and a Council of Ministers.

  There is no doubt that in view of Article 239AA of the Constitution, which created the NCT of Delhi, three subjects are reserved for the Centre : public order, police and land, while the others are in the domain of the Delhi legislature and administration.

 As regards public services, there may be a grey area, but the ambiguity should be resolved by interpreting Article 239AA democratically, rather than in an authoritarian manner, since admittedly India is a democracy. Hence the Delhi government should have the right to choose officers in whom it has confidence.

  After the Glorious Revolution of 1688 in England the principle of supremacy of the legislature over the king has been firmly established, and in Shamsher Singh vs. State of Punjab, 1974, a Constitution Bench of the Indian Supreme Court has held that the Indian President or Governors are only like the British king, that is , having no real executive powers except ' the right to be consulted, the right to encourage, and the right to warn ', as Walter Bagehot in his book ' The English Constitution ' mentioned.

 In a democracy it is the people who are supreme, and the people operate through their elected representatives. The President of India, Prime Minister, other Ministers, Judges, bureaucrats, police, army, etc are nothing but servants of the people.The legislature, elected by the people, therefore represents the 'general will' ( to use Rousseau's terminology ) which is supreme. Najeeb Jung, being unelected, is only a servant of the people, and must behave as such. However, as I mentioned earlier, like Faust he has shamelessly sold his soul to a Mephistopheles

The Causes of Conversions


This comment has been made on my previous post :
"  Sir what is your opinion on currently residing Muslims and Christians in India ? Were their ancestors not Hindus by birth and were not they converted to Islam or Christianity by force ? "

This is my answer :

Only about 5% Muslims and Christians would be having ancestors who were forcibly converted. The remaining 95% were mostly belonging to the depressed classes like the dalits, who were treated so inhumanly by the upper castes that they voluntarily became Muslim or Christian to get social emancipation.

 If I were a dalit and treated like a dog by upper castes I would prefer to become a Muslim or Christian, because in those religions I am at least treated as a human being. So the ancestors of the majority of today's Muslims and Christians got converted voluntarily, not forcibly,  to get social emancipation. Only a minority were forcibly converted.

 In places where caste oppression was more terrible, e.g. Bengal ( see the novels and stories of the great Bengali writer Sharad Chandra Chattopadhyaya ) there were more conversions.

House of Parliament, or a fish market ?

Is this a House of Parliament, or a fish market ? Everyone is shouting at the same time. Nobody takes the permission of the chair before speaking. Hardly anyone can be heard ?
 And the destiny of the nation is in the hands of these indisciplined, uncouth rowdies !

Chinese Expanding Imperialism


With their 3.5 trillion dollar foreign exchange reserve and huge trade surplus, the Chinese have become aggressive imperialists, hungrily seeking markets and sources of cheap raw materials, particularly in poor underdeveloped countries,like ravenous wolves.. Thus the Chinese have become imperialists, seeking to plunder weak countries in Asia and Africa, like the Europeans in the 19th and early 20th centuries.

 But Chinese imperialism is expanding aggressive imperialism, like that of Nazi Germany. Therefore it is much more dangerous for Asian and African countries than traditional imperialism, which at best is defensive in nature.

 All right minded persons must therefore oppose tooth and nail the Chinese imperialist attempt to dominate our countries and grab our markets and raw materials

Conversion from one religion to another is conversion from one idiocy to another. People should convert to science and rationality
Iqbal must be condemned
I strongly object to posthumous grant of Tarana-e-Hind award to Allama Iqbal in Kolkata by Mamata Banerji. She is only eyeing the Muslim vote bank.
 Iqbal may have been a good Urdu poet but he must be condemned for throughout shamelessly supporting creation of Pakistan, e.g. in his Presidential speech of the Muslim League at its Allahabad session in 1930, and for preaching feudal communal pan-Islamic nonsense in 'Shikwa' and 'Jawab-e-Shikwa'.

Rajasthan Government surrenders to Gujars

Rajasthan Government surrenders to Gujars and agrees to give them 5% reservation.
 I have 2 comments to make about this :

(1) I am opposed to caste or communal reservations. In fact such reservations are doing great harm to the country by perpetuating casteism and casteist hatred. Politicians, however, benefit as they rely on such vote banks in the elections

 And how many SCs or OBCs benefit from such reservations ? Hardly .01%, and these too, of the 'creamy layer'. Most SCs and OBCs are still living in miserable conditions. The persons who are really benefited by such reservations are our crooked politicians

 What should be done is to give facilities and financial help to the poor of all castes and communities ( and there are many poor among the 'upper castes' too ).

Boys and girls of the 'upper castes' getting over 90% marks are often denied admission or jobs, while SCs and OBCs having 40% or even less get them. This naturally causes a lot of heart burning in the former. In fact it is 'reverse discrimination', which was declared unconstitutional, being violative of the equality provision, by the U.S. Supreme Court in Bakke's case in USA.

 I was told by a Principal of a Government Medical College in U.P. that he was pressurized by the Minister concerned to give pass marks to some SC students who repeatedly failed in their exams. What kind of doctors are we inflicting on society ? Will they heal the patients or harm them ? I am not saying that all SC doctors are incompetent, but those who pass their exams in Medical Colleges in this manner certainly are.

(2) I never go to vote, because my vote is meaningless. Most people in India vote in 'vote banks' on the basis of caste and religion like sheep and cattle. What value does my single vote have when we see most people in most states voting in droves and herds for their caste candidate or caste party ? Most people do not see the merit of a candidate, whether he is a good man or bad man, whether he is educated or not, etc but only the candidate's caste or religion. That is why a large section of our M.P.s and MLAs have criminal antecedents. Phoolan Devi who was alleged to have committed many murders, was elected an M.P. only because she was of a backward caste. Democracy was never meant to be run in this manner

 So thank you very much, you may have your democracy as much as you want, but please do not ask me to be a party to it

Kashmiris must keep suffering


A Kashmiri Muslim sent me this fb message today :

Good evening sir,
 I am from Kashmir. Recently  militants  in Kashmir have threatened  mobile tower land owners to make their towers disfunctional. Also, they threatened mobile showroom owners and warned them to close all such type of communications  within a week,  particularly  in North Kashmir.

Yesterday  they entered in a BSNL office and fired indiscriminately  on them resulting in  3 injured  and 1 dead on the spot. On the same day they killed a mobile  land owner.

Today about 10.15 pm. they entered  in a home and fired on a person who is now battling  for his life in hospital.  He is also a land owner of a tower.

 I am confused. There are  7 lakh troops in Kashmir but still this is happening.  Is it due to security failure or due to any other reason ?

 It is clear that if this is not stopped well on time it means mobile  companies  have to close their businesses in the valley, leaving  thousands jobless. Who is responsible ? How to tackle this ? That   is my question to you sir

This is my reply :

I am indeed deeply sad for what has happened to both Kashmiri Pandits and Kashmiri Muslims. I am a Kashmiri myself, and all Kashmiris, whether Hindu or Muslim, are my blood brothers. Therefore any atrocity or death or suffering of Kashmiris causes me great grief, and I would like peace to come back in Kashmir, and justice done to all Kashmiris.

 The problem, however, is that you Kashmiris will not listen to me. although I have patiently and repeatedly tried to tell you what is good for you.

 I have repeatedly said

(1) Kashmir is a part of India, having been incorporated into India by the great Mughal Emperor Akbar in 1587, and thereafter it remained part of India. Although there was a Maharaja, Kashmir was in effect part of India during British rule.

(2) India will not, and must not, allow Kashmir to secede from India, because if it does then next Nagas may demand secession, then Mizos, then Tamils, etc. Where will it end ? India will be broken up into pieces.

 As I said in my article ' What is India ' ( see online and on my blog justicekatju.blogspot.in and on the website kgfindia.com ), India is broadly a country of immigrants, like North America, and this accounts for its tremendous diversity---so many religions. castes, languages, ethnic groups, etc. The only policy which will enable us to remain together and prosper is secularism and giving respect and equality to all communities and lingual, regional and ethnic groups, otherwise our country cannot survive for one day. This was the policy of the great Emperor Akbar, who is the real Father of the Nation ( not that fake 'Mahatma' who took the country for a ride ), and who gave equal respect to all.

(3) The only solution to the Kashmir problem is reunification of India, Pakistan and Bangladesh under a strong secular government which does not tolerate religious extremism or bigotry of any kind, whether Hindu or Muslim, and crushes it with an iron hand. It is high time that all people in our sub continent must realize the truth : Pakistan is a fake, artificial entity ( I refuse to call it a country ), created by the British and their agents, those rascals Gandhi and Jinnah, on the basis of the bogus two nation theory.

(4) All this high talk of U.N. resolutions overlook two points (a) It presumes the validity of Partition, and the genuineness of 'Pakistan', although it was a big fraud and swindle, and (b) It overlooks the fact that the U.N. is dominated by big powers which impose their will on weaker nations. Their resolutions are therefore often unfair and flawed.

I have therefore been saying repeatedly to Kashmiris what is in their interest : that they must give up their stupid demand for independence or secession to Pakistan, and instead start demanding reunification of India and Pakistan under a secular government, but my words have fallen on deaf ears. And when people prefer to remain stupid they must keep suffering

Faust and Najeeb Jung


I have described Najeeb Jung as a Faust who has sold his soul to a Mephistopheles ( the devil's representative ). Some people asked me who was Faust. So let me explain.

Faust is the protagonist of a classic German legend, and is the central character in the play ' Dr. Faustus' by the renowned German scholar and writer Goethe, and also of the English playwright Christopher Marlowe.

 Faust is a scholar who is highly successful yet dissatisfied with his life, which leads him to make a pact with the Devil, exchanging his soul for unlimited knowledge and worldly pleasures. Faust and the adjective Faustian imply a situation in which an ambitious person surrenders moral integrity in order to achieve power and other worldly benefits.

 Najeeb Jung is like Faust, who has abandoned all sense of morality for holding on to the chair of Lt. Governor of Delhi. I have called for his resignation,  but since he has no shame he will certainly not resign.

Bazzat Kashmiris


This well known Pashto proverb applies to me too, being a Kashmiri :

" Although a scarcity of men should happen, do not cultivate the acquaintance of these three kinds of people:
 1st, an Afghan, 2nd, a Kamboh, and 3rd, a wicked Kashmiri "

My elders used to tell me it applies only to wicked ( bazzat ) Kashmiris, and not all Kashmiris !
 But it is for you all to decide

The Chinese chors


 Apart from becoming very aggressive in capturing foreign markets, like European imperialists in colonial days ( see my blog ' Getting kicked out of China ' on justicekatju.blogspot.in ), the Chinese have in recent years become some of the biggest chors in the world. With their huge amount of corruption money from China, many of them have bought valuable real estate in the Bay Area in California, New York, Vancouver and indeed all over North America.

  For a property worth 2 million dollars they will offer 3 million. Moreover they will pay the entire sale price immediately in down payment, instead of taking a mortgage, as most North Americans do. Naturally the sellers prefer their bids.

  A relative of mine in Vancouver where I stayed recently for a few weeks told me that a house in front of his was bought by a Chinese for 12 million dollars an year back, but the Chinese has not lived in it for a single day. Obviously the Chinese are using such real estate for parking their ill gotten wealth. They usually buy these properties not in their real name, say Li Ti Chang, but under some assumed name e.g. Thomas Liu, to avoid detection.

  Moreover the tax laws in North America are such that while one has to disclose his other assets in his tax returns, e.g. bank accounts, fixed deposits, shares, etc one does not have to disclose his real estate assets.

 The result of all this is that real estate prices have shot up in many cities in North America, and the local people are facing difficulty in buying houses, as they have become too expensive.

India, Pakistan and Bangladesh are uncivilized countries

I hope you are enjoying your stay in Vancouver. I am --- from Mewat(Haryana), famously known as  the land of Meos which is just 50 to 60 Kms from our Capital city.

I have been following your Facebook page since last couple of months. I am really impressed by your uncompromising stand against injustice, tyranny, oppression and uncanny desire to convey the truth fearlessly. Though I don't agree on everything that you say.

I have started to see my own country through the eyes of a victim as there has been constant threat for the existence, property and dignity of minority communities like Muslims, Christians and Dalits.
Anti-minority sentiments are rising exponentially and our great nation has been polarized like never before. I can give you many evidences to validate this statement.

Yesterday while Modi Ji was busy in celebrating Modiversary, the plundering and burning of Muslim homes, places of worship and killing of innocent children and women was going on in Ballabgarh(Haryana). This inhumane act was not even covered by mainstream media.

Another horrific incidence took place against Dalits on 16th May in Nagaur district of Rajasthan. The people of Jat community crushed 3 Dalits under tractor and derobed their women publicly. I can go on and on.

As I have started to consider you as a fighter against injustice and oppression. I ask you how we can totally stop these barbaric acts against minority communities and secure justice to all.
I look forward to receive permanent solutions to stop these inhumane and barbaric acts.

 A hallmark of a civilized society is that minorities therein can live with dignity and honour. It is the duty of the majority community everywhere to ensure that minorities can live with dignity and honour.

 From that standpoint India, Pakistan and Bangladesh are not civilized societies, because minorities cannot live with dignity and honour in any of these countries

A Time to Resign


After the Delhi High Court verdict, it is time for that shameless man Najeeb Jung to resign.
He has been behaving like His Master's Voice, and like Faust, has sold his soul to a Mephistopheles

The British policy in India was divide and rule, i.e. dividing Hindus and Muslims ( see online ' History in the Service of Imperialism' by B.N. Setting up Universities on religious basis was part of the British policy of divide and rule, just like separate electorates created by the Minto-Morley 'Reforms',1909. A University is by definition something universal. How can it be Hindu or Muslim ? So those who set up AMU and BHU were objectively British agents ( whatever they may have regarded themselves subjectively, and whatever others may have regarded them ).

Mamata Banerji is nuts. She is dictatorial, arrogant, and with nothing in her upper storey.
I had earlier supported her, under the impression that she was honest, but  later changed my opinion about her when she displayed her true colours, e.g. by victimizing an upright lady police officer ( Damyanti Sen ), getting Shiladitya Choudhary arrested ( falsely accusing him of being a Maoist ), getting a Professor of Jadhavpur University, Prof. Mahapatra, arrested because he put up some cartoons about her on the social media, and behaving whimsically and like an idiot on several other occasions. This is apart from the financial charges made against her about chit funds etc

Today, 24th May is the birthday of one of my heroes, the great revolutionary Bengali poet Kazi Nazrul Islam, who fought against British rule, casteism, religious bigotry, womens' oppression, and other social evils.

 The organization of which I am a patron ( Justice M.N. Venkatachaliah, former Chief Justice of India, is the Chief patron ), the Kalidas Ghalib Foundation ( see the website kgfindia.com ) held a function in his honour in Kolkata a couple of years back, which I attended. We gave a momento to some relatives of Kazi Nazrul Islam who also attended the function.

Who is correct, Najeeb Jung or Kejriwal?

In the present conflict between Najeeb Jung and Kejriwal several people have asked me for my opinion as to who is correct ?

My opinion is : Kejriwal is correct. Let me explain

1. Before coming to Article 239AA of the Constitution, the Government of NCT of Delhi Act, 1991, and the Transaction of Business of the Government Rules, 1993, we should first consider the matter from the historical perspective.

In ancient and medieval times, the king was supreme. However after the Glorious Revolution of 1688, the principle of democracy and Parliamentary Sovereignty have been firmly established in England and elsewhere. Now it is not the king but the people who are supreme, and they excercize their 'general will', as Rousseau called it, through their representatives in the legislature.
2. What power, if any, does the British king now have ?

According to the eminent constitutional expert Walter Bagehot ( 1826-1877 ), as mentioned in his well known book 'The English Constitution', the British King still has 3 rights :(1) the right to be consulted, (2) the right to encourage, and (3) the right to warn. But apart from these very limited rights, he has to act in accordance with the advice of the Council of Ministers.

3. In Shamsher Singh vs. State of Punjab, A.I.R. 1974 S.C.2192 a 7 Judge bench of the Indian Supreme Court held that the President and Governors in India are like the British King. In other words, they have to act on the advice of the Council of Ministers, and not on their own discretion. This was the legal position even before the 42nd Amendment of the Constitution which amended Article 74 by adding the words " who shall act on the advice of the Council of Ministers ". Thus, the 42nd Amendment only clarified the law, and did not change it

As explained by the Supreme Court in Shamsher Singh's judgment, the expression ' aid and advice ' is only a term of art, and it does not mean that the President or Governor has any discretion in the matter. He has to act according to the advice given by the Council of Ministers, and this is obvious once it is realized that we are living in a democracy, where people rule themselves ( through their elected representatives ). The President of India and the Governors are only formal heads, like the British King

4. It is true that Delhi is not a full fledged state, and certain powers e.g. relating to police and land, are with the Central Government.

However, Delhi is also not a Union Territory, after the 69th Constitutional Amendment which introduced Articla 239AA. Unlike a Union Territory, it has a legislature and a Council of Ministers.
Article 239AA (4) of the Constitution says " There shall be a Council of Ministers with a Chief Minister at the head to aid and advise the Lt. Governor in the excercize of his functions in reference to matters with respect to which the Lt. Governor has power to make laws, except insofar as he is, by or under law required to act in his discretion "

The expression ' aid and advise ' has to treated as a term of art, as held by the Supreme Court in Shamsher Singh's case, and not literally, otherwise democracy will be subverted.

Article 239(6) says that " The Council of Ministers shall be collectively responsible to the Assembly ".. This provision incorporates the principle of democracy that the people rule themselves, through their elected representatives. The stand of Mr. Najeeb Jung is thus totally untenable.

Mr Najeeb Jung claims that he has the authority to appoint officers of the Delhi Government at his discretion, while Kejriwal claims he does not. Assuming that there is some legal uncertainty on this matter, the democratic way of resolving it is that we accept Mr. Kejriwal's view, because he is an elected functionary, and head of a democratically elected body, while Najeeb Jung is not.

It is evident that Najeeb Jung is behaving like His Master's Voice. Like Faust, he has sold his soul to a Mephistopheles.

My Facebook Page

I see that I have 138,000 followers on my facebook page, with 19,000 joining this week. The number of followers joining each week is accelerating.

 And this is despite my calling most of you idiots, which I genuinely believe. As I said repeatedly, I never seek publicity for myself, but I do seek publicity for my ideas, as I believe they are needed for the country's progress.

 I call most of you idiots not to harm you or demoralize you but because I want you to cease being idiots and gullible people whom politicians and others can easily deceive. Indians are still mostly very backward people, full of casteism, communalism, and superstitions, who can be easily befooled by any charlatan in the shape of a politician, a 'baba', etc. I want the Indian masses to stop being stupid and backward, and instead become rational,  scientific and enlightened.

 I am not in a popularity contest, and I do not want your votes. Often I say things which make me very unpopular temporarily. e.g. my statements on Gandhi, Subhas Chandra Bose, Tagore, Allama Iqbal, Saiyyad Ahmed Khan, beef ban, burqa, etc. But I say this because I genuinely believe it has to be said in the country's interest, and I always give reasons in support of my views..
And though you may hate me temporarily on reading my comments,  but after a few days of cool deliberation and discussion with others it is quite possible you will change your opinion and agree with me.

 One thing I can assure you : I will never try to deceive you, and I will only say things which I genuinely believe to be true. Perhaps it is for this reason that my followers ( of all communities, lingual and ethnic groups and regions in India ) are increasing rapidly. People of India ( in which I include Pakistan and Bangladesh ) have been deceived and lied to and taken for a ride for so long that now they are looking for someone who will speak the truth.

gay relationships and gay marriage

Once again, discussing gay relationships and gay marriage

      This evening I had a long discussion with some young ladies in Vancouver about gay relationships and gay marriage. They argued very coolly and persuasively, and convinced me to change my opinion partially on the subject.

     I have an open mind and no ego problem, and I admit that sometimes my opinions may be wholly or partially wrong. I am a human being, and sometimes do commit mistakes. What these young ladies have persuaded me of, by giving me the scientific facts, is that a small percentage of the population have brains that are wired so that they are attracted to the same sex. They love people of the same sex, and there should be no objection or judgment towards that in a free society. I think they're right. Therefore I was at least partially wrong.

      However, I am still of the opinion that ordinarily same sex relationships are unnatural, and heterosexual relationships are natural. That being said, I believe that homosexual relationships should certainly not be made a criminal offense as they are today in India, vide section 377 of the Indian Penal Code. That provision should be abolished immediately.

A walk in Vancouver


23.5.2015, 3 p.m. West Vancouver, Canada
Went for a walk in the morning with a relative with whom I am staying. I had been going for a morning walk everyday with him on the Seawalk, which is a path along the shore built around 1967 for walkers and joggers, but today we turned left towards Ambleside Park, from where one can have a nice view of Stanley Park across the water, and Lions Gate Bridge which connects West Vancouver and Stanley Park ( the bridge was designed on the model of the San Francisco Golden suspension bridge ).

 Vancouver is the city where a lot of Canadian elders come to settle after retirement, because of its relatively temperate climate as contrasted to other parts of Canada which become extremely cold. The average hottest temperature ( in July and August ) here is 22 degrees Celsius, or 72 degrees Fahrenheit, while the average coldest temperature ( in December and January ) is 1 degree centigrade or 34 degrees Fahrenheit. This may be contrasted to Alberta which has minus 30-40 degrees centigrade temperature in winter. Today ( 23.5.2015 ) the temperature was 17 degrees centigrade. I did not need a pullover, but my relative told me to take it along in the car just in case, because the weather can change very fast here.

 I saw a lot of elderly people having a walk, and also many younger people running for exercise. Many North Americans are very health conscious.

 Healthcare is free for all citizens in Canada under the Canada Health Act, 1984, but one has to pay for medicines if one is earning above a certain amount annually. If one is poor, even medicines are given free ( see online Healthcare in Canada ).

 At a pier where we went to we saw some Chinese doing crab fishing. It is done with a kind of net  in which some bait is kept ( usually  some fish, or chicken's head etc ). The rules for crab fishing are very strict. A Dungeness crab  measuring less than 16.5 cm. in width, or a female crab, must be thrown back into the water, and in fact I saw a crab fisher throwing a small crab back into the water.
 I love crab meat. The white meat is in the arms covered with a shell, and one must break the shell with a hammer or something to get to the meat. It is delicious, and I find it tastier than lobster, which is also one of my favourite sea foods.

 On the way we saw young volunteers taking old people, who could not walk themselves, for a walk. Volunteering is common in Canada.

 Towards the end of the walk we saw near the shore a totem pole, belonging to a Squamish band ( tribe ), My relative took my photo standing in front of it, and I will post it later.

 The Squamish Nation are the native Americans ( formerly known as 'Red Indians' ) in British Columbia, Canada. Like all native Americans in America, they were at one time treated very badly by the white people who came from Europe, and driven into reservations, but now they are better off, and own a lot of properties, including a part of Park Royal, the huge shopping Centre in West Vancouver.
 After our walk we went to a Whole Foods shopping centre in Park Royal. I was not very hungry as I had had a heavy breakfast of sardines, ham and fried eggs, so I had a green salad with green peas and chilly sauce. The place is one of an American food supermarket chain specializing in organic food, owned by the company Wholesale Food Market Inc. One can buy all kinds of organic food items there, and also eat at the restaurant there.

 Now I am looking forward to having some delicious

99% Muslims, and 99% Pakistanis are good people


 In the comments on my post ' Massacre of Ismailis in Pakistan ' many views which were very unfair to Muslims in general, and Sunnis and Pakistanis in particular were expressed. Has all my teaching to you Indians gone waste ?

 I have repeatedly told you that 99% people of all communities, sects, lingual and ethnic groups are good people, though they may sometimes be misguided by a few wicked people. This is what my teacher, the great French thinker Rousseau taught me when I was still a young man, a lesson which is deeply embedded in me even now when I am 69 years old, and is a core principle in my philosophy ( see Will Durant's ' The Story of Civilization : Rousseau and Revolution ' ).. I have repeatedly tried to pass on this truthful knowledge to you all, but sometimes I feel I am hitting my head against a wall, and that most of you are absolute blockheads and incorrigible. For the fault of 1% mischievous persons you blame the entire community. Have you no brains ?

 As I explained to you in several articles, e.g. ' What is India ' ( see my blog justicekatju.blogspot.in and on the website kgfindia.com ), India is broadly a country of immigrants, like North America, and this is why it has so much diversity--so many religions, castes, languages, ethnic groups, etc. So the only policy which will work in our sub continent is secularism and giving equal respect to all communities, etc. , the policy of the great Emperor Akbar.

 To demonize Muslims, or Sunnis or Pakistanis is playing into the hands of our enemies who wish Indians ( in whom I include Pakistanis and Bangladeshis ) to hate each other and fight with each other, and thereby keep India backward and poor. When will you people wake up and realize the truth ?.

Massacre of Ismailis in Karachi


22.5.2015, 3 0.m. Vancouver, Canada

 Had lunch in a restaurant called ' Nando's '. It is one of a chain of about 1000 such restaurants of the same name in the world, serving Portuguese African food of Mozambique. specializing in flame grilled peri peri chicken.

 The restaurant is in a huge shopping centre and mall called Park Royal in West Vancouver, spread over about 92,000 sq.m. land, and owned by an Ismaili. Ismailis are one of the richest communities in Canada and elsewhere.

 The owner of the restaurant is also an Ismaili. He was in the restaurant when I came there with my relatives, and was wearing the same black dress worn by the other attendants ( his employees ).

 I started talking to him in Hindustani. He asked me whether I liked the food ? I said that the chicken was one of the most delicious I had tasted in my life.

 I asked him where he was from ? He said he was from Karachi. He then told me of the massacre of 43 Ismailis in Karachi recently ( on 13th May, 2015 ), some of whom were known to him. He was almost crying when he started speaking of the incident

 Ismailis are a small sect of Shias, comprising of just a few hundred thousand, and headed by the Agha Khan. They do not go to regular mosques but to 'jamaatkhanas'. They are a peaceful trading community, and yet they are being slaughtered in Pakistan, he said, simply because they were Shias.

Euthanasia in Canada

In Carter vs. Canada, 2015, the Canadian Supreme Court reversed its own earlier decision in the Sue Rodriguez case, 1993.

In the earlier decision by a 5-4 majority the Court had refused to validate physician assisted death, but in the recent unanimous decision given in February this year it has held the absolute prohibition against it to be invalid.

 Physician assisted death is a form of active euthanasia ( see my judgment in Aruna Shanbaug vs. Union of India ). It terminates the life of a terminally ill person in horrible agony with no known treatment available by a lethal injection.

 As regards the apprehensions that there are dangers in this, or that the person may give consent in a moment of weakness, the Court said that adequate safeguards can be made by Parliament for this, but total prohibition was disproportionate.

 The problem with this decision is that while holding physician assisted death valid, it has suspended the judgment for 12 months, during which period the Canadian Parliament should make a law on the subject. But what will happen to cases arising during this 12 month period ? Would it not have been better for the Canadian Supreme Court to have made a law, as we did in Aruna Shanbaug;s case, subject to some other law made later by  Parliament ?
